{"id":2511,"date":"2010-05-08T23:34:13","date_gmt":"2010-05-08T22:34:13","guid":{"rendered":"http:\/\/fjala.shkoder.net\/?p=2511"},"modified":"2010-05-08T23:34:13","modified_gmt":"2010-05-08T22:34:13","slug":"vendimi-i-kushtetueses-lejon-hapjen-e-kutive-2","status":"publish","type":"post","link":"https:\/\/fjala.info\/2009-2015\/vendimi-i-kushtetueses-lejon-hapjen-e-kutive-2\/","title":{"rendered":"Vendimi i Kushtetueses lejon hapjen e kutive"},"content":{"rendered":"<p><strong>Ulsi Manja<\/strong>*, <em>08.05.2010<\/em><\/p>\n<p>Q\u00eb pas zgjedhjeve te kontestuara te 28 qershorit 2009, n\u00eb fjalorin e debatit politik mes maxhoranc\u00ebs aktuale dhe opozit\u00ebs, n\u00eb mediat vizive dhe ato t\u00eb shkruara, mes analist\u00ebve t\u00eb ndrysh\u00ebm, mes qytetar\u00ebve t\u00eb thjesht\u00eb e deri tek bariu n\u00eb mal, ka z\u00ebn\u00eb vend e nuk po iu hiqet nga mendja, fjala &#8220;vendim gjykate&#8221; dhe &#8220;kutit\u00eb nuk hapen sepse k\u00ebshtu ka vendosur gjykata&#8221;. Kur qeveritar\u00ebt k\u00ebrkojn\u00eb t\u00eb edukojn\u00eb qytetar\u00ebt me frym\u00ebn e respektimit t\u00eb ligjit dhe t\u00eb vendimeve t\u00eb gjykatave, deri k\u00ebtu, nuk shoh asgj\u00eb t\u00eb keqe; por kur me k\u00ebt\u00eb alibi k\u00ebrkohet q\u00eb t\u00eb mbahet peng demokracia dhe integrimi i vendit, at\u00ebher\u00eb opozita ka detyrimin t&#8217;i thot\u00eb &#8220;stop&#8221; maxhoranc\u00ebs, ose si\u00e7 thot\u00eb nj\u00eb shprehje t\u00eb urt\u00eb popullore &#8220;ndalu beg se ka hendek&#8221;.<\/p>\n<p>Rrug\u00eb p\u00ebr zgjidhjen e kriz\u00ebs politike ka n\u00eb qoft\u00eb se t\u00eb dy krah\u00ebt e politik\u00ebs e trajtojn\u00eb at\u00eb si t\u00eb till\u00eb dhe jo si shkelje e parimit t\u00eb ndarjes s\u00eb pushteteve. P\u00ebr sa ka ndodhur deri tani, e shoh me vend t\u00eb sjell n\u00eb v\u00ebmendjen e lexuesit disa argumente q\u00eb provojn\u00eb se kriza \u00ebsht\u00eb t\u00ebr\u00ebsisht artificiale dhe pasoj\u00eb e munges\u00ebs s\u00eb vullnetit t\u00eb maxhoranc\u00ebs p\u00ebr t\u00eb trajtuar nj\u00eb k\u00ebrkes\u00eb legjitime t\u00eb opozit\u00ebs.<\/p>\n<p>S\u00eb pari: P\u00ebr t\u00eb zgjidhur kriz\u00ebn politike aktuale, m\u00eb e pakta q\u00eb duhet t\u00eb b\u00ebj\u00eb kryeministri dhe maxhoranca q\u00eb ai drejton, \u00ebsht\u00eb t\u00eb l\u00ebn\u00eb m\u00ebnjan\u00eb rolin e juristit dhe t\u00eb ulen p\u00ebr t\u00eb zgjidhur kriz\u00ebn n\u00eb nivel politik, pasi rezoluta e K\u00ebshillit t\u00eb Evrop\u00ebs nuk ka artikuluar termin &#8220;kriz\u00eb juridike&#8221; apo &#8220;boshll\u00ebk ligjor&#8221;, por \u00ebsht\u00eb shprehur qart\u00eb q\u00eb n\u00eb Shqip\u00ebri ka kriz\u00eb politike dhe k\u00ebt\u00eb kriz\u00eb e zgjidhin ata q\u00eb merren me politik\u00eb dhe jo jurist\u00ebt apo grupet e interesit. Ato thjesht mund t\u00eb japin ndihm\u00eb teknike, gjithmon\u00eb, n\u00ebse ua k\u00ebrkon politika.<\/p>\n<p>S\u00eb dyti: Maxhoranca duhet t\u00eb tregoj\u00eb vullnet politik p\u00ebr zgjidhjen e kriz\u00ebs dhe kjo, pik\u00ebs\u00ebpari, b\u00ebhet duke respektuar vendimet e gjykatave, ashtu si\u00e7 e k\u00ebrkon interesi i vendit dhe ai publik dhe kurrsesi n\u00eb kund\u00ebrshtim me frym\u00ebn e vet\u00eb k\u00ebtyre vendimeve, thjesht sepse asaj i intereson t\u00eb mbaj\u00eb pushtetin duke zhytur vendin n\u00eb kriz\u00eb politike. N\u00eb rastin konkret, maxhoranca po mundohet t\u00eb mbuloj\u00eb gjith\u00eb problematik\u00ebn e zgjedhjeve t\u00eb 28 qershorit 2009 me nj\u00eb vendim t\u00eb Gjykat\u00ebs Kushtetuese t\u00eb vitit 2003, lidhur me &#8220;interpretimin p\u00ebrfundimtar t\u00eb Nenit 77, pika 2 t\u00eb Kushtetut\u00ebs t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, p\u00ebr komisionet hetimore t\u00eb Kuvendit&#8221;, duke e deformuar q\u00ebllimisht frym\u00ebn dhe q\u00ebllimin e k\u00ebtij vendimi.<\/p>\n<p>S\u00eb treti: Un\u00eb mendoj se ky vendim i Gjykat\u00ebs Kushtetuese \u00ebsht\u00eb pik\u00ebnisja m\u00eb e mir\u00eb e dialogut mes maxhoranc\u00ebs dhe opozit\u00ebs, n\u00eb rast se ai lexohet dhe interpretohet ashtu si\u00e7 ka dashur n\u00eb t\u00eb v\u00ebrtet\u00eb kjo trup\u00eb gjykuese. N\u00eb k\u00ebt\u00eb pik\u00eb e shoh me vend ti t\u00ebrheq v\u00ebmendjen opozit\u00ebs se ajo ka barr\u00ebn t\u00eb qart\u00ebsoj\u00eb partnered nd\u00ebrkomb\u00ebtar\u00eb se hapja e kutive n\u00eb funksion t\u00eb interesit publik dhe t\u00eb p\u00ebrmir\u00ebsimit t\u00eb funksionimit t\u00eb demokracis\u00eb n\u00eb vend gjen materializimin m\u00eb t\u00eb sakt\u00eb n\u00eb k\u00ebt\u00eb vendim t\u00eb Gjykat\u00ebs Kushtetuese, e cila, duke dashur t\u00eb sqaroj\u00eb rolin e komisioneve hetimore, ka qart\u00ebsuar shprehimisht se &#8220;\u00e7\u00ebshtjet e ve\u00e7anta q\u00eb p\u00ebrb\u00ebjn\u00eb thelbin e objektit t\u00eb veprimtaris\u00eb s\u00eb komisioneve hetimore parlamentare, t\u00eb cilat e p\u00ebrmbajn\u00eb n\u00eb vetvete interesin publik, jan\u00eb ato q\u00eb hetohen n\u00eb aspektin e kontrollit e t\u00eb zbatimit t\u00eb ligjeve, t\u00eb njohjes e verifikimit n\u00eb thell\u00ebsi t\u00eb nj\u00eb fenomeni, ngjarjeje, a veprimtarie dhe q\u00eb nxisin iniciativat p\u00ebr propozime, amendime apo miratime ligjesh, me q\u00ebllim parandalimin e fenomeneve negative p\u00ebr shoq\u00ebrin\u00eb e shtetin dhe nxjerrjen e p\u00ebrgjegj\u00ebsive institucionale&#8221;.<\/p>\n<p>Ky interpretim q\u00eb b\u00ebn Gjykata Kushtetuese n\u00eb fakt \u00ebsht\u00eb thelbi i k\u00ebrkes\u00ebs s\u00eb opozit\u00ebs p\u00ebr ngritjen e komisionit parlamentar p\u00ebr hetimin e zgjedhjeve t\u00eb 28 qershorit 2009. Opozita duhet t\u00eb qart\u00ebsoj\u00eb nd\u00ebrkomb\u00ebtar\u00ebt se ajo q\u00eb artikulon \u00e7do dit\u00eb Edi Rama se &#8220;kutit\u00eb duhen hapur p\u00ebr t\u00eb b\u00ebr\u00eb autopsin\u00eb e k\u00ebtyre zgjedhjeve, me q\u00ebllim q\u00eb zgjedhjet e ardhshme t\u00eb mos vdesin nga e nj\u00ebjta s\u00ebmundje&#8221;, \u00ebsht\u00eb as m\u00eb shum\u00eb dhe as me pak nj\u00eb artikulim i marr\u00eb nga ky vendim i Gjykat\u00ebs Kushtetuese. <\/p>\n<p>Q\u00eb t\u00eb arrihet me sukses parandalimi i fenomeneve negative p\u00ebr zgjedhjet e ardhshme, duhet t\u00eb dihet dhe studiohet me thell\u00ebsi problematika e zgjedhjeve q\u00eb lam\u00eb pas, duhet t\u00eb nxirren p\u00ebrgjegj\u00ebsit\u00eb institucionale dhe individuale t\u00eb gjithsecilit, me q\u00ebllim diagnostikimin dhe sh\u00ebrimin e s\u00ebmundjeve q\u00eb kan\u00eb zgjedhjet n\u00eb Shqip\u00ebri prej gati 20 vjet\u00ebsh dhe ata q\u00eb merren me hetimin p\u00ebr shkak t\u00eb detyr\u00ebs zyrtare (e kam fjal\u00ebn p\u00ebr prokuror\u00ebt) e din\u00eb mjaft mir\u00eb se p\u00ebr t\u00eb hetuar nj\u00eb ngjarje apo dukuri k\u00ebrkohet gjithanshm\u00ebri, objektivitet dhe shpejt\u00ebsi. Dhe kjo arrihet n\u00ebp\u00ebrmjet dy metodave t\u00eb hetimit t\u00eb zgjedhjeve kuvendore: nga periferia e ngjarjes q\u00eb \u00ebsht\u00eb fushata parazgjedhore, dita e zgjedhjeve, num\u00ebrimi, etj., drejt qendr\u00ebs q\u00eb jan\u00eb kutit\u00eb e votimit ose anasjelltas. N\u00eb rastin konkret, opozita p\u00ebr t\u00eb leht\u00ebsuar pun\u00ebn e k\u00ebtij komisioni hetimor k\u00ebrkon rrug\u00ebn e dyt\u00eb t\u00eb hetimit t\u00eb zgjedhjeve.<\/p>\n<p>S\u00eb kat\u00ebrti: Maxhoranca kapet fort pas nj\u00eb parimi klasik q\u00eb vepron n\u00eb drejt\u00ebsi q\u00eb \u00ebsht\u00eb &#8220;parimi i gj\u00ebs\u00eb s\u00eb gjykuar&#8221;, kur shprehet se kutit\u00eb nuk hapen se ka nj\u00eb vendim t\u00eb form\u00ebs s\u00eb prer\u00eb t\u00eb Kolegjit Zgjedhor p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje. Parimi i gj\u00ebs\u00eb s\u00eb gjykuar ka vler\u00eb n\u00eb rastin e zgjidhjes gjyq\u00ebsisht t\u00eb nj\u00eb marr\u00ebdh\u00ebnie t\u00eb caktuar n\u00eb hierarkin\u00eb e sistemit gjyq\u00ebsor me vendim t\u00eb form\u00ebs s\u00eb prer\u00eb, nd\u00ebrsa produkti p\u00ebrfundimtar i nj\u00eb komisioni hetimor parlamentar, si\u00e7 definohet n\u00eb Kushtetut\u00eb dhe Rregulloren e Kuvendit, nuk cenon zgjidhjen e dh\u00ebn\u00eb nga gjykata p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje; ajo thjesht b\u00ebn transparenc\u00ebn e asaj l\u00ebnde q\u00eb ka \u00e7uar gjykat\u00ebn n\u00eb k\u00ebt\u00eb vendimmarrje, por kurrsesi nuk ka tag\u00ebr ose prerogativ\u00eb gjyq\u00ebsore p\u00ebr t\u00eb shfuqizuar vendimet e mara nga ana e gjykatave dhe as t\u00eb b\u00ebj\u00eb rolin e akuz\u00ebs.<\/p>\n<p>Edhe n\u00eb k\u00ebt\u00eb pik\u00eb na vjen n\u00eb ndihm\u00eb vendimi i Gjykat\u00ebs Kushtetuese i vitit 2003, kur shprehet se komisionet hetimore parlamentare zhvillojn\u00eb deri diku veprimtari gjyq\u00ebsore apo &#8220;quasi gjyq\u00ebsore&#8221;, por ato kan\u00eb disa cil\u00ebsi t\u00eb ve\u00e7anta, t\u00eb tilla si: nuk nd\u00ebrhyjn\u00eb n\u00eb juridiksionin e gjykatave, nuk marrin kompetencat l\u00ebndore t\u00eb gjykatave, raporti final i komisionit hetimor nuk ka fuqi detyruese mbi organet e tjera dhe, aq m\u00eb pak, mbi vendimet e form\u00ebs s\u00eb prer\u00eb t\u00eb gjykatave, komisionet hetimore nuk jan\u00eb mjet i Kuvendit p\u00ebr t\u00eb marr\u00eb p\u00ebrsip\u00ebr atribute hetimi dhe gjykimi q\u00eb me ligj i takojn\u00eb prokuroris\u00eb dhe gjykatave, por jan\u00eb mjet efektiv i kontrollit t\u00eb Kuvendit mbi pushtetet e tjera.<\/p>\n<p>N\u00eb rastin konkret, opozita e ka b\u00ebr\u00eb t\u00eb qart\u00eb q\u00eb nuk k\u00ebrkon p\u00ebrmbysje t\u00eb rezultatit n\u00eb tavolin\u00eb dhe as rishikim t\u00eb produktit q\u00eb kan\u00eb prodhuar vendimet e KQZ-s\u00eb dhe Kolegjit Zgjedhor n\u00eb lidhje me shp\u00ebrndarjen e mandateve t\u00eb deputet\u00ebve q\u00eb dol\u00ebn nga zgjedhjet e 28 qershorit 2009 sepse k\u00ebt\u00eb e pengon nga pik\u00ebpamja kushtetuese, respektimi i pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit dhe parimi klasik i &#8220;gj\u00ebs\u00eb s\u00eb gjykuar&#8221;. <\/p>\n<p>Maxhoranca e di mjaft mir\u00eb q\u00eb komisioni hetimor parlamentar nuk ka tag\u00ebr ose prerogativa t\u00eb shfuqizimit t\u00eb vendimeve t\u00eb form\u00ebs s\u00eb prer\u00eb t\u00eb gjykat\u00ebs, por q\u00ebllimisht k\u00ebrkon ta vesh\u00eb komisionin hetimor parlamentar q\u00eb k\u00ebrkon opozita me funksione t\u00eb nj\u00eb &#8220;Gjykate m\u00eb t\u00eb Lart\u00eb&#8221; n\u00eb raport me vendimet e KQZ-s\u00eb dhe Kolegjit Zgjedhor, me synim q\u00eb tu mbush\u00eb mendjen nd\u00ebrkomb\u00ebtar\u00ebve se opozita k\u00ebrkon t\u00eb shfuqizoj\u00eb rolin dhe pavar\u00ebsin\u00eb e pushtetit gjyq\u00ebsor, pasi n\u00eb k\u00ebt\u00eb pik\u00eb nd\u00ebrkomb\u00ebtar\u00ebt jan\u00eb shum\u00eb t\u00eb ndjesh\u00ebm.<\/p>\n<p>Produkti final i komisionit hetimor, sigurisht q\u00eb nuk ka efekte detyruese mbi gjykatat, por ndikimi i tij n\u00eb nivelin politik mund t\u00eb jet\u00eb i konsideruesh\u00ebm. Dhe opozita k\u00ebt\u00eb k\u00ebrkon; sh\u00ebrimin e zgjedhjeve n\u00eb nivelin politik e pastaj n\u00eb rrafshin juridik dhe ky nuk \u00ebsht\u00eb vet\u00ebm interes i saj, por i gjith\u00eb klas\u00ebs politike dhe shoq\u00ebris\u00eb shqiptare. P\u00ebr t\u00eb b\u00ebr\u00eb nj\u00eb pun\u00eb t\u00eb till\u00eb, natyrisht, duhen t\u00eb dh\u00ebna dhe fakte q\u00eb mblidhen vet\u00ebm n\u00ebp\u00ebrmjet k\u00ebtij komisioni hetimor kuvendor dhe k\u00ebt\u00eb e sqaron n\u00eb m\u00ebnyr\u00eb t\u00eb past\u00ebr vendimi i Gjykat\u00ebs Kushtetuese kur shprehet: &#8220;Duke hetuar nj\u00eb fush\u00eb t\u00eb caktuar brenda kompetencave q\u00eb p\u00ebrfshihen n\u00eb p\u00ebrgjegj\u00ebsin\u00eb kushtetuese t\u00eb Kuvendit, mund t\u00eb arrij\u00eb t\u00eb gjej\u00eb t\u00eb dh\u00ebna, t\u00eb cilat p\u00ebrb\u00ebjn\u00eb shkak p\u00ebr t&#8217;u vler\u00ebsuar nga ana e tij, por, pa hyr\u00eb n\u00eb sfer\u00ebn e organeve hetimore e gjyq\u00ebsore t\u00eb ngarkuara nga Kushtetuta p\u00ebr veprimtari t\u00eb k\u00ebtij lloji&#8221;. Ajo q\u00eb u intereson pal\u00ebve n\u00eb nj\u00eb proces politik, nga raporti p\u00ebrfundimtar i komisionit parlamentar, \u00ebsht\u00eb marrja e produktit problematik me q\u00ebllim nd\u00ebrhyrjen n\u00eb nivel politik n\u00eb drejtim t\u00eb nj\u00eb ligj-b\u00ebrje m\u00eb t\u00eb mir\u00eb n\u00eb t\u00eb ardhmen.<\/p>\n<p>S\u00eb pesti: Gjykata Kushtetuese, me vendimin e saj, ka dh\u00ebn\u00eb q\u00eb n\u00eb vitin 2003 solucionin e zgjidhjes s\u00eb kriz\u00ebs politike aktuale kur shprehet se: &#8220;Kuvendi, &#8220;n\u00eb rastet kur k\u00ebrkohet ngritja e komisionit hetimor nga nj\u00eb e kat\u00ebrta e deputet\u00ebve, ka detyrimin q\u00eb t\u00eb mos e diskutoj\u00eb ngritjen e komisionit, por ia n\u00ebnshtron diskutimit parlamentar shkall\u00ebn e respektimit t\u00eb parimeve kushtetuese n\u00eb objektin e veprimtaris\u00eb s\u00eb tij. Prandaj, kufizimet e lejueshme kushtetuese q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me respektimin e parimeve t\u00eb r\u00ebnd\u00ebsishme fokusohen n\u00eb objektin e hetimit, i cili nuk mund t\u00eb reduktohet nga Kuvendi deri n\u00eb at\u00eb mas\u00eb sa t&#8217;ia b\u00ebj\u00eb t\u00eb pamundur komisionit kryerjen e veprimtaris\u00eb&#8230;&#8230;, duke dhunuar n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb ushtrimin normal t\u00eb k\u00ebsaj t\u00eb drejte&#8221;.<\/p>\n<p>Efektivisht, duke iu referuar argumentit t\u00eb dh\u00ebn\u00eb m\u00eb sip\u00ebr nga Gjykata Kushtetuese, sipas mendimit tim, zgjidhja e kriz\u00ebs politike aktuale b\u00ebhet krejt e thjesht\u00eb: K\u00ebshtu, n\u00eb tryez\u00ebn e Presidentit, pal\u00ebt, me vullnet t\u00eb plot\u00eb politik, duhet t\u00eb bien dakord p\u00ebr ngritjen e komisionit hetimor parlamentar p\u00ebr zgjedhjet e 28 qershorit 2009; shumic\u00ebn e vendimmarrjes n\u00eb k\u00ebt\u00eb komision ta ket\u00eb opozita dhe ky komision t\u00eb vendos\u00eb vet\u00eb n\u00eb diskrecion me shumic\u00eb votash p\u00ebr metod\u00ebn e hetimit, duke p\u00ebrfshir\u00eb edhe hapjen e kutive, mjafton q\u00eb hetimi i zgjedhjeve t\u00eb jet\u00eb i plot\u00eb dhe t\u00eb zbardh\u00eb gjith\u00eb problematik\u00ebn e hasur. <\/p>\n<p>Nj\u00eb variant tjet\u00ebr mund t\u00eb ishte q\u00eb komisioni hetimor parlamentar, gjithmon\u00eb n\u00eb funksion t\u00eb nj\u00eb hetimi t\u00ebr\u00ebsor dhe objektiv t\u00eb problematik\u00ebs s\u00eb zgjedhjeve, t\u00eb ket\u00eb t\u00eb drejt\u00ebn q\u00eb me k\u00ebrkes\u00ebn e dy an\u00ebtar\u00ebve t\u00eb komisionit hetimor, rast pas rasti, kur e \u00e7mon t\u00eb nevojshme, t\u00eb b\u00ebj\u00eb hapjen e detyrueshme t\u00eb kutive n\u00eb ato zona zgjedhore q\u00eb jan\u00eb l\u00ebn\u00eb jasht\u00eb trajtimit nga Kolegji Zgjedhor, nd\u00ebrsa n\u00eb zonat zgjedhore p\u00ebr t\u00eb cilat \u00ebsht\u00eb shprehur Kolegji Zgjedhor, t\u00eb b\u00ebhet transparenca e plot\u00eb vet\u00ebm e materialeve zgjedhore.<\/p>\n<p>Pra, rrug\u00eb ligjore p\u00ebr zgjidhjen e kriz\u00ebs ka, por vullneti politik i pal\u00ebve duhet q\u00eb n\u00ebp\u00ebrmjet parlamentit ti jap\u00eb diskrecion komisionit hetimor n\u00eb drejtim t\u00eb metod\u00ebs q\u00eb do t\u00eb zgjidhet p\u00ebr t\u00eb hetuar rreth objektit t\u00eb hetimit. Opozita, n\u00eb k\u00ebmbim t\u00eb k\u00ebsaj zgjidhje, e ka dh\u00ebn\u00eb konsensusin e saj, ka deklaruar se njeh dhe pranon zgjedhjet e 28 Qershorit, pavar\u00ebsisht se ato jan\u00eb shprehje e nj\u00eb vullneti qytetar t\u00eb deformuar.
