Sipas saj, \u201ce drejta p\u00ebrb\u00ebn baz\u00ebn dhe kufijt\u00eb e veprimtaris\u00eb s\u00eb shtetit\u201d, dhe se k\u00ebto t\u00eb drejta \u201cjan\u00eb t\u00eb pandashme, t\u00eb patjet\u00ebrsueshme e t\u00eb padhunueshme dhe q\u00ebndrojn\u00eb n\u00eb themel t\u00eb t\u00eb gjith\u00eb rendit juridik\u201d. N\u00eb Kushtetut\u00eb gjithashtu citohen edhe paketa t\u00eb tjera konkrete q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me t\u00eb drejtat e njeriut dhe detyrimin shtet\u00ebror p\u00ebr mbrojtjen e tyre, p\u00ebrfshir\u00eb t\u00eb drejt\u00ebn e l\u00ebvizjes, besimit, mendimit, korrespodenc\u00ebs, gjykimit t\u00eb drejt\u00eb, t\u00eb drejtat politike, barazis\u00eb, mosdiskriminimit etj. N\u00eb funksion t\u00eb saj jan\u00eb edhe me dhjet\u00ebra ligje dhe akte t\u00eb tjera n\u00ebnligjore q\u00eb sakt\u00ebsojn\u00eb detyrimet shtet\u00ebrore ndaj qytetar\u00ebve. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, raporti midis shtetit, rendit kushtetues dhe qytetarit merr nj\u00eb mbrojtje t\u00eb theksuar kushtetuese dhe n\u00eb pamje t\u00eb par\u00eb, duket se t\u00eb drejtat e qytetar\u00ebve shqiptar\u00eb jan\u00eb m\u00eb se t\u00eb mbrojtura dhe t\u00eb garantuara.<\/p>\n<p>N\u00ebse shohim p\u00ebrtej Kushtetut\u00ebs dhe dokumenteve t\u00eb shkruara, zbatimi praktik i ligjeve n\u00eb raport me qytetar\u00ebt dhe t\u00eb drejtat e tyre jan\u00eb kund\u00ebrshtuese. \u00c7do dit\u00eb, \u00e7do or\u00eb, n\u00eb publik dhe n\u00eb veprime zyrtare ne jemi d\u00ebshmitar\u00eb se si shteti dhe politika, institucionet dhe entet publike tregojn\u00eb mosp\u00ebrfillje deri edhe arroganc\u00eb ndaj qytetarit dhe asaj \u00e7far\u00eb p\u00ebrfaq\u00ebson ai. Jan\u00eb skena q\u00eb ne i shohim p\u00ebrdit\u00eb dhe duke i par\u00eb k\u00ebshtu jemi m\u00ebsuar me to dhe nuk b\u00ebjn\u00eb m\u00eb p\u00ebrshtypje si p.sh, policia e shtetit q\u00eb nxjerr t\u00eb arrestuar dhe t\u00eb mitur p\u00ebrpara kamerave, kur n\u00eb fakt ata jan\u00eb t\u00eb arrestuar p\u00ebr veprime t\u00eb dyshuara dhe nuk jan\u00eb shpallur ende t\u00eb fajsh\u00ebm nga gjykata; tatimet q\u00eb shpallin n\u00eb media emra firmash problematike kur n\u00eb fakt do t\u00eb duhej nj\u00eb vendim gjykate p\u00ebr faj\u00ebsimin e tyre; organet ushtarake q\u00eb marrin me forc\u00eb t\u00eb rinj p\u00ebr ti d\u00ebrguar ushtar\u00eb kur n\u00eb fakt duhet informuar familja dhe t\u00eb respektohet integriteti i tyre; organet e arsimit t\u00eb cilat urdh\u00ebrojn\u00eb m\u00ebsuesit t\u00eb japin or\u00eb falas m\u00ebsimi, kur n\u00eb fakt me kushtetut\u00eb ndalohet puna e papaguar; ministria e sh\u00ebndet\u00ebsis\u00eb e cila shpall fushat\u00eb largimesh t\u00eb mjek\u00ebve t\u00eb akuzuar nga pacient\u00ebt, kur n\u00eb fakt ata kan\u00eb status dhe faji i tyre mund t\u00eb provohet nga gjykata; vet\u00eb gjykatat t\u00eb cilat refuzojn\u00eb padit\u00eb civile qytetare p\u00ebr shkak t\u00eb presioneve politike; dhe s\u00eb fundi, vet\u00eb media dhe p\u00ebr t\u00eb tep\u00ebr, vet\u00eb politika, e cila e shnd\u00ebrron edhe tribun\u00ebn parlamentare n\u00eb tribun\u00eb sharjesh, fyerjesh dhe sulmesh verbale mbi jet\u00ebn private, familjen, rrethin shoq\u00ebror dhe organizat\u00ebn politike q\u00eb p\u00ebrfaq\u00ebson kund\u00ebrshtari politik i radh\u00ebs.<\/p>\n<p>Presidenti Karter, i njohur p\u00ebr angazhimet p\u00ebr t\u00eb drejtat e njeriut, m\u00eb se nj\u00ebher\u00eb ka theksuar se \u201ce keqja nuk \u00ebsht\u00eb kur t\u00eb drejtat shkelen, e keqja \u00ebsht\u00eb kur shkelja e t\u00eb drejtave b\u00ebhet normalitet dhe kur qytetari nuk ka nj\u00eb der\u00eb p\u00ebr t\u00eb trokitur p\u00ebr t\u00eb drejtat e tij\u201d. Kjo th\u00ebnie n\u00eb kontestin shqiptar gjen terren dhe fakte t\u00eb shumta aprovimi. P\u00ebr shembull, duke marr\u00eb \u00e7\u00ebshtjen e zgjedhjeve dhe t\u00eb votimeve n\u00eb 19 vjet. Praktika e vjedhjes dhe manipulimit t\u00eb votave n\u00eb thelb \u00ebsht\u00eb praktik\u00eb antikushtetuese dhe antiligjore, ka t\u00eb b\u00ebj\u00eb me t\u00eb drejt\u00ebn m\u00eb universale, t\u00eb vullnetit politik. N\u00eb vendin ton\u00eb kjo e drejt\u00eb \u00ebsht\u00eb trajtuar si pla\u00e7k\u00eb tregu dhe sot, t\u00eb gjith\u00eb pranojn\u00eb se fenomeni vijon vet\u00ebm se debati \u00ebsht\u00eb n\u00ebse n\u00eb zgjedhjet e fundit u vodh m\u00eb pak apo m\u00eb shum\u00eb se n\u00eb zgjedhjet paraardh\u00ebse.<\/p>\n<p>Ose m\u00eb tej, n\u00ebse flasim p\u00ebr praktik\u00ebn e ekonomis\u00eb informale e selektive. Nj\u00eb qytetar q\u00eb nuk ka paguar nj\u00eb fatur\u00eb telefoni, sot nuk ka telefon dhe duhet t\u00eb paguaj\u00eb nj\u00eb gjob\u00eb, kamat\u00ebn dhe rivendosjen e linj\u00ebs. Kurse nj\u00eb individ \u2013 biznesmen q\u00eb ka zhvilluar aktivitet t\u00eb paligjsh\u00ebm financiar n\u00eb vite, tani me nism\u00eb t\u00eb qeveris\u00eb do t\u00eb p\u00ebrfitoj\u00eb amnisti dhe parat\u00eb e burimeve t\u00eb paligjshme do t\u00eb fitojn\u00eb statusin e burimeve normale financiare. Pra, shteti k\u00ebrkon amnisti fiskale p\u00ebr biznesin dhe parat\u00eb e padukshme dhe refuzon p.sh, t\u2019i jap\u00eb fund praktik\u00ebs diskriminuese sipas t\u00eb cil\u00ebs qytetar\u00ebt e disa qyteteve paguajn\u00eb sh\u00ebrbimet sociale (taksa, energjin\u00eb, tatimet, etj) jo vet\u00ebm t\u00eb vetat, por edhe t\u00eb pjes\u00ebs s\u00eb tjet\u00ebr t\u00eb popullsis\u00eb q\u00eb refuzon t\u00eb paguaj\u00eb ose q\u00eb shteti nuk \u00ebsht\u00eb n\u00eb gjendje t\u2019ua mbledh\u00eb.<\/p>\n<p>Dit\u00ebt e fundit Kongresi Amerikan zhvilloi nj\u00eb seanc\u00eb t\u00eb posa\u00e7me hetimi dhe marrje n\u00eb pyetje p\u00ebr kompanin\u00eb japoneze t\u00eb automjeteve \u2018Tojota\u2019, p\u00ebr shkak t\u00eb defekteve t\u00eb konstatuara n\u00eb mark\u00ebn e re t\u00eb automjeteve t\u00eb prodhuar nga kjo kompani. Synimi kryesor i hetimit ishte mbrojtja e konsumator\u00ebve amerikan\u00eb, t\u00eb drejtave t\u00eb qytetar\u00ebve q\u00eb kishin bler\u00eb nj\u00eb makin\u00eb t\u00eb till\u00eb. Kompania erdhi, raportoi, k\u00ebrkoi falje, premtoi kompensim dhe problemi mori zgjidhje. Ne n\u00eb Shqip\u00ebri kemi nj\u00eb parlament, kemi nj\u00eb komision q\u00eb duhet t\u00eb mbroj\u00eb t\u00eb drejtat e konsumatorit, kemi nj\u00eb komision tjet\u00ebr p\u00ebr t\u00eb drejtat e njeriut, por as nj\u00ebri dhe as tjetri nuk kan\u00eb zhvilluar asnj\u00ebher\u00eb n\u00eb 19 vjet, nj\u00eb seanc\u00eb d\u00ebgjimore apo hetimi mbi nj\u00eb problem q\u00eb lidhet me k\u00ebrkesat dhe problematik\u00ebn qytetare.<\/p>\n<p>Shteti shqiptar sot \u00ebsht\u00eb nd\u00ebr t\u00eb vetmit n\u00eb list\u00ebn e shteteve demokratike, q\u00eb nuk ka nj\u00eb institucion konkret q\u00eb trajtohen t\u00eb drejtat e njeriut (politike dhe ekonomike, fetare dhe sociale) dhe nuk ka nj\u00eb raport t\u00eb gjendjes s\u00eb tyre vjetore. Zakonisht k\u00ebt\u00eb zbraz\u00ebti e p\u00ebrmbush raporti vjetor i Departamentit Amerikan t\u00eb Shtetit mbi t\u00eb drejtat e njeriut n\u00eb Shqip\u00ebri, por zakonisht, gjithnj\u00eb qeverit\u00eb tona refuzojn\u00eb pjes\u00ebt kritike t\u00eb k\u00ebtij raporti dhe asnj\u00eb institucion nuk merret me problemet q\u00eb ngrihen prej tij, p\u00ebr tu dh\u00ebn\u00eb zgjidhje ligjore dhe administrative.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, ne kemi institucione shtet\u00ebrore dhe ente publike, t\u00eb cilat p\u00ebr shkak t\u00eb interpretimit t\u00eb s\u00eb mir\u00ebs publike ose p\u00ebr shkak t\u00eb p\u00ebrgjegj\u00ebsive direkte t\u00eb keqmenaxhimit t\u00eb tyre, kthehen n\u00eb shkaktar\u00ebt kryesor\u00eb jo vet\u00ebm t\u00eb cenimit t\u00eb t\u00eb drejtave t\u00eb njeriut, por edhe t\u00eb humbjes s\u00eb jet\u00ebs s\u00eb qytetar\u00ebve t\u00eb pafajsh\u00ebm. N\u00eb G\u00ebrdec nj\u00eb skandal shtet\u00ebror kushtoi jet\u00ebt e 26 personave t\u00eb pafajsh\u00ebm, n\u00eb Shkod\u00ebr hapja p\u00ebr shkak t\u00eb keqmenaxhimit t\u00eb hidrocentraleve shkaktoi d\u00ebme t\u00eb pallogaritshme materiale, n\u00eb Durr\u00ebs dhe Gjirokast\u00ebr, nd\u00ebrtimet jasht\u00eb kritereve ligjore por me leje shtet\u00ebrore shkaktuan rr\u00ebzime pallatesh dhe humbje t\u00eb jet\u00ebs s\u00eb pafajshme qytetare; gjat\u00eb vitit 2009 n\u00eb 10 raste punonj\u00ebs t\u00eb KESH ose elektricist\u00eb privat\u00eb humb\u00ebn jet\u00ebn n\u00eb detyr\u00eb p\u00ebr shkak t\u00eb l\u00ebshimit t\u00eb paparalajm\u00ebruar t\u00eb energjis\u00eb nga entet lokale t\u00eb k\u00ebtij institucioni; \u00e7do vit me dhjet\u00ebra sht\u00ebpi n\u00eb jug e n\u00eb veri digjen apo humbin pajisje t\u00eb kushtueshme p\u00ebr shkak t\u00eb l\u00ebvizjes s\u00eb tensionit t\u00eb lart\u00eb t\u00eb energjis\u00eb; viktimat e pikave t\u00eb gazit, t\u00eb karburanteve dhe t\u00eb aksidenteve n\u00eb pun\u00eb ose n\u00eb rrug\u00eb vijojn\u00eb t\u00eb jen\u00eb pjes\u00eb e kronikave t\u00eb zakonshme; nj\u00eb f\u00ebmij\u00eb u prek nga SIDA p\u00ebr faj t\u00eb sh\u00ebrbimit spitalor, nd\u00ebrkoh\u00eb q\u00eb asnj\u00eb individ nuk \u00ebsht\u00eb v\u00ebn\u00eb akoma p\u00ebrpara drejt\u00ebsis\u00eb dhe asnj\u00eb institucion p\u00ebrgjegj\u00ebs nuk ka b\u00ebr\u00eb ende kompensimin e d\u00ebmeve t\u00eb shkaktuara njer\u00ebzore dhe materiale. Kompania \u2018Tojota\u2019 shpalli kompensim p\u00ebr d\u00ebmet e shkaktuara, kurse tek ne, u desh nj\u00eb debat publik shtet \u2013 media \u2013 politik\u00eb p\u00ebr t\u00eb bindur ca zyrtar\u00eb t\u00eb OSSH-s\u00eb p\u00ebr t\u00eb kompensuar nj\u00eb vjedhje publike t\u00eb t\u00eb ardhurave t\u00eb familjeve shqiptare, faturimin e dyfisht\u00eb me nj\u00eb \u00e7mim m\u00eb t\u00eb lart\u00eb t\u00eb kuot\u00ebs reale t\u00eb muajit dhjetor 2009.<\/p>\n<p>Shqip\u00ebria ka nj\u00eb inspektorat pune, por gjithnj\u00eb ndodh q\u00eb, sa her\u00eb ka incidente me vdekje ose aksidentim t\u00eb punonj\u00ebsve gjat\u00eb pun\u00ebs (vitin 2009 ishin 32 raste t\u00eb tilla), ky inspektorat faj\u00ebson viktim\u00ebn dhe jo kompanin\u00eb, firm\u00ebn apo entin publik ku ka ndodhur aksidenti. N\u00eb Britanin\u00eb e Madhe nj\u00eb shqiptar fitoi m\u00eb 2009-\u00ebn nj\u00eb gjyq me vler\u00eb 1 milion paund sepse mbeti i aksidentuar n\u00eb pun\u00eb, kurse n\u00eb Shqip\u00ebri vet\u00ebm n\u00eb Bulqiz\u00eb gjat\u00eb 2009-\u00ebs humb\u00ebn jet\u00ebn 8 minator\u00eb, ose n\u00eb firmat e nd\u00ebrtimit dhe \u00e7imentos humb\u00ebn jet\u00ebn 12 punonj\u00ebs dhe askush nuk u vu p\u00ebrpara p\u00ebrgjegj\u00ebsis\u00eb, familjet e viktimave jetojn\u00eb n\u00eb varf\u00ebri, t\u00eb harruar e t\u00eb braktisur si nga shteti ashtu edhe nga kompanit\u00eb dhe firmat p\u00ebrgjegj\u00ebse t\u00eb k\u00ebtyre rasteve. Madje, me gjith\u00eb k\u00ebt\u00eb bilanc tragjik ende nuk kemi pasur nj\u00eb rast t\u00eb vet\u00ebm, n\u00eb t\u00eb cilin nj\u00eb firm\u00eb private apo ent shtet\u00ebror p\u00ebrgjegj\u00ebs p\u00ebr vdekjen e nj\u00eb punonj\u00ebsi t\u00eb ket\u00eb k\u00ebrkuar falje publike apo t\u00eb ket\u00eb njoftuar publikisht praktika hetimi t\u00eb brendsh\u00ebm p\u00ebr gjetjen e p\u00ebrgjegj\u00ebsive nominale. Kurse vet\u00eb shteti dhe krer\u00ebt e tij mjaftohen vet\u00ebm me vizita t\u00eb shoq\u00ebruara me kamera televizive, apo me ndonj\u00eb telegram t\u00eb thjesht\u00eb ngush\u00ebllues.<\/p>\n<p>Problemi m\u00eb i madh \u00ebsht\u00eb se n\u00eb Shqip\u00ebri kemi shum\u00eb institucione q\u00eb e shkelin t\u00eb drejt\u00ebn, por nuk kemi institucione dhe mekanizma q\u00eb e garantojn\u00eb t\u00eb drejt\u00ebn. Institucione si Avokati i Popullit jan\u00eb formale dhe selektive (p.sh, hesht\u00ebn p\u00ebr rastin e faturave t\u00eb energjis\u00eb, p\u00ebrmbytjeve n\u00eb Shkod\u00ebr apo humbjes s\u00eb jet\u00ebs s\u00eb minator\u00ebve n\u00eb Bulqiz\u00eb); gjykatat nuk arrijn\u00eb t\u00eb japin drejt\u00ebsi midis t\u00eb gjall\u00ebve e jo m\u00eb n\u00eb p\u00ebrballje me viktimat, t\u00eb vdekurit; prokuroria me krenari raporti se ka pasur m\u00eb 2009-\u00ebn vet\u00ebm 5 raste \u201ckryesisht\u201d, kur normalisht n\u00eb nj\u00eb vend rajonal si Mali i Zi, raste t\u00eb tilla ishin 25 her\u00eb m\u00eb t\u00eb lart\u00eb; policia ka keqkuptuar rolin e saj dhe merret m\u00eb shum\u00eb me pasojat sesa me parandalimin e rasteve t\u00eb krimit dhe kriminalitetit, institucionet shtet\u00ebrore p\u00ebrgjegj\u00ebse i trajtojn\u00eb rastet n\u00eb labirinthe burokratike q\u00eb nuk ofrojn\u00eb kurr\u00eb zgjidhje; shoq\u00ebrit\u00eb e sigurimit nuk mbulojn\u00eb kompensim p\u00ebr vlera e raste t\u00eb incidenteve t\u00eb m\u00ebdha; organizatat e shoq\u00ebris\u00eb civile merren m\u00eb shum\u00eb me \u00e7\u00ebshtje q\u00eb ofrojn\u00eb donacione e v\u00ebmendje t\u00eb t\u00eb huajve si martesat gej apo rom\u00ebt, sesa jet\u00ebt e cenuara apo t\u00eb humbura t\u00eb qytetar\u00ebve; media raporton kronika e detaje pa k\u00ebrkuar vazhdimisht p\u00ebrgjegj\u00ebsi dhe ndjekje t\u00eb rasteve deri n\u00eb gjetjen e t\u00eb drejt\u00ebs.<\/p>\n<p>Cila \u00ebsht\u00eb zgjidhja? Kushtetuta e thot\u00eb qart\u00eb, shteti \u00ebsht\u00eb p\u00ebrgjegj\u00ebs dhe ka monopolin e mbrojtjes dhe garantimit t\u00eb t\u00eb drejtave t\u00eb njeriut. Shteti p\u00ebrb\u00ebhet nga institucione politike (president, parlament, qeveri, nj\u00ebsi drejtuese lokale) dhe institucione jopolitike (gjykata, prokurori, polici, ushtri, administrat\u00eb, etj). N\u00ebse ai vepron qoft\u00eb edhe n\u00eb nj\u00eb rast t\u00eb vet\u00ebm, t\u00eb pakt\u00ebn krijohet tradita se n\u00eb nj\u00eb rast t\u00eb till\u00eb veprohet. Organet p\u00ebrgjegj\u00ebse duhet t\u00eb krijojn\u00eb nj\u00eb nj\u00ebsi monitorizmi qendrore dhe lokale t\u00eb rasteve t\u00eb cenimit t\u00eb t\u00eb drejtave dhe sidomos t\u00eb humbjes s\u00eb jet\u00ebs s\u00eb qytetar\u00ebve t\u00eb pafajsh\u00ebm, dhe kjo nj\u00ebsi duhet t\u00eb ndjek\u00eb rrug\u00ebn administrative dhe ligjore t\u00eb denoncimit n\u00eb \u00e7do rast dhe p\u00ebr \u00e7do rast.<\/p>\n<p>Avokati i Popullit duhet t\u00eb kaloj\u00eb nga problematika e burgjeve n\u00eb mbrojtjen e jet\u00ebs s\u00eb atyre q\u00eb jetojn\u00eb \u201ct\u00eb burgosur\u201d jasht\u00eb burgjeve; prokuroria duhet t\u00eb ket\u00eb nj\u00eb nj\u00ebsi t\u00eb posa\u00e7me ndjekjeje dhe kall\u00ebzimi p\u00ebr \u00e7do rast konkret dhe se vet\u00eb shoq\u00ebria civile mund t\u00eb krijoj\u00eb nj\u00eb rrjet verifikimesh dhe denoncimesh zyrtare t\u00eb rasteve n\u00eb fjal\u00eb.<br \/>\n\u00c7do k\u00ebshill\u00eb e nism\u00eb \u00ebsht\u00eb produktive m\u00eb shum\u00eb sesa heshtja, sepse n\u00eb fund t\u00eb fundit asgj\u00eb tjet\u00ebr nuk ka vler\u00eb reale, as politika dhe as integrimi, as reformat dhe as kutit\u00eb, as projektet industriale dhe as liberalizimi i vizave, n\u00ebse vet\u00eb shteti e shoq\u00ebria humbin at\u00eb q\u00eb \u00ebsht\u00eb m\u00eb thelb\u00ebsore, respektin p\u00ebr jet\u00ebn, respektin p\u00ebr individin, respektin p\u00ebr integritetin dhe n\u00eb t\u00ebr\u00ebsi, fytyr\u00ebn njer\u00ebzore t\u00eb demokracis\u00eb.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nga: AFRIM KRASNIQI Kushtetuta e Shqip\u00ebris\u00eb, n\u00eb nenin 3 t\u00eb saj thekson se shteti shqiptar ka p\u00ebr baz\u00eb, ve\u00e7 t\u00eb tjerash edhe \u201crespektimin dhe mbrojtjen e t\u00eb drejtave e lirive t\u00eb njeriut\u201d.
