Raporti b\u00ebnte t\u00eb ditur gjithashtu se Shqip\u00ebria krahasuar me raportin e nj\u00eb viti m\u00eb par\u00eb kishte pasur ngritje p\u00ebrsa i p\u00ebrket zbatueshm\u00ebris\u00eb s\u00eb ligjeve por nuk n\u00ebnvizonte me holl\u00ebsi fushat n\u00eb t\u00eb cilat zbatimi i ligjit \u00ebsht\u00eb m\u00eb problematik. Gjithsesi edhe pse raporti mund t\u00eb mos i n\u00ebnvizonte k\u00ebto fusha problematike nuk \u00ebsht\u00eb e v\u00ebshtir\u00eb q\u00eb t\u00eb hamend\u00ebsosh se cilat mund t\u00eb jen\u00eb ato.<\/p>\n<p>Duke hedhur nj\u00eb v\u00ebshtrim t\u00eb shpejt\u00eb n\u00eb \u00e7\u00ebshtjet gjyq\u00ebsore q\u00eb k\u00ebrkohen t\u00eb shqyrtohen nga qytetar\u00ebt shqiptar\u00eb n\u00eb gjykat\u00ebn e Strasburgut, mund t\u00eb v\u00ebresh leht\u00eb se ato n\u00eb t\u00eb shumt\u00ebn e rasteve jan\u00eb \u00e7\u00ebshtje pron\u00ebsie dhe penale q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me shkelje t\u00eb s\u00eb drejtave t\u00eb qytetar\u00ebve shqiptar\u00eb n\u00eb raport me drejt\u00ebsin\u00eb shqiptare. Sigurisht q\u00eb evidentimi i fushave p\u00ebrkat\u00ebse \u00ebsht\u00eb i r\u00ebnd\u00ebsish\u00ebm p\u00ebrsa i p\u00ebrket dhe masave q\u00eb mund t\u00eb merren p\u00ebr p\u00ebrmir\u00ebsimin e situat\u00ebs, n\u00eb fakt n\u00eb perceptimin e thjesht\u00eb t\u00eb gj\u00ebrave \u00ebsht\u00eb e v\u00ebshtir\u00eb q\u00eb t\u00eb arrish n\u00eb nj\u00eb p\u00ebrfundim t\u00eb qart\u00eb se \u00e7far\u00eb i mungon me t\u00eb v\u00ebrtet\u00eb drejt\u00ebsis\u00eb shqiptare.<\/p>\n<p>K\u00ebshtu p.sh kur themi shifr\u00ebn 66% t\u00eb vjen nd\u00ebrmend nj\u00ebher\u00eb q\u00eb nga p\u00ebrmasat sasiore mund t\u00eb jen\u00eb se 66% e \u00e7\u00ebshtjeve gjyq\u00ebsore q\u00eb gjykohen drejt\u00eb n\u00eb Shqip\u00ebri dhe n\u00eb k\u00ebt\u00eb rast shifra e 34 % q\u00eb gjykohet keq ting\u00ebllon e frikshme pasi shum\u00eb leht\u00eb mund t\u00eb evindetosh se kjo p\u00ebrb\u00ebn nj\u00eb shkelje flagrante t\u00eb s\u00eb drejtave t\u00eb njeriut. Por jo, mbani frym\u00ebn! Gjendja nuk \u00ebsht\u00eb aq keq. Sigurisht q\u00eb zbatueshm\u00ebria e ligjit nuk matet nga ana sasiore n\u00eb raporte t\u00eb tilla, por nga ana cil\u00ebsore e tij q\u00eb do t\u00eb thot\u00eb q\u00eb vet\u00ebm 66% e vendimeve gjyq\u00ebsore zbatohen kurse pjesa e mbetur zvarritet p\u00ebr t\u00eb mos u zbatuar. Por a nuk \u00ebsht\u00eb kjo 34% nj\u00eb shif\u00ebr alarmuese? A mund ta b\u00ebjm\u00eb gjumin t\u00eb qet\u00eb se drejt\u00ebsia si garantuese e lirive tona individuale po funksionon mir\u00eb n\u00eb Shqip\u00ebri?<\/p>\n<p>Pyetjet besoj se jan\u00eb retorike. Nuk do shkenc\u00eb t\u00eb madhe t\u00eb kuptosh se n\u00eb krahasim me vendet e tjera t\u00eb rajonit, vazhdojm\u00eb t\u00eb mbetemi problematik dhe t\u00eb mbajm\u00eb vendin e par\u00eb p\u00ebr sjellje q\u00eb ndoshta paraardh\u00ebsve tan\u00eb do tu vinte r\u00ebnd\u00eb. Thash\u00eb paraardh\u00ebsve tan\u00eb?A nuk ka di\u00e7ka t\u00eb \u00e7uditshme k\u00ebtu? Por a nuk d\u00ebgjon lart\u00eb e posht\u00eb se sjellja jon\u00eb p\u00ebrkundrejt ligjit \u00ebsht\u00eb si rezultat i s\u00eb shkuar\u00ebs son\u00eb. Me pak fjal\u00eb opinioni i p\u00ebrhapur gjithandej \u00ebsht\u00eb se Shqip\u00ebria duke mos ardhur nga nj\u00eb tradit\u00eb e fort\u00eb shtetformuese ka v\u00ebshtir\u00ebsi n\u00eb zbatimin e ligjit, prandaj do t\u00eb duhet koh\u00eb q\u00eb zbatimi i tij t\u00eb kthehet n\u00eb nj\u00eb edukat\u00eb t\u00eb v\u00ebrtet\u00eb qytetare. Bukur, me k\u00ebt\u00eb justifikim t\u00eb gjith\u00eb besoj se mbeten t\u00eb k\u00ebnaqur.<\/p>\n<p>Drejt\u00ebsia shqiptare n\u00eb radh\u00eb t\u00eb par\u00eb q\u00eb do t\u00eb vazhdoj\u00eb t\u00eb funksionoj\u00eb ashtu si ka funksionuar, partner\u00ebt nd\u00ebrkomb\u00ebtar\u00eb q\u00eb n\u00eb rekomandimet e tyre do t\u00eb duhet t\u00eb kuptojn\u00eb kushtet specifike t\u00eb Shqip\u00ebris\u00eb, k\u00ebshtu q\u00eb mund t\u00eb shkelin nj\u00ebrin sy a ndoshta dhe t\u00eb dy n\u00ebse drejt\u00ebsia nuk zbatohet, r\u00ebnd\u00ebsi ka besoj stabiliteti i vendit q\u00eb do prodhoj\u00eb n\u00eb mos sot, ndoshta pas 10 vjet\u00ebsh e ndoshta dhe m\u00eb shum\u00eb se 10 vjet, demokraci t\u00eb v\u00ebrtet\u00eb legjislative dhe organizatat jo qeveritare q\u00eb do t\u00eb duhet t\u00eb marrin projekte shum\u00eb vje\u00e7are p\u00ebr t\u00eb krijuar kultur\u00ebn e duhur ligj zbatuese.<\/p>\n<p>Nj\u00eb moment! Apo ndoshta ia kan\u00eb marr\u00eb dor\u00ebn nga regjimi i kaluar q\u00eb kur u kujtoje gjyqtar\u00ebve t\u00eb koh\u00ebs teknik\u00ebn legjislative, meqen\u00ebse akte t\u00eb tyre ligjor\u00eb binin n\u00eb kund\u00ebrshtim m\u00eb ligjin, ata th\u00ebrrisnin eg\u00ebr po pse vendimi i partis\u00eb do t\u00eb gjykohet nga procedurat? Dhe k\u00ebshtu zbatonin vendimet e partis\u00eb-shtet duke shkelur brutalisht t\u00eb drejtat e qytetar\u00ebve shqiptar\u00eb q\u00eb n\u00eb at\u00eb ishull stalinizmi q\u00eb ishte Shqip\u00ebria nuk kishin se ku mund t\u00eb ankoheshin.<\/p>\n<p>Koh\u00ebt p\u00ebr fat t\u00eb mir\u00eb kan\u00eb ndryshuar, njer\u00ebzit g\u00ebzojn\u00eb t\u00eb gjitha drejtat politike dhe individuale por drejt\u00ebsia shqiptare edhe pse nuk \u00ebsht\u00eb m\u00eb abuzive ndaj t\u00eb drejtave politike t\u00eb qytetar\u00ebve shqiptar\u00eb si n\u00eb t\u00eb kaluar\u00ebn \u00ebsht\u00eb abuzive ndaj lirive t\u00eb tjera po aq t\u00eb ndjeshme si \u00ebsht\u00eb ajo e pron\u00ebs.<\/p>\n<p>Sot, pas nj\u00ebzet vjet\u00ebsh tranzicioni , Shqip\u00ebria mund t\u00eb jet\u00eb nga t\u00eb vetmet vende n\u00eb ish-Evrop\u00ebn Lindore q\u00eb ende nuk e ka zgjidhur drejt k\u00ebt\u00eb problem dhe akoma m\u00eb keq n\u00eb disa raste me ndihm\u00ebn e drejt\u00ebsis\u00eb \u00ebsht\u00eb b\u00ebr\u00eb dhe tjet\u00ebrsim pronash si ka evidentuar me t\u00eb drejt\u00eb Gjykata e Strasburgut. Vullneti politik i p\u00ebrcaktuar ndonj\u00ebher\u00eb dhe nga qarqe t\u00eb ndryshme dhe t\u00eb dyshimta ekonomike ka p\u00ebrcaktuar dhe perfomanc\u00ebn e drejt\u00ebsis\u00eb shqiptare, \u00e7ka e ka b\u00ebr\u00eb at\u00eb n\u00eb perceptimin popullor nj\u00eb nga aspektet m\u00eb negative t\u00eb element\u00ebve t\u00eb qeverisjes.<\/p>\n<p>Nj\u00eb poet bejtexhi shqiptar n\u00eb shekullin e XVIII, Hasan Zyko Kamberi kas shkruar se \u201cKadiut,(gjyqtarit) t\u2019i rr\u00ebfesh paran\u00eb\/Ters e v\u00ebrtit sheriat(ligjin)\/P\u00ebr para se \u00e7\u2019e shet t\u2019an\u00eb\/Ja di kimen\u00eb paras\u00eb\u2026\u201d.
