Konferenca i kushtohej nism\u00ebs s\u00eb nd\u00ebrmarr\u00eb prej Qendr\u00ebs p\u00ebr Nisma Ligjore Qytetare p\u00ebr p\u00ebrllogaritjen e kostos s\u00eb zbatueshm\u00ebris\u00eb s\u00eb Ligjit nr. 9669, dat\u00eb 18.12.2006, \u201cP\u00ebr masat ndaj dhun\u00ebs n\u00eb marr\u00ebdh\u00ebniet familjare\u201d, nj\u00eb prej standardeve t\u00eb nj\u00ebsuar p\u00ebr mosdiskriminim n\u00eb familje. M\u00eb kishte b\u00ebr\u00eb p\u00ebrshtypje q\u00eb, kund\u00ebr \u00e7do arsyetimi qoft\u00eb dhe formal, ky ligj ishte miratuar pa aneksin e domosdosh\u00ebm t\u00eb buxhetit dhe askush nuk ishte marr\u00eb me k\u00ebt\u00eb kusht q\u00eb u jep fuqi veprimi ligjeve, megjith\u00ebse kishin kaluar gati pes\u00eb vjet.<\/p>\n<p>N\u00eb gjuh\u00ebn e eurokultur\u00ebs juridike, miratimi i ligjeve pa marrjen e p\u00ebrgjegj\u00ebsis\u00eb financiare t\u00eb domosdoshme p\u00ebr zbatimin e tyre \u00ebsht\u00eb nj\u00eb akt demagogjik. Esht\u00eb, si t\u00eb thuash, nj\u00eb propagand\u00eb p\u00ebrmes ligjit, dometh\u00ebn\u00eb t\u00eb b\u00ebsh sikur po merresh me nj\u00eb \u00e7\u00ebshtje duke mos u marr\u00eb aspak me t\u00eb.<\/p>\n<p>E interesuar p\u00ebr k\u00ebt\u00eb mospajtim, q\u00eb teknikisht n\u00eb gjuh\u00ebn e hartimit t\u00eb ligjeve quhet flagrant, m\u00ebsova se kjo kishte ndodhur dhe m\u00eb par\u00eb e m\u00eb pas me veprimtarin\u00eb ligjv\u00ebn\u00ebse n\u00eb Shqip\u00ebri dhe se askujt nuk i b\u00ebnte p\u00ebrshtypje pse nj\u00eb ligj, p\u00ebr m\u00eb tep\u00ebr nj\u00eb ligj p\u00ebr mbrojtje e barazi, ishte miratuar pa fatur\u00eb financiare, madje pa e vrar\u00eb mendjen sa mund t\u00eb ishte kjo kosto, si qe rasti i Ligjit nr. 9669, dat\u00eb 18.12.2006, \u201cP\u00ebr masat ndaj dhun\u00ebs n\u00eb marr\u00ebdh\u00ebniet familjare\u201d.<\/p>\n<p>Duke qen\u00eb se diskriminimi dhe dhuna m\u00eb s\u00eb pari drejtohen ndaj pjes\u00ebs me m\u00eb pak mbrojtje e siguri n\u00eb shoq\u00ebri, p\u00ebrllogaritja e kostos s\u00eb ligjit p\u00ebr mbrojtjen e individit prej dhun\u00ebs n\u00eb familje ishte nd\u00ebrmarr\u00eb prej nj\u00eb grupi veprimtaresh zonja, t\u00eb cilat, duke pasur mb\u00ebshtetjen e UN WOMEN, kishin kryer v\u00ebzhgime, kishin organizuar anketa, kishin shp\u00ebrndar\u00eb pyet\u00ebsor\u00eb dhe kishin statistikuar t\u00eb dh\u00ebna duke iu referuar kat\u00ebr nj\u00ebsive administrative t\u00eb vendit, kat\u00ebr qarqeve. Prej k\u00ebtyre t\u00eb dh\u00ebnave mund t\u00eb p\u00ebrfytyrohet kostoja e p\u00ebrgjithshme dhe, n\u00eb mos qoft\u00eb pjes\u00eb e ndikimit t\u00eb efektit kriz\u00eb, vitin e ardhsh\u00ebm mund t\u00eb parashikohet n\u00eb buxhet, n\u00eb m\u00ebnyr\u00eb q\u00eb institucionet e ngarkuara me detyra ligjore (policia, gjykatat), por edhe vet\u00eb viktimat e dhun\u00ebs n\u00eb familje, t\u00eb jen\u00eb t\u00eb motivuara p\u00ebr t\u00eb kryer detyr\u00ebn dhe p\u00ebr t\u00eb arritur zbatueshm\u00ebrin\u00eb e ligjit.<\/p>\n<p>Me t\u00eb drejt\u00eb hartimi i nj\u00eb projekti p\u00ebr koston e zbatueshm\u00ebris\u00eb s\u00eb k\u00ebtij ligji ka nisur me p\u00ebrllogaritjen e koh\u00ebs faktike t\u00eb shpenzuar prej gjyqtarit dhe punonj\u00ebsit t\u00eb policis\u00eb p\u00ebr zbatimi e urdhrave t\u00eb mbrojtjes dhe urdhrave t\u00eb mbrojtjes s\u00eb menj\u00ebhershme (terma t\u00eb ligjit vet\u00eb). Duke i mesatarizuar t\u00eb dh\u00ebnat e anketimit rezulton kjo evidenc\u00eb kostoje n\u00eb koh\u00eb:<\/p>\n<p>1. Koha mesatare e \u00e7do gjyqtari p\u00ebr t\u00eb d\u00ebgjuar pal\u00ebt n\u00eb proces ka rezultuar 1 or\u00eb e 24 minuta.<br \/>\n2. P\u00ebr p\u00ebrgatitjen e vendimit \u00e7do gjyqtar harxhon mesatarisht 1 or\u00eb e 15 minuta.<br \/>\n3. P\u00ebr t\u00eb l\u00ebshuar urdhrin e menj\u00ebhersh\u00ebm t\u00eb mbrojtjes \u00e7do gjyqtar harxhon 1 or\u00eb e 10 minuta.<br \/>\n4. Rastet e komplikuara z\u00ebn\u00eb mesatarisht 5 n\u00eb 10 raste p\u00ebr nj\u00eb punonj\u00ebs policie.<br \/>\n5. Nj\u00eb punonj\u00ebs policie p\u00ebr nj\u00eb rast t\u00eb till\u00eb harxhon 9 or\u00eb e 30 minuta.<br \/>\n6. N\u00eb rast se punonj\u00ebsi i policis\u00eb shoq\u00ebron viktim\u00ebn n\u00eb streh\u00ebza harxhon mesatarisht 1 or\u00eb e 50 minuta.<br \/>\n7. N\u00eb rastet kur viktima paraqitet tek punonj\u00ebsi i policis\u00eb me f\u00ebmij\u00eb t\u00eb mitur, koha e harxhuar \u00ebsht\u00eb 3 or\u00eb e 20 minuta.<br \/>\n8. P\u00ebr p\u00ebrgatitjen e k\u00ebrkes\u00eb-padis\u00eb punonj\u00ebsi i policis\u00eb harxhon 1 or\u00eb e 20minuta.<br \/>\n9. Q\u00eb punonj\u00ebsi i policis\u00eb t\u00eb kompletoj\u00eb dokumentacionin duhen af\u00ebrsisht 3 or\u00eb.<\/p>\n<p>K\u00ebto t\u00eb dh\u00ebna e b\u00ebjn\u00eb problemin m\u00eb konkret se sa mund t\u00eb duket dhe e kthejn\u00eb veprimin e ligjit nga agjitacion dhe konformiz\u00ebm ndaj organizmave dhe standardeve nd\u00ebrkomb\u00ebtare n\u00eb nj\u00eb \u00e7\u00ebshtje q\u00eb meriton p\u00ebrgjegj\u00ebsi.<\/p>\n<p>Plot\u00ebsimi i m\u00ebtejsh\u00ebm i projektit leht\u00ebsohet duke qen\u00eb se koha n\u00eb or\u00eb nuk \u00ebsht\u00eb e v\u00ebshtir\u00eb t\u00eb kthehet n\u00eb koh\u00eb t\u00eb pagueshme dhe m\u00eb tej n\u00eb para, duke qen\u00eb se pagat e punonj\u00ebsve t\u00eb policis\u00eb dhe t\u00eb gjyqtar\u00ebve jan\u00eb t\u00eb indeksuara. T\u00eb dh\u00ebnat jan\u00eb statistikuar n\u00eb m\u00ebnyr\u00eb t\u00eb besueshme, duke qen\u00eb se jan\u00eb s\u00eb paku 64 intervista me funksionar\u00eb t\u00eb p\u00ebrfshir\u00eb n\u00eb zbatimin e deritash\u00ebm t\u00eb ligjit (gjyqtar\u00eb, prokuror\u00eb, punonj\u00ebs policie dhe vet\u00eb viktimat e dhun\u00ebs) n\u00eb qytetet Kuk\u00ebs, Durr\u00ebs, Kor\u00e7\u00eb dhe Tiran\u00eb. Kostoja e zbatimit t\u00eb urdhrave t\u00eb mbrojtjes s\u00eb menj\u00ebhershme \u00ebsht\u00eb p\u00ebrllogaritur ndaras. Detyra e ligjv\u00ebn\u00ebsit k\u00ebshtu \u00ebsht\u00eb let\u00ebsuar shum\u00eb dhe mbetet t\u00eb verifikohet se \u00e7far\u00eb vullneti ka dhe sa i sinqert\u00eb ka qen\u00eb miratimi i ligjit. N\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrmbledhur n\u00eb dy tabelat n\u00eb vijim paraqitet kostoja e koh\u00ebs s\u00eb shpenzuar prej gjykat\u00ebs (evidenca e par\u00eb) dhe prej policis\u00eb (evidenca e dyt\u00eb), e kthyer n\u00eb para, dometh\u00ebn\u00eb e buxhetizuar. Dy rastet duken t\u00eb ngjashme, por jan\u00eb krejt t\u00eb kund\u00ebrt me nj\u00ebri-tjetrin. N\u00eb rastin e par\u00eb, p\u00ebr demagogji, ligji \u00ebsht\u00eb miratuar, por zbatueshm\u00ebria i \u00ebsht\u00eb l\u00ebn\u00eb vullnetit t\u00eb lir\u00eb dhe koh\u00ebs s\u00eb tep\u00ebrt t\u00eb institucioneve t\u00eb ngarkuara me p\u00ebrgjegj\u00ebsi.<\/p>\n<p>Q\u00eb do t\u00eb thot\u00eb t\u00eb mos shpenzohet asgj\u00eb plus. N\u00eb rastin e dyt\u00eb, p\u00ebrkundrazi, mosparaqitja e kostos dhe miratimi pa flet\u00ebn e buxhetit ka kuptimin se buxheti do ta p\u00ebrballoj\u00eb koston aq sa t\u00eb rezultoj\u00eb. Nj\u00eb teknologji krejt tjet\u00ebr kan\u00eb zbatuar hartuesit e projekt-kostos s\u00eb ligit p\u00ebr dhun\u00ebn n\u00eb familje: n\u00eb mend\u00ebsin\u00eb e tyre nuk ka qen\u00eb i tep\u00ebrt edhe z\u00ebri \u201cshpenzime t\u00eb viktim\u00ebs\u201d p\u00ebr koh\u00eb t\u00eb humbur nga puna, shpenzime udh\u00ebtimi, shpenzime avokatie, shpenzime kujdestarie p\u00ebr f\u00ebmij\u00ebt, q\u00eb jan\u00eb t\u00eb pashmangshme n\u00eb raste t\u00eb tilla. Kostoja e viktim\u00ebs paraqitet si n\u00eb tabel\u00ebn e m\u00ebposhtme dhe vet\u00ebm prej saj mund t\u00eb p\u00ebrfytyrohet sa harxhon shoq\u00ebria shqiptare p\u00ebr vet\u00ebmbrojtje prej dhun\u00ebs n\u00eb familje.
