Ligji q\u00eb ka hartuar qeveria \u201cBerisha\u201d, votuar parlamenti me kryetare Jozefina Topallin dhe dekretuar nga presidenti Bamir Topi ishte b\u00ebr\u00eb sipas p\u00ebrvoj\u00ebs m\u00eb t\u00eb mir\u00eb shteteve an\u00ebtare t\u00eb BE-s\u00eb, q\u00eb kan\u00eb nivel t\u00eb mjaftuesh\u00ebm t\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave personale, shtete q\u00eb kan\u00eb ratifikuar konvent\u00ebn e vitit 1981, \u201cP\u00ebr mbrojtjen e individ\u00ebve nga p\u00ebrpunimi automatik i t\u00eb dh\u00ebnave personale\u201d, si dhe protokollin shtes\u00eb t\u00eb saj, q\u00eb garantojn\u00eb mbrojtjen e mjaftueshme t\u00eb t\u00eb dh\u00ebnave personale, n\u00eb p\u00ebrputhje me t\u00eb gjitha k\u00ebrkesat e direktiv\u00ebs 95\/46\/EC, t\u00eb Parlamentit dhe K\u00ebshillit t\u00eb Europ\u00ebs, dat\u00eb 24 tetor 1995, \u201cP\u00ebr mbrojtjen e individ\u00ebve n\u00eb lidhje me p\u00ebrpunimin e t\u00eb dh\u00ebnave personale dhe qarkullimin e lir\u00eb t\u00eb t\u00eb dh\u00ebnave\u201d.<\/p>\n<p>Pak vite m\u00eb par\u00eb, kur ky regjist\u00ebr nuk ishte hartuar ende dhe kur n\u00eb Shqip\u00ebri p\u00ebrflitej se ishte vendosur q\u00eb koncesionin p\u00ebr kartat dhe pasaportat e reja t\u00eb shqiptar\u00ebve do ta fitonte ajo firm\u00eb q\u00eb n\u00eb t\u00eb v\u00ebrtet\u00eb e fitoi, dikush q\u00eb shoq\u00ebronte z\u00ebvend\u00ebsministrin e brendsh\u00ebm Ferdinand Pone gjat\u00eb nj\u00eb udh\u00ebtimi n\u00eb Vjen\u00eb tregonte jo pa humor se si kishin dashur t\u00eb futeshin n\u00eb serverin e t\u00eb dh\u00ebnave p\u00ebr t\u00eb gjetur, p\u00ebr gallat\u00eb, se ku rrinte n\u00eb Baden, n\u00eb periferi t\u00eb kryeqytetit austriak, ish-kryeministri shqiptar, Fatos Nano.<\/p>\n<p>Sigurisht q\u00eb nuk hyn\u00eb n\u00eb server, por shoq\u00ebruesi i Ferdinand Pones, shprehte shqet\u00ebsimin se \u00e7far\u00eb do t\u00eb ndodhte n\u00eb Tiran\u00eb, n\u00ebse dikush do t\u00eb donte t\u00eb futej n\u00eb regjistrin e t\u00eb dh\u00ebnave personale t\u00eb shtetasve. A do t\u00eb ishte database e t\u00eb dh\u00ebnave personale nj\u00eb arm\u00eb m\u00eb shum\u00eb n\u00eb duart e pushtetit kund\u00ebr individ\u00ebve, q\u00eb i lan\u00eb t\u00eb dh\u00ebnat personale, bashk\u00eb me shenjat e gisht\u00ebrinjve, n\u00eb em\u00ebr t\u00eb shtetb\u00ebrjes dhe nj\u00eb vendi m\u00eb t\u00eb sigurt brenda dhe m\u00eb t\u00eb respektuar jasht\u00eb.<\/p>\n<p>Por fakti q\u00eb ky regjist\u00ebr \u00ebsht\u00eb shp\u00ebrndar\u00eb ndoshta nd\u00ebr qindra destinacione, \u00ebsht\u00eb shum\u00eb shqet\u00ebsues. Jo pse \u00ebsht\u00eb n\u00eb duart e mia, por n\u00eb ato t\u00eb atyre q\u00eb i shp\u00ebrdorojn\u00eb dhe abuzojn\u00eb me k\u00ebto t\u00eb dh\u00ebna. Mund t\u2019i ket\u00eb ndodhur shum\u00ebkujt, p\u00ebrpara votimeve t\u00eb 8 majit 2011, q\u00eb n\u00eb celular t\u2019i vinte urimi p\u00ebr dit\u00eblindje nga kandidati i PD-s\u00eb, Lul\u00ebzim Basha. Kur kjo u b\u00eb balt\u00eb, PS-ja akuzoi kandidatin Basha, q\u00eb sapo kishte dh\u00ebn\u00eb dor\u00ebheqjen nga posti i Ministrit t\u00eb Brendsh\u00ebm q\u00eb kishte n\u00ebn var\u00ebsi edhe drejtorin\u00eb Gjendjes Civile, se kishte shkelur hapur ligjin p\u00ebr mbrojtjen e te dh\u00ebnave personale dhe t\u00eb privat\u00ebsis\u00eb, sepse kur opozita kishte k\u00ebrkuar emrat e personave q\u00eb kishin nd\u00ebrruar gjendjen civile, drejtori Armand Teliti deklaroi se t\u00eb dh\u00ebnat personale nuk mund t\u2019i jepen personave t\u00eb tjer\u00eb.<\/p>\n<p>N\u00eb vende t\u00eb tjera ku \u00ebsht\u00eb n\u00eb fuqi ligji p\u00ebr p\u00ebrdorimin e t\u00eb dh\u00ebnave personale, marrja dhe nxjerrja n\u00eb opazar e t\u00eb dh\u00ebnave t\u00eb tilla konsiderohet krim dhe nd\u00ebshkohet sipas ligjeve n\u00eb fuqi. Ashtu si edhe n\u00eb Shqip\u00ebri, si\u00e7 e parasheh ligji nr. 9887, dat\u00eb 10.3.2008, \u201cP\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale\u201d, neni 2 i t\u00eb cilit ka parimin e p\u00ebrgjithsh\u00ebm q\u00eb \u201cP\u00ebrpunimi i ligjsh\u00ebm i t\u00eb dh\u00ebnave personale b\u00ebhet duke respektuar dhe garantuar t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut dhe, n\u00eb ve\u00e7anti, t\u00eb drejt\u00ebn e ruajtjes s\u00eb jet\u00ebs private\u201d.<\/p>\n<p>Por k\u00ebto t\u00eb dh\u00ebna personale jan\u00eb maja e ajsbergut. Me qindra ankesa i jan\u00eb drejtuar Komisionerit p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave Personale, kund\u00ebr publikimit t\u00eb t\u00eb dh\u00ebnave personale t\u00eb individ\u00ebve t\u00eb ndrysh\u00ebm, pa dijenin\u00eb dhe d\u00ebshir\u00ebn e tyre. Sepse, nd\u00ebrsa gjat\u00eb fushat\u00ebs elektorale qeveria kishte n\u00eb dor\u00eb \u201cdat\u00eblindjen\u201d e shtetasve, agjencit\u00eb e lidhura me qeverin\u00eb dhe n\u00eb sh\u00ebrbim t\u00eb saj, kan\u00eb t\u00eb dh\u00ebnat e shtetasve p\u00ebr bankat, sigurimet, telekomunikacionin apo sh\u00ebndet\u00ebsin\u00eb.<\/p>\n<p>Duke i p\u00ebrdorur ato atje ku ka interes p\u00ebr t\u00eb intimiduar, k\u00ebrc\u00ebnuar apo mbajtur n\u00ebn tutel\u00eb personat e v\u00ebn\u00eb n\u00ebn sh\u00ebnjest\u00ebr, ata q\u00eb duhen bler\u00eb apo ata q\u00eb kan\u00eb vendosur q\u00eb t\u00eb mos shiten.
