After the refusal of Ramiz Krasniqi and Musa Dragusha to become EULEX\u2019s instruments in this injustice against Albin and VET\u00cbVENDOSJE!, finally EULEX found a lawyer ready to make its job of persecuting Albin Kurti easier. During his introductory comments, de Mongeot praised the position of this new lawyer toward Albin\u2019s case, comparing him with the previous lawyers, Ramiz Krasniqi and Musa Dragusha. This illustrated the obedience and close cooperation of the lawyer in question towards EULEX and the trial it is leading.<\/p>\n After this, Avni Gjakova spoke, and in the first part of his address, he dedicated 5 minutes to his patriotism, explaining that he is Albanian. Then he declared that what happened on 10th February had turned into a \u201ctragic-comedy\u201d: A tragedy because people were killed, but a comedy because of the trial against Albin. And when the atmosphere that he had created with his speech, suggested that he might give his resignation, he presented a request to the EULEX panel. According to his request, the Panel should be constituted of Albanians and not internationals. Thus, he was not against the EULEX panel as such, and thus against EULEX being above our courts, but he was just against the ethnic constitution of this Panel. The ethnic structure of the Panel is not the main problem in this case, but EULEX itself, its presence and its executive power, which is above our courts and makes impossible the justice and fairness of the courts. In addition to this, it appears that Avni Gjakova misinterpreted Albin\u2019s call to all lawyers, judges and prosecutors of Kosova on purpose. Albin had said: \u201cI will accept only a court of the Republic of Kosova, without EULEX above it\u201d. Yet, the case against Albin Kurti is the harshest and clearest example of EULEX\u2019s domination of Kosova\u2019s courts: First, because the case was re-started by EULEX itself; second, because the EULEX Special Prosecutor is leading this case; and thirdly, because in this case, EULEX has assigned the prosecutor, defense lawyer and local judge in its own Panel. The District Court is just assisting in this trial.<\/p>\n After Avni Gjakova presented his request, the Panel withdrew to analyze his request. The Presiding Judge de Mongeot then stated that Avni Gjakova\u2019s request would be sent to the Presidency of the Assembly of EULEX Judges. De Mongeot was also very understanding towards Gjakova\u2019s request, since he understood that the request was neither substantive, nor above all, achievable. All that de Mongeot wanted was the physical presence of the defense lawyer in the future trial session, because only his physical presence is necessary to ensure the procedures necessary for the persecution of Albin Kurti to continue. Finally, the Presiding Judge said that this Panel will continue with the same constitution at least until the review of Gjakova\u2019s request by the competent authorities, without prejudging the legitimacy of his request.<\/p>\n The Judging Panel adjourned the next trial session to Thursday at 11:00.
