B\u00ebhet fjal\u00eb p\u00ebr nj\u00eb diskutim t\u00eb madh n\u00eb demokraci: n\u00ebse gjykatat duhet t\u00eb japin vendime duke u bazuar tek parimet dhe morali. Bota ka njohur shum\u00eb raste kur vendimet e gjykatave kan\u00eb vendosur gur\u00eb kilometrik\u00eb n\u00eb rrug\u00ebn drejt shtetit t\u00eb s\u00eb drejt\u00ebs. Precedent\u00ebt e tyre kan\u00eb frym\u00ebzuar zhvillimin e nj\u00eb shoq\u00ebrie m\u00eb t\u00eb lir\u00eb.<\/p>\n<p><strong>A ishte ky rasti n\u00eb Shqip\u00ebri?<\/strong><\/p>\n<p>I pyetur n\u00eb lidhje me vendimet e Komisionit Qendror t\u00eb Zgjedhjeve dhe Kolegjit Zgjedhor, ambasadori amerikan shprehu zhg\u00ebnjim p\u00ebr q\u00ebndrimet politike t\u00eb KQZ-s\u00eb dhe n\u00eb nj\u00eb far\u00eb m\u00ebnyr\u00eb la t\u00eb kuptohet se Kolegji nuk mund t\u00eb zgjidh\u00eb k\u00ebt\u00eb kriz\u00eb politike duke dh\u00ebn\u00eb interpretime ligjore. Por n\u00eb t\u00eb v\u00ebrtet\u00eb duket se problemi n\u00eb Shqip\u00ebri u komplikua kur Kolegji vendosi t\u00eb b\u00ebj\u00eb interpretime politike. K\u00ebshtu, vendimi i fundit i Kolegjit Zgjedhor ishte tep\u00ebr i shkurt\u00ebr, i p\u00ebrqendruar thuajse n\u00eb nj\u00eb fjali, at\u00eb q\u00eb Kodi Zgjedhor nuk parashikon mbivendosje t\u00eb afateve ligjore p\u00ebr ankimimet.<\/p>\n<p>PS kishte humbur k\u00ebt\u00eb afat duke mos b\u00ebr\u00eb ankimim q\u00eb n\u00eb maj p\u00ebr pavlefshm\u00ebri t\u00eb zgjedhjeve. Edhe vendimi pararend\u00ebs, ai p\u00ebr hetimin e t\u00eb gjitha kutive, tregoi se sa e r\u00ebnd\u00ebsishme \u00ebsht\u00eb procedura. Kurse vendimi i par\u00eb, i Kolegjit t\u00eb drejtuar nga Tom Ndreca, ishte ai q\u00eb vulosi fatin e padive pasardh\u00ebse pasi i dha fund debatit p\u00ebr vlefshm\u00ebrin\u00eb e flet\u00ebve t\u00eb hedhura gabim.<\/p>\n<p>Nd\u00ebrsa zgjatej pa fund duke interpretuar t\u00eb drejt\u00ebn e KQZ-s\u00eb p\u00ebr t\u00eb nxjerr\u00eb akte normative e individuale, kur ra fjala tek num\u00ebrimi i votave t\u00eb hedhura gabim, Kolegji tha shkurt: \u00ebsht\u00eb e drejt\u00eb kushtetuese num\u00ebrimi i \u00e7do vote. Ky interpretim politik n\u00eb t\u00eb v\u00ebrtet\u00eb shkat\u00ebrroi t\u00eb gjith\u00eb procesin. Komisioneri p\u00ebr Zgjerimin, Stefan Fyle, u lexoi deputet\u00ebve shqiptar\u00eb pjes\u00eb nga raporti i ODIHR p\u00ebr zgjedhjet e vitit 2007, duke u theksuar pjes\u00ebn se votat e hedhura gabim ishin t\u00eb pavlefshme. N\u00eb logjik\u00ebn e Per\u00ebndimit nj\u00eb \u00e7\u00ebshtje e till\u00eb nuk zgjidhet p\u00ebrve\u00e7se duke iu referuar precedentit. Kaq mjafton dhe \u00e7\u00ebshtja nuk komplikohet p\u00ebr asnj\u00eb arsye.<\/p>\n<p>Por, n\u00ebse n\u00eb vijim t\u00eb k\u00ebsaj fraze n\u00eb raportin e ODIHR lexon se \u00e7far\u00eb thuhet p\u00ebr Kolegjin q\u00eb n\u00eb vitin 2007, v\u00eb duart n\u00eb kok\u00eb. Parimi i precedentit nuk ekziston, p\u00ebr \u00e7\u00ebshtje t\u00eb nj\u00ebjta jepen vendime t\u00eb ndryshme, nj\u00eb l\u00ebmsh ligjor. Pastaj vijm\u00eb tek dita kur Bashkimi Europian e SHBA deklarojn\u00eb se vendimi i Kolegjit nuk i ka fshir\u00eb dyshimet q\u00eb kishin ata p\u00ebr baz\u00ebn ligjore q\u00eb u p\u00ebrdor p\u00ebr t\u00eb hapur kutit\u00eb e p\u00ebr t\u00eb vler\u00ebsuar si t\u00eb vlefshme votat e hedhura gabim.<\/p>\n<p>Por a \u00ebsht\u00eb e v\u00ebrtet\u00eb q\u00eb Per\u00ebndimi k\u00ebrkonte q\u00eb shteti ligjor t\u00eb zgjidhte mishmashin e krijuar pas vendimit t\u00eb Ristanit p\u00ebr t\u00eb num\u00ebruar votat e hedhura gabim? Nj\u00eb jo absolute. K\u00ebrkesa e hedhur prej tyre p\u00ebr t\u00eb marr\u00eb nj\u00eb opinion nga Komisioni i Venecias, nj\u00eb trup\u00eb jurist\u00ebsh pran\u00eb K\u00ebshillit t\u00eb Europ\u00ebs, ishte qartazi nj\u00eb shprehje e mosbesimit ndaj Kolegjit Zgjedhor dhe institucioneve shqiptare, q\u00eb mbrohen me zjarr nga mazhoranca.<\/p>\n<p>Tani q\u00eb zgjedhjet kan\u00eb marr\u00eb vler\u00ebsimin negativ nga nd\u00ebrkomb\u00ebtar\u00ebt, gjithmon\u00eb e m\u00eb shum\u00eb po d\u00ebgjojm\u00eb nga kryeministri Sali Berisha t\u00eb thot\u00eb me g\u00ebzim se shqiptar\u00ebt dol\u00ebn masivisht n\u00eb zgjedhje, thua se pjes\u00ebmarrja rekord e shqiptar\u00ebve \u00ebsht\u00eb nj\u00eb tregues i vot\u00ebs pro tij. Edhe n\u00eb mbledhjen e K\u00ebshillit Komb\u00ebtar e p\u00ebrs\u00ebriti k\u00ebt\u00eb gj\u00eb, pa guxuar p\u00ebr asnj\u00eb moment t\u00eb b\u00ebj\u00eb nj\u00eb analiz\u00eb p\u00ebr votat e hedhura p\u00ebr partin\u00eb e tij, por duke u krenuar me faktin se di t\u00eb b\u00ebj\u00eb koalicion paraprak: lexo, pazare t\u00eb ndyra. N\u00eb nj\u00eb vend normal nj\u00eb forc\u00eb politike duhet t\u00eb testoj\u00eb elektoratin e saj, at\u00eb q\u00eb voton p\u00ebr logon e saj, e jo t\u00eb merret me rezultatet e t\u00eb tjer\u00ebve.<\/p>\n<p>Por p\u00ebr t\u00eb mos u zgjatur, a ekziston mund\u00ebsia q\u00eb populli t\u00eb ket\u00eb dal\u00eb masivisht n\u00eb k\u00ebto zgjedhje, t\u00eb ket\u00eb vendosur nj\u00eb rekord, e t\u00eb ket\u00eb votuar p\u00ebr t\u00eb mbajtur qeverin\u00eb? \u00cbsht\u00eb e paimagjinueshme q\u00eb njer\u00ebzit t\u00eb dalin m\u00eb shum\u00eb n\u00eb votime p\u00ebr t\u00eb ruajtur status-quo-n\u00eb. Ata dalin p\u00ebr t\u00eb ndryshuar. Nuk \u00ebsht\u00eb nj\u00eb qeverisje aq e mir\u00eb sa t\u00eb \u00e7oj\u00eb njer\u00ebzit pesh\u00eb n\u00eb votime p\u00ebr t\u00eb mbajtur at\u00eb qeveri.<\/p>\n<p>Ta harrojm\u00eb se ndodh nj\u00eb gj\u00eb e till\u00eb n\u00eb vendin ton\u00eb, q\u00eb njer\u00ebzit t\u00eb dalin n\u00eb votime m\u00eb shum\u00eb p\u00ebr t\u00eb mbajtur nj\u00eb qeveri. Numri i lart\u00eb i votuesve n\u00eb nj\u00eb demokraci \u00ebsht\u00eb nj\u00eb tregues q\u00eb b\u00ebn me dhimbje koke qeverin\u00eb. Kjo ka qen\u00eb nj\u00eb sfid\u00eb e madhe p\u00ebr opozit\u00ebn, q\u00eb ka nxjerr\u00eb kaq shum\u00eb njer\u00ebz n\u00eb votime dhe ia ka dal\u00eb q\u00eb zgjedhjet lokale t\u2019i kthej\u00eb n\u00eb referendum popullor. Nuk \u00ebsht\u00eb kollaj t\u2019u thuash njer\u00ebzve q\u00eb dilni e votoni p\u00ebr t\u00eb rr\u00ebzuar Berish\u00ebn, kur ata duan t\u00eb ken\u00eb p\u00ebrpara syve nj\u00eb kryebashkiak, t\u00eb cilit t\u2019i k\u00ebrkojn\u00eb llogari p\u00ebr gj\u00ebrat e p\u00ebrditshme.<\/p>\n<p>Nuk \u00ebsht\u00eb e leht\u00eb t\u2019u nxjerr\u00ebsh p\u00ebrpara votuesve s\u00ebrish t\u00eb nj\u00ebjt\u00ebt kryebashkiak\u00eb, q\u00eb kan\u00eb vuajtur faktin se Berisha u ka shteruar fondet, q\u00eb jan\u00eb konsumuar, si\u00e7 ndodh r\u00ebndom me pushtetin, e tu thuash m\u2019i votoni s\u00ebrish. Ajo q\u00eb ndodhi me 8 maj ka qen\u00eb frym\u00eb p\u00ebr ndryshim. Sesa e ndaloi k\u00ebt\u00eb frym\u00eb Berisha, nuk e dim\u00eb, por ai ishte lajmi m\u00eb i mir\u00eb n\u00eb ato zgjedhje. Lajmi i keq \u00ebsht\u00eb se gjith\u00e7ka ndodhi me grabitjen e Tiran\u00ebs, mund t\u00eb ket\u00eb ndikuar n\u00eb daljen e votuesve n\u00eb zgjedhjet e ardhshme. Kjo \u00ebsht\u00eb detyra kryesore e opozit\u00ebs tani e tutje, t\u00eb injektoj\u00eb besim tek zgjedhjet.<\/p>\n<p>Por \u00e7far\u00eb ka ndodhur gjat\u00eb k\u00ebtyre dit\u00ebve? Dy debate jan\u00eb hapur: i pari ka t\u00eb b\u00ebj\u00eb me ndryshimet kushtetuese, i dyti lidhet me faktin se a duhet t\u00eb b\u00ebj\u00eb koalicion me LSI-n\u00eb Partia Socialiste, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb fitoj\u00eb n\u00eb zgjedhjet e ardhshme. Ndryshimet kushtetuese lidhen gjithmon\u00eb me zgjedhjen e presidentit, e ky debati p\u00ebr koalicionin me Met\u00ebn thuajse nuk ka kuptim n\u00eb k\u00ebto dit\u00eb.<\/p>\n<p>N\u00eb dit\u00ebn kur ODIHR ka nisur t\u00eb hartoj\u00eb raportin p\u00ebrfundimtar p\u00ebr zgjedhjet e 8 majit, mb\u00ebrritja e sekserit t\u00eb qeveris\u00eb, Volfgang Grosruk, tregon se qeveria ka p\u00ebr synim kryesor t\u00eb shk\u00ebpus\u00eb ndonj\u00eb vler\u00ebsim nga raporti p\u00ebrfundimtar. M\u00eb pas do t\u00eb nis\u00eb betej\u00ebn n\u00eb tribuna e p\u00ebrpara kamerave p\u00ebr t\u00eb th\u00ebn\u00eb se zgjedhjet po p\u00ebrmir\u00ebsohen, se duhet nj\u00eb reform\u00eb, se do i l\u00ebr\u00eb opozit\u00ebs mund\u00ebsin\u00eb t\u00eb b\u00ebj\u00eb propozim e k\u00ebshtu me radh\u00eb.<\/p>\n<p>Opozita i ka hyr\u00eb me qejf k\u00ebtij debati, por n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb nuk arrihet askund. Sot kemi mb\u00ebrritur n\u00eb pik\u00ebn kur dy zyrtar\u00ebt e lart\u00eb t\u00eb BE, Ashton dhe Fyle thon\u00eb pa dorashka se vendi nuk di t\u00eb mbaj\u00eb zgjedhje.<\/p>\n<p>E kush \u00ebsht\u00eb zgjidhja? Ajo q\u00eb guxoi dhe e artikuloi n\u00eb t\u00eb p\u00ebrditshmen e njohur Nju Jork Tajms Daniel Korski, an\u00ebtar i K\u00ebshillit Europian p\u00ebr Marr\u00ebdh\u00ebnie me Jasht\u00eb. Vendi t\u00eb mbaj\u00eb zgjedhje t\u00eb jasht\u00ebzakonshme, t\u00eb cilat do organizohen nga komuniteti nd\u00ebrkomb\u00ebtar. Nj\u00eb operacion gjigant, nj\u00ebsoj si n\u00eb fillimin e viteve \u201990 apo n\u00eb vitin 1997.
