N\u00eb nj\u00eb shoq\u00ebri t\u00eb civilizuar, sht\u00ebpia \u00ebsht\u00eb nj\u00eb hapsir\u00eb padhunueshme dhe u p\u00ebrket atyre q\u00eb jetojn\u00eb n\u00eb t\u00eb. Ata q\u00eb jetojn\u00eb aty mund t\u00eb \u00e7lodhen, t\u00eb shijojn\u00eb lumturin\u00eb familjare, intimitetitn e tjera. Sipas paragrafit 602 t\u00eb Kanunit ku thuhet : &#8220;Shpija e Shqiptarit asht e Zotit dhe e mikut&#8221; q\u00eb do t\u00eb thot\u00eb se sht\u00ebpia nuk i p\u00ebrket pronarit t\u00eb saj por t\u00eb huajit. <\/p>\n<p>Mund ta shtrojm\u00eb pyetjen: \u00c7far\u00eb psikologjie ka krijuar n\u00eb popull th\u00ebnia \u201cSht\u00ebpia e shqiptarit \u00ebsht\u00eb e zotit dhe e mikut\u201d?<\/p>\n<p>P\u00ebr t\u00eb filluar, mund t\u00eb themi me rezerv\u00eb apo me naivitet se kjo shpehje ka q\u00ebllim t&#8217;i uroj\u00eb mir\u00ebseardhje dikujt i cili kur vjen n\u00eb sht\u00ebpi dhe ndihet i turp\u00ebruar. N\u00eb shum\u00eb gjuh\u00eb t\u00eb m\u00ebdha p\u00ebrdoret shprehja \u201cndihuni i lirsh\u00ebm si n\u00eb sht\u00ebpin\u00eb tuaj\u201d por nuk \u00ebsht\u00eb ligj q\u00eb p\u00ebrcakton pron\u00ebn dhe pronarin. N\u00eb shoq\u00ebrit\u00eb e civilizuara, kur dikush shkon n\u00eb sht\u00ebpin\u00eb e tjetrit, minimumi i mir\u00ebsjelles \u00ebsht\u00eb q\u00eb t\u00eb mos pengoj\u00eb. \u00cbsht\u00eb normale q\u00eb miku t\u00eb turp\u00ebrohet dhe, me plot ar\u00ebsye, t\u00eb ket\u00eb frik\u00eb se e pengon tjetrin. Pra, ai q\u00eb pret nuk stresohet, nuk turp\u00ebrohet, nuk ka frik\u00eb se gjykohet por \u00ebsht\u00eb i fort\u00eb n\u00eb hap\u00ebsir\u00ebn e tij, n\u00eb zon\u00ebn e tij t\u00eb konfortit. Vet\u00ebm n\u00eb k\u00ebt\u00eb situat\u00eb, shprehja e mikpritjes \u201cndihuni si n\u00eb sht\u00ebpn\u00eb tuaj\u201d e ka kuptimin pozitiv. <\/p>\n<p>N\u00eb t\u00eb kund\u00ebrt\u00ebn, nocioni i mikpritjes \u00ebsht\u00eb keqkuptuar nga shqiptar\u00ebt sepse nuk b\u00ebhet fjal\u00eb p\u00ebr mir\u00ebsjellje por p\u00ebr nj\u00eb ligj i cili shprehet n\u00eb paragrafin 602 t\u00eb Kanunit. Po t\u00eb shikohet holl\u00eb e holl\u00eb dhe me seriozitetin m\u00eb t\u00eb madh, ky ligj e ka rregulluar jet\u00ebn e shqiptar\u00ebve n\u00eb gjitha trojet dhe \u00ebsht\u00eb b\u00ebr\u00eb pika qendrore e Kanunit. <\/p>\n<p>N\u00eb krahasim me ligjin e mikpritjes, gjakmarrja \u00ebsht\u00eb pik\u00eb periferike. Gjakmarrja nodh vet\u00ebm n\u00eb disa pjes\u00eb te trojeve tona dhe po \u00e7rr\u00ebnjoset gradualisht sepse ajo \u00ebsht\u00eb m\u00eb spektakulare dhe m\u00eb leht\u00eb e sulmuar me argumente nga njer\u00ebzit e shkolluar. N\u00ebse lexojm\u00eb gjith\u00eb nenin 96 t\u00eb Kanunit q\u00eb fillon pik\u00ebrisht me paragrafin 602, mund t\u00eb kuptohet se miku edhe armiku mund t\u00eb futen n\u00eb sht\u00ebpi dhe se pronari \u00ebsht\u00eb i detyruar t&#8217;i ushqej\u00eb ata pa dallim edhe kur s&#8217;ka buk\u00eb p\u00ebr f\u00ebmij\u00ebt e vet. <\/p>\n<p>N\u00eb trojet shqiptare, edhepse sht\u00ebpia nund t\u00eb ket\u00eb oborr t\u00eb rrethuar me \u00e7elik e beton, t\u00eb jet\u00eb kull\u00eb e fort\u00eb apo kala, shqiptari \u00ebsht\u00eb i xhveshur, lakuriqu, i dob\u00ebt, i destabilizuar, i \u00e7orientuar&#8230; sepse psikologjikisht, sipas ligjit, nuk \u00ebsht\u00eb n\u00eb terrenin e tij. Normalisht, kur ndeshen dy ekipe futbolli, ekipi q\u00eb luan n\u00eb fush\u00ebn e vet konsiderohet se ka p\u00ebrpar\u00ebsi p\u00ebr t\u00eb fituar. N\u00eb t\u00eb kund\u00ebrt\u00ebn, shqiptar\u00ebt mu at\u00ebher\u00eb jan\u00eb t\u00eb dob\u00ebt. Nd\u00ebrsa, kur ndodhen tek tjetri, i lejojn\u00eb vetes t\u00eb shkojn\u00eb m\u00eb larg se duhet dhe t\u00eb konsiderohen pronar\u00eb t\u00eb pasuris\u00eb m\u00eb t\u00eb madhe dhe m\u00eb t\u00eb shtrenjt\u00eb q\u00eb mund t\u00eb ket\u00eb njeriu: sht\u00ebpis\u00eb. Po t\u00eb flasim me gjuh\u00ebn e drejt\u00ebsis\u00eb moderne (ndoshta edhe klasike) kur dikush pretendon se \u00ebsht\u00eb pronar i pasuris\u00eb s\u00eb tjetrit, ai \u00ebshte hajn, kriminel. Pra, paragrafi 602 krijon \u00e7oroditje raportesh nd\u00ebrmjet shqiptar\u00ebsh dhe shok t\u00eb madh kulturor me popujt tjer\u00eb. <\/p>\n<p>Kam b\u00ebr\u00eb studime n\u00eb deg\u00ebn e administrimit t\u00eb biznesit, ku ka shum\u00eb drejt\u00ebsi, psikologji, sociologji, analiza kulturash p\u00ebr t\u00eb b\u00ebr\u00eb negociata, e tjera. Kam dy raste personale q\u00eb m\u00eb bindin se ne e kemi t\u00eb ngulitur n\u00eb tru mosrespektin e pasuris\u00eb dhe jet\u00ebs s\u00eb tjetrit. <\/p>\n<p>Rasti i par\u00eb. Jam mal\u00ebsor dhe kam studjuar n\u00eb Amerik\u00eb. Shkova n\u00eb sht\u00ebpi tek nj\u00eb shok amerikan p\u00ebr t\u00eb marr\u00eb di\u00e7ka sipas marr\u00ebveshjes. Posa e hapi der\u00ebn, un\u00eb isha i p\u00ebrgatitur psikologjikisht t\u00eb hyja. Nuk kisha fare nevoj\u00eb t\u00eb prisja t&#8217;m\u00eb ftonte. Kur e pa shoku im i studimeve se po kaloja kufirin e asaj q\u00eb sipas tij nuk lejohej, ma zuri rrug\u00ebn, ma dha dosjen, m\u00eb p\u00ebrsh\u00ebndeti, u fut brenda dhe e mbylli der\u00ebn duke m\u00eb l\u00ebn\u00eb jasht\u00eb. M\u00eb von\u00eb e kuptova se ishte me nj\u00eb shoqen e tij dhe kishte gj\u00ebra me interesante t\u00eb b\u00ebnte se t&#8217;m\u00eb priste mua. Kur u takuam pastaj n\u00eb universitet u soll si m\u00eb par\u00eb, sikur nuk kishte ndodhur gj\u00eb. E kuptova leht\u00eb se un\u00eb kisha problem se desha t\u00eb futesha n\u00eb intimitetin e tij e jo ai q\u00eb nuk m\u00eb lejoi. <\/p>\n<p>Rasti i dyt\u00eb. Gjithashtu n\u00eb Amerik\u00eb, shkova te nj\u00eb shqiptar dhe i cili krenohej me faktin se ishte burr\u00eb zakoni dhe se i ruante traditat e tij \u201ct\u00eb mira\u201d edhe n\u00eb diapor\u00eb. M\u00eb priti dhe kur u futa n\u00eb sallon, u ula. Ai q\u00ebndronte n\u00eb k\u00ebmb\u00eb. Q\u00ebndroi e q\u00ebndroi n\u00eb k\u00ebmb\u00eb derisa m\u00eb shkoi mendja t&#8217;i thoja t\u00eb ulej. Un\u00eb, i huaji n\u00eb sht\u00ebpin\u00eb e tij, duhej ta ftoja t\u00eb ulej!!! <\/p>\n<p>Psikoanalisti Erik Erikson (1902- 1994 ) pohon n\u00eb nj\u00eb nga studimet e tij n\u00eb lidhje me etapat e zhvillimit t\u00eb individit se pa identitet nuk ka intimitet dhe pa intimitet nuk ka identitet. Tek shqiptar\u00ebt, intimitetit i tjetrit nuk respektohet dhe ndoshta p\u00ebr k\u00ebt\u00eb ar\u00ebsye nuk kemi identitet t\u00eb fort\u00eb. M\u00eb brengos fakti se ende nuk kam par\u00eb n\u00eb trojet shqiptare mesazhe t\u00eb shkruara n\u00eb der\u00eb ku thuhet: \u201cJu lutem mos m\u00eb pengoni, nuk kan koh\u00eb t\u00eb pres miq apo musafir\u00eb, jam duke e b\u00ebr\u00eb nj\u00eb punim shkencor, nj\u00eb studim&#8230; duke u \u00e7lodhur!\u201d Aq m\u00eb keq, \u00ebsht\u00eb turp t\u00eb k\u00ebrkosh nga tjetri respektin e intimitetit. <\/p>\n<p>Nj\u00eb mik kosovar nga Prishtina m\u00eb ka treguar nj\u00eb rast n\u00eb lidhje me k\u00ebt\u00eb q\u00eb thash: \u201cNj\u00eb i af\u00ebrt nga nj\u00eb fshat, vinte \u00e7do jav\u00eb p\u00ebr pazar n\u00eb qytet dhe familja ime duhej ta priste. Pas nj\u00eb kohe u lodh\u00ebm dhe nuk doni ta shihnin n\u00eb sht\u00ebpi at\u00eb mik i cili me koh\u00eb u b\u00eb armik i t\u00ebr\u00eb familjes sepse e konsideronte sht\u00ebpin\u00eb ton\u00eb si hotel apo mulli, ku s&#8217;paguante asgj\u00eb. N\u00eb kok\u00ebn (dhe n\u00eb interesin e tij) t\u00eb pritej si mik ishte e drejt\u00eb e tij legjitime. Kur u lodh\u00ebm, nj\u00eb dit\u00eb, duke u bazuar n\u00eb orarin e autobusit, u paraqit\u00ebm se nuk ishim n\u00eb sht\u00ebpi kur erdhi miku n\u00eb fjal\u00eb. Ai u ul para der\u00ebs dhe priti disa or\u00eb. Pastaj shkoi te fqiu p\u00ebr t\u00eb na denoncuar duke th\u00ebn\u00eb se nuk donim ta prisnim me q\u00ebllim. Fqiu i cili kishte t\u00eb nj\u00ebjtin problem si neve me nj\u00eb mikun e tij i ka th\u00ebn\u00eb: &#8211; \u201cUn\u00eb po t\u00eb isha ne vendin t\u00ebnd, sa her\u00eb t\u00eb vija p\u00ebr pazar n\u00eb qytet, do t\u00eb shkoja n\u00eb hotel apo motel dhe nuk do t\u00eb pengoja ask\u00ebnd\u201d. Miku u hidh\u00ebrua dhe nuk erdhi m\u00eb dhe kjo gj\u00eb ishte shum\u00eb pozitive p\u00ebr t\u00ebr\u00eb familjen time\u201d.<\/p>\n<p>Nj\u00eb i huaj q\u00eb e kam njohur vet\u00eb n\u00eb p\u00ebr\u00ebndim donte t\u00eb udh\u00ebtonte n\u00eb Shqip\u00ebri. M\u00eb k\u00ebrkoi t&#8217;a d\u00ebrgoja te familja ime q\u00eb t\u00eb flinte. Un\u00eb i sugjerova t\u00eb shkonte n\u00eb hotel q\u00eb t\u00eb ndihej m\u00eb mir\u00eb duke e informuar se n\u00eb vendin tim ka hotele t\u00eb kategorive t\u00eb ndryshme dhe restaurante t\u00eb kategorive t\u00eb ndryshme. I shtova gjithashtu se normalisht njer\u00ebzit jan\u00eb t\u00eb dashur dhe mikprit\u00ebs n\u00eb sh\u00ebrbim t\u00eb turist\u00ebve sepse edhe politike shtet\u00ebrore ka interes t\u00eb ket\u00eb turist\u00eb dhe investon q\u00eb ata te ndihen sa m\u00eb mir\u00eb. Ai m\u00eb tha se e dinte k\u00ebt\u00eb gj\u00eb por kishte d\u00ebgjuar se&#8230;. Ajo \u201cse&#8230;\u201d p\u00ebr mua do t\u00eb thoshte: \u201cParagrafi 602 i Kanunit\u201d. I shpjegova turistit potencial se paragrafi 602 i cili takon mesjet\u00ebs nuk \u00ebsht\u00eb m\u00eb n\u00eb fuqi n\u00eb trojet shqiptare. Ai shkoi n\u00eb Shqip\u00ebri sepse kishte pun\u00eb, por q\u00eb nga ajo dit\u00eb m\u00eb respektoi si njeri normal bashkohor dhe jo si nj\u00eb krijes\u00eb nga mesjeta si\u00e7 i konvenonte t\u00eb m\u00eb paragjykonte m\u00eb par\u00eb. <\/p>\n<p>N\u00eb p\u00ebrfundim, t\u00eb p\u00ebrkujtojm\u00eb se pagagrafi 602 i Kanunit thot\u00eb tekstualisht &#8220;Shpija e Shqiptarit asht e Zotit dhe e mikut&#8221;. Fol\u00ebm p\u00ebr sht\u00ebpin\u00eb dhe mikun por gati e harruam Zotin. Ta p\u00ebrkujtojm\u00eb Zotin por me logjik\u00eb. N\u00ebs\u00eb sht\u00ebpia e shiptarit \u00ebsht\u00eb e Zotit, edhe sht\u00ebpia e afrikanit, gjermanit, indianit, grekut, turkut, serbit; edhe dhelpra, ujku, gjarp\u00ebri, qelizat, qimet, qindra e mij\u00ebra fe, kultura, popuj t\u00eb bot\u00ebs&#8230;. jan\u00eb t\u00eb Zotit. Un\u00eb si ekonomist, nuk kam frik\u00eb se koncepti Zot i \u00e7orienton shqiptar\u00ebt sepse ai normalisht simbolizon gjith\u00ebsin\u00eb, gjithp\u00ebrfshirjen. <\/p>\n<p>Mir\u00ebpo kur shqiptarit i prishet \u00e7atia e sht\u00ebpis\u00eb, shqiptari nuk duhet ta shqet\u00ebsoj\u00eb dhe ta pengoj\u00eb Zotin me lutje q\u00eb ai (Zoti) t&#8217;ia riparoj\u00eb \u00e7atin\u00eb (e pam\u00eb se sa shum\u00eb ka p\u00ebr t\u00eb administruar Zoti!) por t\u00eb hip me shkall\u00eb dhe ta rregulloj\u00eb vet\u00eb. Shqiptari duhet t\u00eb jet\u00eb vet zot n\u00eb sht\u00ebpin\u00eb e tij ose, m\u00eb mir\u00eb t\u00eb themi, duhet t\u00eb b\u00ebj\u00eb prov\u00eb para Zotit dhe njer\u00ebzimit se \u00ebsht\u00eb i zoti i sht\u00ebpis\u00eb s\u00eb tij. Tani n\u00ebse dikush ka nd\u00ebrmend t\u00eb shkruaj nj\u00eb Kanun bashkohor, duhet patjet\u00ebr ta modifikoj\u00eb paragrafin 602.
