Gjuha e p\u00ebrdorur n\u00eb k\u00ebt\u00eb raport, edhe pse nuk del nga caqet e korrektes\u00ebs politike, \u00ebsht\u00eb \u00e7udit\u00ebrisht tep\u00ebr e qart\u00eb sa i p\u00ebrket vler\u00ebsimit t\u00eb num\u00ebrimeve. N\u00eb raportin e OSBE\/ODIHR procesi i num\u00ebrimit dhe i validimit t\u00eb votave p\u00ebr kryetarin q\u00eb jan\u00eb hedhur n\u00eb kuti t\u00eb tjera, konsiderohet si i parregullt dhe pa baz\u00eb ligjore. V\u00ebzhguesit nd\u00ebrkomb\u00ebtar\u00eb shprehen se ky proces i parregullt \u00ebsht\u00eb k\u00ebrkuar nga ana e kryeministrit Berisha, dhe KQZ ka vendosur t&#8217;i p\u00ebrgjigjet thirrjes s\u00eb kryetarit t\u00eb PD-s\u00eb, pa konsensusin e opozit\u00ebs.<\/p>\n<p>N\u00eb raportin e OSBE\/ODIHR gjithashtu qortohet e kritikohet haptazi mungesa e transparenc\u00ebs mbi arsyetimin e argumentimin ligjor t\u00eb vendimeve q\u00eb ka marr\u00eb k\u00ebto dit\u00eb KQZ-ja, duke filluar q\u00eb nga mosrespektimi i afateve kohore p\u00ebr shpalljen e rezultatit t\u00eb marra nga Qendrat e Num\u00ebrimit t\u00eb Tiran\u00ebs, e deri tek marrja e nj\u00eb vendimi p\u00ebr t\u00eb konsideruar si t\u00eb vlefshme flet\u00ebt e votimit, n\u00eb nj\u00eb m\u00ebnyr\u00eb t\u00eb paparashikuar prej kodit elektoral.<\/p>\n<p>N\u00eb kreun e tret\u00eb t\u00eb raportit, aty ku trajtohet m\u00eb gjer\u00ebsisht administrimi i procesit zgjedhor gjat\u00eb datave 10 deri n\u00eb 18 maj, pra administrimi i procesit t\u00eb num\u00ebrimit e i shqyrtimit n\u00eb KZAZ, si dhe i procesit t\u00eb certifikimit nga KQZ, v\u00ebrejtjet e pak\u00ebnaq\u00ebsit\u00eb e OSBE\/ODIHR jan\u00eb t\u00eb mprehta, e nuk l\u00ebn\u00eb vend p\u00ebr keqkuptim.<\/p>\n<p>Si fillim, qortohet fakti se KQZ nuk i ka marr\u00eb masat infrastrukturore si\u00e7 duhet, e nuk ka instruktuar apo trajnuar t\u00eb gjith\u00eb an\u00ebtar\u00ebt e ekipeve t\u00eb num\u00ebrimit t\u00eb votave, e ky ka qen\u00eb shkak i ngecjeve e vonimeve t\u00eb proceseve n\u00eb disa raste:<\/p>\n<p>&#8220;Fillimi i num\u00ebrimit t\u00eb votave u nis me vones\u00eb n\u00eb shum\u00eb vende, pjes\u00ebrisht p\u00ebr shkak t\u00eb faktit q\u00eb disa an\u00ebtar\u00eb t\u00eb grupeve t\u00eb num\u00ebrimit n\u00eb disa VNV nuk ishin em\u00ebruar ose nuk ishin trainuar deri n\u00eb momentin q\u00eb filloi num\u00ebrimi. P\u00ebrpos k\u00ebsaj, v\u00ebzhguesit e OSBE\/ODIHR-it raportuan se procesi i num\u00ebrimit nd\u00ebrpritej her\u00eb pas here p\u00ebr shkak t\u00eb debateve nd\u00ebrmjet an\u00ebtar\u00ebve t\u00eb KZAZ-s\u00eb, an\u00ebtar\u00ebve t\u00eb grupit t\u00eb num\u00ebrimit dhe\/ose v\u00ebzhguesve t\u00eb partive.4 Nuk kishte asnj\u00eb udh\u00ebzim n\u00eb nivel komb\u00ebtar lidhur me pushimet, duke e l\u00ebn\u00eb \u00e7do KZAZ t\u00eb merrte vet\u00eb vendimet n\u00eb k\u00ebt\u00eb drejtim. N\u00eb disa raste q\u00eb iu b\u00ebn\u00eb t\u00eb ditura KQZ-s\u00eb, ajo urdh\u00ebroi vazhdimin e procesit. Megjithat\u00eb, disa KZAZ vazhduan t\u00eb punonin me ritme t\u00eb ngadalta, ve\u00e7an\u00ebrisht n\u00eb Tiran\u00eb.&#8221;<\/p>\n<p>M\u00eb pas, OSBE\/ODIHR nuk ka l\u00ebn\u00eb pa p\u00ebrmendur v\u00ebshtir\u00ebsit\u00eb q\u00eb kan\u00eb hasur v\u00ebzhguesit gjat\u00eb procesit t\u00eb num\u00ebrimit, sidomos p\u00ebr sa i p\u00ebrket flet\u00ebve t\u00eb kontestuara n\u00eb momentet e num\u00ebrimit, t\u00eb cilat sot po quhen t\u00eb vlefshme dhe po rinum\u00ebrohen nga KQZ:<\/p>\n<p>&#8220;V\u00ebzhguesit mund\u00ebn t\u00eb ishin t\u00eb pranish\u00ebm pa asnj\u00eb penges\u00eb n\u00eb VNV-t\u00eb. Gjat\u00eb num\u00ebrimit, \u00e7do flet\u00eb votimi regjistrohej me kamera dhe tregohej menj\u00ebher\u00eb n\u00eb ekran p\u00ebr t\u00eb gjith\u00eb v\u00ebzhguesit e pranish\u00ebm. Megjithat\u00eb, flet\u00ebt e votimit nuk mund t\u00eb shiheshin plot\u00ebsisht p\u00ebr shkak t\u00eb m\u00ebnyr\u00ebs s\u00eb vendosjes n\u00ebn kamer\u00eb, ose sepse nuk liheshin mjaftuesh\u00ebm n\u00ebn kamer\u00eb. P\u00ebr m\u00eb tep\u00ebr, v\u00ebzhguesit nuk lejoheshin t&#8217;u afroheshin tavolinave, prandaj p\u00ebr ta ishte e v\u00ebshtir\u00eb t\u00eb shikonin n\u00ebse flet\u00ebt e votimit vendoseshin n\u00eb togun e flet\u00ebve t\u00eb votimit t\u00eb kandidatit\/partis\u00eb p\u00ebrkat\u00ebse apo sesi plot\u00ebsoheshin protokollet me rezultatet e qendr\u00ebs s\u00eb votimit. S\u00eb fundmi, v\u00ebzhguesit nuk mund\u00ebn t\u00eb shihnin konsiderimin e flet\u00ebve t\u00eb votimit t\u00eb kontestuara nga an\u00ebtar\u00ebt e grupeve t\u00eb num\u00ebrimit dhe an\u00ebtar\u00ebt e KZAZ-s\u00eb.&#8221;<\/p>\n<p>OSBE\/ODIHR: Num\u00ebrimi nga KQZ nuk bazohet n\u00eb ligj<br \/>\nMir\u00ebpo problemet m\u00eb t\u00eb r\u00ebnda sa i p\u00ebrket administrimit t\u00eb num\u00ebrimit nga KQZ, raporti i v\u00eb n\u00eb dukje n\u00eb paragrafin vijues:<\/p>\n<p>&#8220;Kodi Zgjedhor nuk parashikon drejtp\u00ebrdrejt vlefshm\u00ebrin\u00eb e flet\u00ebve t\u00eb votimit gjetur n\u00eb nj\u00eb kuti votimi, t\u00eb ndryshme nga ajo q\u00eb i korrespondon llojit t\u00eb zgjedhjes p\u00ebr at\u00eb flet\u00eb. Ai as nuk parashikon ndonj\u00eb procedur\u00eb p\u00ebr vler\u00ebsimin e flet\u00ebve t\u00eb votimit t\u00eb gjetura n\u00eb kuti t\u00eb tjera. Nuk kishte asnj\u00eb vendim apo udh\u00ebzim nga KQZ-ja p\u00ebr k\u00ebt\u00eb \u00e7eshtje p\u00ebrpara dit\u00ebs s\u00eb zgjedhjeve, dhe as manuali i miratuar i KQZ-s\u00eb nuk e trajtonte k\u00ebt\u00eb \u00e7eshtje, ndon\u00ebse n\u00eb zgjedhjet e kaluara vendore, flet\u00ebt e votimit t\u00eb hedhura gabim p\u00ebrb\u00ebn\u00eb problem. An\u00ebtar\u00ebt e grupeve t\u00eb num\u00ebrimit ishin trainuar p\u00ebr t&#8217;i konsideruar flet\u00eb t\u00eb tilla votimi t\u00eb pavlefshme dhe flet\u00ebt e votimit t\u00eb hedhura gabim ishin konsideruar t\u00eb pavlefshme n\u00eb Tiran\u00eb deri n\u00eb mbylljen e num\u00ebrimit p\u00ebr kryetar bashkie t\u00eb Tiran\u00ebs m\u00eb 14 maj.&#8221;<\/p>\n<p>N\u00eb k\u00ebt\u00eb paragraf, po t\u00eb konsiderosh faktin q\u00eb raporti l\u00ebshohet nga nj\u00eb institucion q\u00eb praktikon gjuh\u00ebn diplomatike, v\u00ebrejtja \u00ebsht\u00eb tep\u00ebr e ashp\u00ebr. Praktikisht OSBE\/ODIHR raporton se ajo q\u00eb nisi t\u00eb b\u00ebj\u00eb KQZ, duke marr\u00eb n\u00eb konsiderat\u00eb e duke num\u00ebruar flet\u00ebt e votimit q\u00eb u gjet\u00ebn n\u00ebp\u00ebr kutit\u00eb e gabuara, nuk ka baz\u00eb ligjore. P\u00ebrve\u00e7 munges\u00ebs s\u00eb baz\u00ebs ligjore, nuk ka patur asnj\u00eb procedur\u00eb, as parashikim t\u00eb nj\u00eb veprimi t\u00eb till\u00eb. Sipas jurist\u00ebve me t\u00eb cil\u00ebt \u00ebsht\u00eb konsultuar &#8220;Shekulli&#8221;, n\u00ebse marrim t\u00eb mir\u00ebqen\u00eb at\u00eb q\u00eb shkruhet n\u00eb raport, duke kryer nj\u00eb veprim t\u00eb paparashikuar as n\u00eb ligj, as n\u00eb direktiva, as n\u00eb precedent\u00eb, KQZ \u00ebsht\u00eb duke kryer di\u00e7ka t\u00eb jasht\u00ebligjshme, duke thyer kodin elektoral, pra duke b\u00ebr\u00eb krim. E ky \u00ebsht\u00eb nj\u00eb implikim i r\u00ebnd\u00eb q\u00eb i b\u00ebhet KQZ prej raportit t\u00eb OSBE\/ODIHR. Mir\u00ebpo, edhe pse KQZ ka qen\u00eb e nd\u00ebrgjegjshme q\u00eb veprimi i num\u00ebrimit dhe i validimit t\u00eb votave t\u00eb hedhura n\u00eb kutit\u00eb e gabuara nuk ka qen\u00eb i ligjsh\u00ebm, diktati i maxhoranc\u00ebs \u00ebsht\u00eb vendosur p\u00ebrmbi ligjin. K\u00ebshtu, raporti i OSBE\/ODIHR vijon m\u00eb tej:<br \/>\n&#8220;M\u00eb 17 maj, tri dit\u00eb pas mbylljes s\u00eb num\u00ebrimit p\u00ebr kryetar bashkie t\u00eb Tiran\u00ebs n\u00eb VNV-n\u00eb e fundit t\u00eb Tiran\u00ebs, kryetari i KQZ-s\u00eb propozoi nj\u00eb projekt vendim, sipas t\u00eb cilit, flet\u00ebt e votimit t\u00eb hedhura n\u00eb kutin\u00eb e gabuar do t\u00eb konsideroheshin t\u00eb vlefshme dhe do t\u00eb num\u00ebroheshin prej vet\u00eb KQZ-s\u00eb.8 Ky num\u00ebrim do t\u00eb ishte vet\u00ebm p\u00ebr flet\u00ebt e votimit gjetur n\u00eb kutin\u00eb e gabuar, q\u00eb ishin kontestuar n\u00eb nivel VNV-je. Sipas kryetarit t\u00eb KQZ-s\u00eb, projekt vendimi ishte propozuar me k\u00ebrkes\u00eb t\u00eb an\u00ebtar\u00ebve t\u00eb 7 KZAZ-ve t\u00eb Tiran\u00ebs, em\u00ebruar nga PD-ja dhe LSI-ja lidhur me 60 kuti votimi.<\/p>\n<p>An\u00ebtar\u00ebt e emeruar nga opozita e kund\u00ebrshtuan propozimin, duke deklaruar se KQZ-ja nuk kishte t\u00eb drejt\u00eb t\u00eb num\u00ebronte flet\u00ebt e votimit dhe se mund t\u00ed hapte ato n\u00eb baz\u00eb t\u00eb ankimimi t\u00eb rezultateve zyrtare. Ata propozuan q\u00eb KQZ-ja t\u00eb nxirrte rezultatet n\u00eb TPR-t\u00eb e marra nga VNVt\u00eb. Seanca e KQZ-s\u00eb, ku do t\u00eb diskutohej projekt vendimi, u nd\u00ebrpre nga deputet\u00ebt e PS-s\u00eb dhe seanca u shty p\u00ebrpara se t\u00eb kalonte n\u00eb votim. M\u00eb 18 maj, pas votimit t\u00eb nj\u00eb vendimi &#8220;n\u00eb parim&#8221; (prej 4-3 votash), ndon\u00ebse nuk ishte miratuar asnj\u00eb vendim p\u00ebrfundimtar, KQZ-ja filloi hapjen e 60 kutive t\u00eb votimit identifikuar n\u00eb k\u00ebrkes\u00eb dhe num\u00ebrimin e flet\u00ebve t\u00eb votimit p\u00ebr kryetar bashkie dhe k\u00ebshilli p\u00ebr Tiran\u00ebn. P\u00ebr MVZ-n\u00eb e OSBE\/ODIHR-it, baza ligjore p\u00ebr hapjen e kutive t\u00eb votimit ishte e paqart\u00eb. An\u00ebtar\u00ebt e em\u00ebruar t\u00eb opozit\u00ebs n\u00eb KQZ u larguan nga seanca. Flet\u00ebt e votimit num\u00ebruar nga KQZ-ja n\u00eb 20 kuti votimi gjat\u00eb seanc\u00ebs s\u00eb dat\u00ebs 18 maj rezultuan n\u00eb 60 flet\u00eb votimi p\u00ebr kryetar bashkie t\u00eb Tiran\u00ebs, 46 p\u00ebr Z. Basha dhe 14 p\u00ebr Z. Rama.&#8221;<\/p>\n<p>Nj\u00eb gjuh\u00eb e till\u00eb, ka koh\u00eb q\u00eb nuk p\u00ebrdoret n\u00eb raportimet e v\u00ebzhguesve nd\u00ebrkomb\u00ebtar\u00eb mbi zgjedhjet shqiptare, sidomos p\u00ebr sa i p\u00ebrket procesit t\u00eb num\u00ebrimit dhe administrimit. Edhe pse m\u00eb p\u00ebrpara jan\u00eb v\u00ebn\u00eb re fenomene brutale, vjedhje votash n\u00eb kuti e t\u00eb tjera fenomene, k\u00ebsaj radhe v\u00ebzhguesit e OSBE\/ODIHR flasin p\u00ebr aksione institucionale t\u00eb cilat nuk marrin parasysh dhe veprojn\u00eb pavar\u00ebsisht ligjeve.<\/p>\n<p>Fatkeq\u00ebsisht, OSBE\/ODIHR e konfirmoi at\u00eb q\u00eb mediat, shoq\u00ebria civile dhe opozita kan\u00eb dit\u00eb q\u00eb po e thon\u00eb, KQZ-ja po vepron n\u00ebn diktatin e mazhoranc\u00ebs, duke sjell\u00eb standarde t\u00eb dyfishta e duke diskriminuar opozit\u00ebn, t\u00eb cil\u00ebn po e privon prej fitores s\u00eb saj n\u00eb Tiran\u00eb, p\u00ebrmes nd\u00ebrrimit t\u00eb rregullave pa paralajm\u00ebrim, pas p\u00ebrfundimit t\u00eb gar\u00ebs.<br \/>\n(<em>Raporti i plot\u00eb \u00ebsht\u00eb publikuar dje n\u00eb faqen www.osbe.org\/odihr<\/em>)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Arb\u00ebr Zaimi, 21.05.2011 Dje misioni v\u00ebzhgues i OSBE\/ODIHR ka l\u00ebshuar nj\u00eb raport mbi zhvillimet e periudh\u00ebs pas-elektorale n\u00eb Shqip\u00ebri, q\u00eb p\u00ebrfshin dit\u00ebt prej 10 majit e gjer m\u00eb 18 maj.
