Lul\u00ebzim Basha doli e p\u00ebrsh\u00ebndeti n\u00eb mesnat\u00eb, nd\u00ebrsa Arben Ristani fluturoi nga g\u00ebzimi duke theksuar faktin se Kolegji legjitimoi veprimtarin\u00eb e KQZ. Por vendimi i zbardhur i Kolegjit Zgjedhor ka fshir\u00eb gjith\u00eb paqart\u00ebsit\u00eb e shfaqura n\u00eb shqiptimin e vendimit, t\u00eb cilat kishin t\u00eb b\u00ebnin me p\u00ebrpjekjen e Berish\u00ebs p\u00ebr t\u00eb klasifikuar votat e hedhura gabim si vota t\u00eb kontestuara dhe p\u00ebr ta mbyllur procesin e transparenc\u00ebs pa num\u00ebruar votat e qytetar\u00ebve, por vet\u00ebm duke p\u00ebrdorur 81 votat q\u00eb duksh\u00ebm jan\u00eb futur n\u00eb grupet e num\u00ebrimit mbasditen e 14 majit.  Vendimi e konsideron n\u00eb kund\u00ebrshtim me frym\u00ebn e Kushtetut\u00ebs procedur\u00ebn e KQZ, dhe qart\u00ebson m\u00ebnyr\u00ebn se si duhet t\u00eb ruhet integriteti i procesit.<\/p>\n<p>Dje Sali Berisha heshti. Heshti dhe Lul\u00ebzim Basha. Makinat me flamuj t\u00eb PD-s\u00eb nuk u pan\u00eb n\u00ebp\u00ebr rrug\u00eb. Arben Ristani nervoz kishte tentuar t\u00eb jepte nj\u00eb opinion n\u00eb nj\u00eb gazet\u00eb af\u00ebr qeveris\u00eb p\u00ebr t\u00eb siguruar Lul\u00ebzim Bash\u00ebn q\u00eb e ka t\u00eb sigurt fitoren, duke shkelur k\u00ebshtu \u00e7do etik\u00eb dhe \u00e7do norm\u00eb ligjore p\u00ebr profilin e kryetarit t\u00eb KQZ. Bile distanca kohore nga e h\u00ebna deri n\u00eb t\u00eb enjte ishte e mbushur nga ana e qeveris\u00eb me keqinterpretim publik t\u00eb vendimit, duke tentuar t\u2019i orientojn\u00eb publikisht gjyqtar\u00ebt se si duhet ta zbardhin vendimin, gj\u00eb q\u00eb rriti ndjesh\u00ebm tensionin n\u00eb vend.<\/p>\n<p>Por ndryshimi m\u00eb i madh dhe thelb\u00ebsor \u00ebsht\u00eb n\u00ebse krahason dy vendimet e zbardhura t\u00eb Kolegjit Zgjedhor, at\u00eb t\u00eb Tom Ndrec\u00ebs dhe k\u00ebt\u00eb t\u00eb Dhurata Haverit.<\/p>\n<p>S\u00eb pari, n\u00ebse i hedh nj\u00eb sy gjuh\u00ebs s\u00eb vendimit t\u00eb djesh\u00ebm t\u00eb Kolegjit dhe gjuh\u00ebs me t\u00eb cil\u00ebn \u00ebsht\u00eb shkruar vendimi i Kolegjit, drejtuar nga Tom Ndreca, shikon nj\u00eb ndryshim t\u00eb fort\u00eb stilistikor, nj\u00eb ndryshim t\u00eb fort\u00eb n\u00eb argumentet ligjore dhe mbi t\u00eb gjitha ndryshim n\u00eb interpretimin e Kodit Elektoral. Edhe pse Tom Ndreca \u00ebsht\u00eb nj\u00eb mirditor, q\u00eb si\u00e7 mburret n\u00ebp\u00ebr tavolina \u201cBerisha e mori nga dhit\u00eb dhe e b\u00ebri zabit\u201d, e kishte zbardhur vendimin n\u00eb nj\u00eb tosk\u00ebrishte t\u00eb theksuar, p\u00ebrzier\u00eb me terma latin\u00eb q\u00eb Ndreca s\u2019i ka d\u00ebgjuar as n\u00eb ndonj\u00eb kish\u00eb, pasi si komunist ateist q\u00eb ka qen\u00eb nuk ka shkelur n\u00eb to. Vendimi i zbardhur i Kolegjit t\u00eb tij dukej qart\u00eb q\u00eb i kishte shkuar i shkruar nga dikush tjet\u00ebr dhe ngjante me dy pika uji si arsyetimi i aktit normativ t\u00eb Ristanit. Po t\u2019i krahasosh do t\u00eb shikosh se ka togfjal\u00ebsha t\u00eb nj\u00ebjt\u00eb, arsyetim t\u00eb nj\u00ebjt\u00eb p\u00ebr \u201cdoktrin\u00ebn e Kushtetut\u00ebs\u201d dhe parimin q\u00eb duhet respektuar \u00e7do vot\u00eb dhe fare pak, bile ndonj\u00ebher\u00eb aspak referenc\u00eb ligjore.<\/p>\n<p>Po t\u00eb shikosh vendimin e djesh\u00ebm t\u00eb Kolegjit ka nj\u00eb sintaks\u00eb krejt ndryshe nga ai i Tom Ndrec\u00ebs, \u00ebsht\u00eb shkruar me nj\u00eb gjuh\u00eb t\u00eb thjesht pa sofistikime, dhe \u00ebsht\u00eb n\u00eb \u00e7do paragraf i mb\u00ebshtetur n\u00eb ligj. Nuk ka ilustrime me terma latin\u00eb dhe as i referohet \u201cFrym\u00ebs s\u00eb shenjt\u00eb\u201d t\u00eb Kushtetut\u00ebs, por thjesht Kodit Elektoral dhe parimeve t\u00eb Kushtetut\u00ebs. Kjo \u00ebsht\u00eb nj\u00eb diferenc\u00eb e madhe q\u00eb d\u00ebshmon se mjafton t\u00eb sillesh si gjyqtar dhe ky proces \u00ebsht\u00eb i d\u00ebnuar t\u00eb shkoj\u00eb n\u00eb pavlefshm\u00ebri ose t\u2019i lihet mandati fituesit.<\/p>\n<p>Nj\u00eb ndryshim i fort\u00eb mes dy vendimeve t\u00eb zbardhura ka t\u00eb b\u00ebj\u00eb dhe me konceptin p\u00ebr flet\u00ebt e hedhura gabim. Vendimi i Tom Ndrec\u00ebs legjitimonte futjen e 81 flet\u00ebve t\u00eb votimit n\u00eb kushte t\u00ebr\u00ebsisht t\u00eb paqarta ligjore, por nuk denjonte t\u00eb verifikonte se si ishte realisht situata n\u00eb kutin\u00eb e kryetarit t\u00eb Bashkis\u00eb, e cila u mbyll me dhjet\u00eb vota para p\u00ebr Edi Ram\u00ebn. Nj\u00eb procesi, i cili kishte p\u00ebrfunduar, ishte alogjike t\u2019i shtoje flet\u00eb t\u00eb tjera votimi pa par\u00eb n\u00eb fillim n\u00ebse mungon apo kishte tep\u00ebr flet\u00eb votimi n\u00eb at\u00eb kuti. Vendimi i djesh\u00ebm i Kolegjit e qart\u00ebson k\u00ebt\u00eb situat\u00eb dhe k\u00ebrkon verifikimin e gjith\u00eb kutive.<\/p>\n<p>Kjo procedur\u00eb \u00ebsht\u00eb e destinuar t\u00eb prodhoj\u00eb dy rezultate, e para q\u00eb t\u00eb p\u00ebrputhen votat e hedhura n\u00eb kutin\u00eb e kryetarit me sasin\u00eb e votave q\u00eb gjenden aty dhe loja merr fund duke i dh\u00ebn\u00eb mandatin fituesit t\u00eb asaj kutie, q\u00eb \u00ebsht\u00eb Edi Rama, ose votat t\u00eb mos p\u00ebrputhen me numrin e votuesit, por natyrisht as me 81 votat e shtuara dhe t\u00eb kalohet n\u00eb pavlefshm\u00ebri. Pra, vendimi i djesh\u00ebm i Kolegjit n\u00eb t\u00eb v\u00ebrtet\u00eb hap rrug\u00eb p\u00ebr t\u00eb penalizuar dhe futjen e duarve n\u00eb kuti duke shtuar 81 vota.<\/p>\n<p>S\u00eb fundmi, duhet th\u00ebn\u00eb se rreth zbardhjes s\u00eb vendimit ka nj\u00eb konspiracion t\u00eb t\u00ebr\u00eb politik. Ka z\u00ebra q\u00eb ja dedikojn\u00eb at\u00eb presionit nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb ruajtur integritetin e votimit. Ka t\u00eb tjer\u00eb q\u00eb kan\u00eb fantazi dhe shikojn\u00eb nj\u00eb p\u00ebrpjekje t\u00eb Berish\u00ebs p\u00ebr t\u00eb shitur Lul\u00ebzim Bash\u00ebn dhe p\u00ebr t\u00eb shp\u00ebtuar qeverin\u00eb. Kjo \u00ebsht\u00eb qesharake pasi Berisha \u00ebsht\u00eb strumbullari i gjith\u00eb k\u00ebtij deformimi t\u00eb procesit zgjedhor. Un\u00eb nuk dua t\u00eb besoj as t\u00eb par\u00ebn, as t\u00eb dyt\u00ebn, por thjesht pamund\u00ebsin\u00eb e gjyqtar\u00ebve t\u00eb Kolegjit p\u00ebr t\u00eb gjykuar ndryshe para k\u00ebtyre fakteve.<\/p>\n<p>Kjo vlen vet\u00ebm p\u00ebr t\u00eb na treguar sa skandal \u00ebsht\u00eb vendimi i Tom Ndrec\u00ebs dhe jo sa real \u00ebsht\u00eb ky vendim. Ky \u00ebsht\u00eb nj\u00eb vendim normal gjyqtar\u00ebsh q\u00eb kan\u00eb rikthyer shansin p\u00ebr t\u00eb hetuar zgjedhjet. Diferenca reale mes dy vendimeve \u00ebsht\u00eb se nj\u00ebri \u00ebsht\u00eb hartuar dhe zbardhur nga gjyqtar\u00eb, tjetri n\u00eb zyr\u00ebn e Berish\u00ebs.
