Dr. MYSLIM PASHA<\/strong><\/p>\n<p>Fshirja e baz\u00ebs ligjore t\u00eb kufijve shtet\u00ebror\u00eb dhe detar\u00eb, nj\u00eb vep\u00ebr e mbrapsht\u00eb antikomb\u00ebtare. \u00cbsht\u00eb urgjente q\u00eb Parlamenti Shqiptar t\u00eb riplot\u00ebsoj\u00eb k\u00ebt\u00eb \u201cvakuum\u201d q\u00eb e ka krijuar vet\u00eb n\u00eb 2008<\/p>\n<p>Jemi v\u00ebrtet n\u00eb koh\u00eb moderne, t\u00eb liris\u00eb dhe t\u00eb gjith\u00ebp\u00ebrfshirjes, por askush, askush, askush nuk ia lejon vetes q\u00eb t\u00eb shqyej\u00eb ligje e t\u00eb hap\u00eb shtigje t\u00eb dyshimta ndaj interesave komb\u00ebtare. Shqip\u00ebria jon\u00eb dhe shqiptar\u00ebt kudo n\u00eb bot\u00eb, e kan\u00eb historin\u00eb e tyre t\u00eb ngjizur brenda gjeohap\u00ebsirave ku ata mbijetuan deri n\u00eb dit\u00ebt e sotme. Kemi trash\u00ebguar dhe ruajtur n\u00eb breza thesaret e k\u00ebsaj mbijetese, e cila n\u00eb radh\u00eb t\u00eb par\u00eb \u00ebsht\u00eb sulmuar dhe prer\u00eb pik\u00ebrisht n\u00eb kufijt\u00eb e saj. Kufijt\u00eb tan\u00eb kan\u00eb histori tragjike. Ndaj fjala \u201ckufij\u201d vijon edhe sot e k\u00ebsaj dite t\u00eb jet\u00eb trondit\u00ebse p\u00ebr ne shqiptar\u00ebt dhe mbart asociacione plot ndjeshm\u00ebri. E pik\u00ebrisht n\u00eb k\u00ebto kushte, m\u00ebsojm\u00eb se \u00ebsht\u00eb nd\u00ebrmarr\u00eb nga politikan\u00ebt shqiptar\u00eb (shqiptar\u00eb ?!) nj\u00eb masak\u00ebr ligjore, duke p\u00ebrmbysur e fundosur n\u00eb detin e dyshimit \u201cLigjet e Kufirit Shtet\u00ebror Tok\u00ebsor dhe Detar\u201d. M\u00ebsojm\u00eb dje nga nj\u00eb raportim n\u00eb Shekulli dhe nj\u00eb intervist\u00eb e n\u00ebnkryetarit t\u00eb Komisionit t\u00eb Ligjeve se kjo gj\u00eb e pamendueshme ka ndodhur n\u00eb vitin 2008. Kjo \u00ebsht\u00eb nj\u00eb nga ngjarjet m\u00eb unike n\u00eb bot\u00eb.<\/p>\n<p>Gadishulli Ballkanik ka nj\u00eb pozit\u00eb gjeografike strategjike prej krye-ure q\u00eb lidh Evrop\u00ebn, Azin\u00eb dhe Afrik\u00ebn. N\u00ebp\u00ebrmjet uj\u00ebrave detare t\u00eb tij, arrihet n\u00eb Suez dhe dilet n\u00eb Lindje t\u00eb Mesme e n\u00eb Gjirin Persik, pik\u00ebrisht te vendburimet e naft\u00ebs. Ligjv\u00ebn\u00ebsit shqiptar\u00eb nisur prej k\u00ebsaj strategjie, nuk MUNDEN T\u00cb KEN\u00cb GUXIMIN ta fshijn\u00eb k\u00ebt\u00eb baz\u00eb ligjore.<\/p>\n<p>E v\u00ebrteta studimore ligjore dhe gjeografike n\u00eb Shqip\u00ebri \u00ebsht\u00eb shum\u00eb e hidhur. Nuk ka studime e holl\u00ebsi t\u00eb domosdoshme p\u00ebr Detet shqiptare dhe Uj\u00ebrat e Brendsh\u00ebm. N\u00eb 2008, me nj\u00eb paragraf t\u00eb fshehur tin\u00ebz brenda nj\u00eb neni, \u00ebsht\u00eb mbyllur edhe kjo histori sado e kufizuar, e legjislacionit kufitar shqiptar<\/p>\n<p>Ligji Nr 9861 dat\u00eb 24.01.2008 \u00ebsht\u00eb nj\u00eb befasi d\u00ebshp\u00ebruese. N\u00ebse e krahason me praktik\u00ebn bot\u00ebrore dhe t\u00eb shteteve fqinj\u00eb n\u00eb Ballkan dhe m\u00eb tej, \u00ebsht\u00eb nj\u00eb superskandal.<\/p>\n<p>Kjo fshirje ligjore p\u00ebr kufijt\u00eb shtet\u00ebror\u00eb dhe ata detar\u00eb \u00ebsht\u00eb kryer vet\u00ebm gjysm\u00eb viti m\u00eb par\u00eb se sa t\u00eb vinte marr\u00ebveshja fam\u00ebkeqe e kufijve detar\u00eb midis Shqip\u00ebris\u00eb dhe Greqis\u00eb q\u00eb u rr\u00ebzua nga Gjykata Kushtetuese e Shqip\u00ebris\u00eb. A nuk iu duket se ka qen\u00eb qartazi nj\u00eb hapje rruge?? Nj\u00eb leht\u00ebsim n\u00eb at\u00eb orientim absurd q\u00eb do t\u00eb vinte m\u00eb von\u00eb??<\/p>\n<p>Fshirja e Legjislacionit dhe nevoja p\u00ebr ndonj\u00eb shtim tjet\u00ebr, q\u00eb lidhet me debatin p\u00ebr \u201cgjirin historik\u201d apo me konceptin tradicional shqiptar t\u00eb \u201cmesit t\u00eb kanalit t\u00eb Korfuzit\u201d p\u00ebr bashk\u00ebpunimin me pal\u00ebt e treta etj, \u2013 ka p\u00ebrcjell\u00eb at\u00eb \u201cvakum\u201d, i cili e nxori Shqip\u00ebrin\u00eb n\u00eb humbjen e saj m\u00eb t\u00eb madhe, t\u00eb uj\u00ebrave Detar\u00eb dhe t\u00eb Shtratdetit Kontinental.<\/p>\n<p>Neni 3.<\/p>\n<p>1. Uj\u00ebrat territoriale t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb shtrihen gjat\u00eb gjith\u00eb bregut t\u00eb saj, n\u00eb nj\u00eb gjer\u00ebsi prej 12 md, duke filluar nga vija e drejt\u00eb baz\u00eb, q\u00eb shkon nga kepi i Rodonit (Muzhllit), Kepi i Pall\u00ebs, i Lagjit (kala e Turr\u00ebs), derdhja e Semanit, derdhja e Vjos\u00ebs, bregu per\u00ebndimor i ishullit t\u00eb Sazanit, kepi i Gjuh\u00ebz\u00ebs, dhe Gjirit t\u00eb Gram\u00ebs dhe mandej midis bregdetit shqiptar dhe ishujve t\u00eb Republik\u00ebs Greke deri P\u00cbRMES KANALIT T\u00cb KORFUZIT. Gjer\u00ebsia e uj\u00ebrave territoriale nga derdhja e Bun\u00ebs, n\u00eb det, deri te kepi i Rodonit, shtrihet deri n\u00eb vij\u00ebn e kufirit shqiptaro- jugosllav. (Mali i Zi )<\/p>\n<p>Dhe ja: \u201cP\u00cbRMES KANALIT T\u00cb KORFUZIT\u201d\u2026 Kanali i Korfuzit, kanali gjeohistorik dhe jet\u00ebsor, i t\u00eb dy vendeve, nj\u00eb nyje aq e njohur jo vet\u00ebm nga dy popujt tan\u00eb, p\u00ebr gjith\u00eb lundrimin Mesdhetar, p\u00ebrb\u00ebn nj\u00eb nga p\u00ebrballjet m\u00eb themelore, n\u00eb k\u00ebt\u00eb p\u00ebrcaktim t\u00eb kufijve detar\u00eb, midis t\u00eb dy vendeve. Ata q\u00eb kan\u00eb qen\u00eb n\u00eb bisedime, dhe ata q\u00eb do t\u00eb jen\u00eb n\u00eb rinegocimet e tanishme, kan\u00eb p\u00ebrpara nj\u00eb \u201cterr ligjor\u201d apo nj\u00eb \u201cvakum\u201d q\u00eb vijon t\u00eb jet\u00eb unik n\u00eb bot\u00eb? Si ka mund\u00ebsi q\u00eb kjo zbulohet disa muaj m\u00eb von\u00eb nga mediumet shqiptare? Nd\u00ebrkaq as Parlamentit dhe Qeveris\u00eb Shqiptare nuk ia b\u00ebn \u201ct\u00ebrr\u201d syri p\u00ebr at\u00eb q\u00eb i ka shkaktuar vendit t\u00eb vet dhe diplomacis\u00eb shqiptare. Si \u00ebsht\u00eb e mundur q\u00eb askush prej Komisionit t\u00eb Siguris\u00eb Komb\u00ebtare \u201cnuk e vuri fare ujin n\u00eb zjarr\u201d p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje kaq pikante? Flitet p\u00ebr Detin Territorial t\u00eb Shqip\u00ebris\u00eb! \u00cbsht\u00eb \u201cc\u00ebnim i plot\u00eb i m\u00ebvet\u00ebsis\u00eb komb\u00ebtare\u201d kjo q\u00eb ka ndodhur. Kjo paraqitet e dukshme dhe e drejtp\u00ebrdrejt\u00eb mbasi brigjet e Shqip\u00ebris\u00eb Jugper\u00ebndimore ndodhen brenda limiteve t\u00eb Deteve Territoriale t\u00eb t\u00eb dy vendeve. Na vijn\u00eb nd\u00ebrmend an\u00ebtar\u00eb t\u00eb Komisionit t\u00eb Ligjeve t\u00eb cil\u00ebt me nj\u00eb pasion t\u00eb mbrapsht\u00eb dhe ciniz\u00ebm t\u00eb ep\u00ebrm kalonin nenet e marr\u00ebveshjes s\u00eb re (at\u00eb t\u00eb rr\u00ebzuar\u00ebn), p\u00ebr t\u00eb b\u00ebr\u00eb gati q\u00eb ta kalonin n\u00eb Parlament.. Askush nuk hodhi n\u00eb tavolin\u00eb ndonj\u00eb pyetje n\u00ebse kemi pasur apo jo nj\u00eb korniz\u00eb Ligjore Detare?<\/p>\n<p>Politik\u00ebb\u00ebrja shqiptare, n\u00eb k\u00ebt\u00eb zhveshje t\u00eb pazakont\u00eb ligjore ka brenda vetes shp\u00ebrfilljen e dinjitetit komb\u00ebtar, p\u00ebr t\u00eb cil\u00ebn nuk po jepet llogari para shqiptar\u00ebve. \u00cbsht\u00eb urgjente q\u00eb Parlamenti Shqiptar t\u00eb nd\u00ebrmarr\u00eb nj\u00eb nism\u00eb t\u00eb re p\u00ebr t\u00eb plot\u00ebsuar k\u00ebt\u00eb \u201cvakuum\u201d q\u00eb e ka krijuar vet\u00eb. Kjo mund t\u00eb b\u00ebhet dhe nuk ka asnj\u00eb penges\u00eb. S\u2019ka se si t\u00eb shkohet drejt bisedimeve t\u00eb reja diplomatike pa rikonceptuar Ligjin p\u00ebr t\u00eb Drejt\u00ebn Detare Shqiptare, si nj\u00eb ligj i brendsh\u00ebm. N\u00ebse nuk rikompozohet baza ligjore q\u00eb \u00ebsht\u00eb fshir\u00eb, kemi qysh tash nj\u00eb rrezik t\u00eb ri. Me sa duket na kan\u00eb fshehur heqjen e kufijve n\u00ebp\u00ebrmjet nj\u00eb mashtrimi ligjor dhe gjeometrik. Ka gjasa q\u00eb edhe n\u00eb t\u00eb ardhmen e rinegocimeve t\u00eb shkojn\u00eb k\u00ebshtu, p\u00ebr t\u00eb \u00e7uar deri n\u00eb fund vepr\u00ebn e tyre t\u00eb mbrapsht\u00eb.
