Neni 5 i ligjit Nr. 8290, dat\u00eb 24.2.1998, \u201cP\u00ebr p\u00ebrdorimin e arm\u00ebve t\u00eb zjarrit\u201d sanksionon se \u201cArm\u00ebt e zjarrit nuk lejohen t\u00eb p\u00ebrdoren: a) kund\u00ebr personave q\u00eb n\u00eb dukje tregojn\u00eb se jan\u00eb t\u00eb mitur (f\u00ebmij\u00eb), gra dhe pleq; b) n\u00eb vende publike, ku ka mbledhje e grumbullime njer\u00ebzish dhe vihet n\u00eb rrezik jeta e t\u00eb tjer\u00ebve.<\/p>\n<p>Arm\u00ebt e zjarrit n\u00eb k\u00ebto raste mund t\u00eb p\u00ebrdoren vet\u00ebm kund\u00ebr personave t\u00eb ve\u00e7ant\u00eb q\u00eb kryejn\u00eb vepra t\u00eb dukshme dhune kund\u00ebr personit ose pasuris\u00eb, q\u00eb n\u00eb vetvete p\u00ebrb\u00ebjn\u00eb shkelje t\u00eb r\u00ebnda t\u00eb ligjit dhe kur p\u00ebrdorimi i masave t\u00eb tjera shtr\u00ebnguese nuk ka dh\u00ebn\u00eb rezultatet e d\u00ebshiruara\u201d. Tre shtetasit q\u00eb humb\u00ebn jet\u00ebn gjat\u00eb demonstrat\u00ebs s\u00eb dhunshme t\u00eb organizuar nga Opozita e Bashkuar jan\u00eb vrar\u00eb me arm\u00eb zjarri jasht\u00eb territorit t\u00eb godin\u00ebs s\u00eb Kryeministris\u00eb. Pamjet filmike t\u00eb shfaqura n\u00eb media ngren\u00eb dyshimin e fort\u00eb se vdekja e tyre ka ardhur si pasoj\u00eb e p\u00ebrdorimit t\u00eb arm\u00ebve t\u00eb zjarrit nga gardist\u00ebt dhe uniformat blu q\u00eb q\u00ebndronin brenda territorit t\u00eb Kryeministris\u00eb.<\/p>\n<p>Kjo \u00ebsht\u00eb pohuar dje edhe nga shefi i qeveris\u00eb, Sali Berisha, i cili n\u00eb daljen publike t\u00eb radh\u00ebs, e cil\u00ebsoi reagimin e gardist\u00ebve n\u00eb respekt t\u00eb ligjit. Sipas tij ata mbrojt\u00ebn institucionin. Por kjo nuk rezulton e v\u00ebrtet\u00eb. Shkelja e par\u00eb ligjore, q\u00eb rezulton t\u00eb ken\u00eb konsumuar punonj\u00ebsit e gard\u00ebs apo policis\u00eb q\u00eb q\u00eblluan mbi turm\u00ebn lidhet pik\u00ebrisht me pik\u00ebn (b) t\u00eb nenit 5, t\u00eb sip\u00ebrcituar. Kjo p\u00ebr shkak se t\u00eb sht\u00ebnat me arm\u00eb jan\u00eb b\u00ebr\u00eb pik\u00ebrisht n\u00eb nj\u00eb vend publik dhe ku ka pasur nj\u00eb grumbullim t\u00eb madh njer\u00ebzish.<\/p>\n<p>Nd\u00ebrkoh\u00eb q\u00eb neni 5 ia u ndalon k\u00ebt\u00eb reagim t\u00eb ashp\u00ebr punonj\u00ebsve t\u00eb gard\u00ebs apo policis\u00eb. Shkelja e dyt\u00eb ligjore lidhet me faktin se arm\u00ebt e zjarrit jan\u00eb p\u00ebrdorur ndaj personave, t\u00eb cil\u00ebt n\u00eb momentin q\u00eb jan\u00eb q\u00eblluar p\u00ebr vdekje nuk kan\u00eb qen\u00eb duke kryer ndonj\u00eb veprim t\u00eb dhunsh\u00ebm si\u00e7 parashikon ligji. Hekuran Deda, 45 vje\u00e7 nga Dibra ka humbur jet\u00ebn si pasoj\u00eb e nj\u00eb plumbi t\u00eb marr\u00eb n\u00eb kok\u00eb n\u00eb nj\u00eb koh\u00eb q\u00eb ndodhej 10-20 metra larg godin\u00ebs s\u00eb kryeministris\u00eb. Pamjet filmike faktojn\u00eb se n\u00eb momentin q\u00eb ai ka humbur jet\u00ebn nuk ka qen\u00eb duke kryer ndonj\u00eb akt t\u00eb dhunsh\u00ebm.<\/p>\n<p>Ziver Veizi, 43 vje\u00e7 nga Gjirokastra, u q\u00ebllua p\u00ebr vdekje me nj\u00eb plumb n\u00eb gjoks, rreth 3-5 metra larg port\u00ebs hyr\u00ebse n\u00eb kryeministri, n\u00eb nj\u00eb moment kur ai q\u00ebndronte i qet\u00eb, nuk ishte duke kryer asnj\u00eb akt t\u00eb dhunsh\u00ebm dhe nuk mbante n\u00eb dor\u00eb asnj\u00eb mjet t\u00eb rreziksh\u00ebm. Disa metra larg kryeministris\u00eb humbi jet\u00ebn dhe shtetasi, Faik Myrto, 50 vje\u00e7 nga Fieri, i vrar\u00eb me nj\u00eb plumb n\u00eb shpatull.
