Kjo \u00ebsht\u00eb nj\u00eb tjet\u00ebr \u201cshuplak\u00eb\u201d q\u00eb GjK i jep p\u00ebrpjekjeve t\u00eb mazhoranc\u00ebs p\u00ebr t\u00eb miratuar ligje q\u00eb bien ndesh me Kushtetut\u00ebn dhe q\u00eb k\u00ebrkojn\u00eb t\u00eb vendosin rregulla juridike me ligje q\u00eb votohen me shumic\u00eb t\u00eb thjesht\u00eb.<\/p>\n<p>Tanim\u00eb, \u00ebsht\u00eb rast i p\u00ebrs\u00ebritur, injorimi haptas q\u00eb mazhoranca i b\u00ebn parimeve e kushtetueshm\u00ebris\u00eb s\u00eb shtetit n\u00eb procedur\u00ebn formale t\u00eb miratimit t\u00eb ligjeve, por edhe n\u00eb p\u00ebrmbajtjen e tyre: si n\u00eb ligjin p\u00ebr lustracionin apo n\u00eb marr\u00ebveshjen p\u00ebr p\u00ebrcaktimin e kufirit detar me Greqin\u00eb.<\/p>\n<p>Injorimi q\u00eb i b\u00ebhet Kushtetut\u00ebs, ndarjes dhe balancimit t\u00eb pushteteve, respektimit t\u00eb lirive dhe t\u00eb drejtave t\u00eb njeriut nuk jan\u00eb rast\u00ebsi, por m\u00ebnyr\u00eb e qeverisjes dhe shprehje e prirjeve teje t\u00eb theksuara p\u00ebr t\u00eb injoruar \u00e7do pushtet tjet\u00ebr dhe p\u00ebr t\u00eb p\u00ebrq\u00ebndruar t\u00eb gjitha pushtetet n\u00eb dor\u00ebn e pushtetit ekzekutiv. K\u00ebt\u00eb p\u00ebrfundim e v\u00ebrteton m\u00eb s\u00eb miri, nismat e tjera ligjore t\u00eb hedhura n\u00eb tregun mediatik, para se t\u00eb b\u00ebhen pjes\u00eb e nismave t\u00eb institucioneve t\u00eb interesuara dhe debateve me ekspert\u00eb dhe institucionet p\u00ebrkat\u00ebse.<\/p>\n<p>P\u00ebrpjekjet p\u00ebr t\u00eb ndryshuar ligje t\u00eb r\u00ebnd\u00ebsishme si: ligjin p\u00ebr Sh\u00ebrbimin Informativ Komb\u00ebtar, ligjin \u201cP\u00ebr policin\u00eb gjyq\u00ebsore\u201d, miratimi i ligjit p\u00ebr parandalimin e krimit t\u00eb organizuar mes goditjes s\u00eb pasuris\u00eb etj. trumbetohen si nisma q\u00eb synojn\u00eb t\u00eb luftoj\u00ebn krimin e organizuar, t\u00eb rrisin efektivitetin e institucioneve t\u00eb ngarkuara me ligj p\u00ebr parandalimin dhe luftimin e krimit t\u00eb organizuar, por n\u00eb fakt, jan\u00eb nisma n\u00eb vazhd\u00ebn e d\u00ebshirave t\u00eb shfrenuara p\u00ebr t\u00eb c\u00ebnuar kushtetut\u00ebn, pavar\u00ebsin\u00eb e institucioneve dhe parimet e vendosura n\u00eb kodet e miratuara me votim t\u00eb cil\u00ebsuar.<\/p>\n<p>N\u00eb nj\u00eb koh\u00eb, kur opozita, n\u00eb respekt t\u00eb Kushtetut\u00ebs, t\u00eb vendimeve t\u00eb Gjykat\u00ebs Kushtetuese, t\u00eb pavar\u00ebsis\u00eb s\u00eb gjykatave, rezolut\u00ebs s\u00eb Asambles\u00eb Komb\u00ebtare t\u00eb K\u00ebshillit t\u00eb Europ\u00ebs k\u00ebrkon hetim parlamentar dhe hapjen e kutive p\u00ebr t\u00eb hetuar, mazhoranca betohet dhe p\u00ebrbetohet p\u00ebr respektim t\u00eb Kushtetut\u00ebs, t\u00eb vendimeve Gjykat\u00ebs Kushtetuese, dhe nga ana tjet\u00ebr, i injoron totalisht ato dhe nuk kursen nj\u00eb lum fyerjesh dhe shpifjesh p\u00ebr an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese, sa her\u00eb q\u00eb k\u00ebta t\u00eb fundit vendosin n\u00eb em\u00ebr t\u00eb Kushtetut\u00ebs.<\/p>\n<p>1. Ne i b\u00ebjm\u00eb thirrje mazhoranc\u00ebs q\u00eb t\u00eb heq\u00eb dor\u00eb nga nisma ligjore q\u00eb bien ndesh me Kushtetut\u00ebn dhe procesin formal dhe substancial t\u00eb b\u00ebrjes s\u00eb ligjeve.<\/p>\n<p>2. Ne i b\u00ebjm\u00eb thirrje mazhoranc\u00ebs dhe Kryeministrit Berisha q\u00eb para se t\u00eb nd\u00ebrmarr\u00eb nisma ligjore t\u00eb r\u00ebnd\u00ebsishme, t\u00eb konsultohet me institucionet q\u00eb zbatojn\u00eb ligjet dhe n\u00eb analizat objektive t\u00eb efektivitetit t\u00eb tyre, dhe jo n\u00eb d\u00ebshirat p\u00ebr t\u00eb kontrolluar dhe marr\u00eb n\u00eb nj\u00eb dor\u00eb t\u00eb gjitha pushtetet.<\/p>\n<p>3. Ne i b\u00ebjm\u00eb thirrje mazhoranc\u00ebs q\u00eb direktivat e BE-s\u00eb t\u00eb mos i keqp\u00ebrdor\u00eb dhe keqinterpretoj\u00eb sa her\u00eb q\u00eb merren nisma p\u00ebr ligje q\u00eb synojn\u00eb marrjen e pushteteve n\u00eb nj\u00eb dor\u00eb.<\/p>\n<p>4. Me q\u00ebllim q\u00eb reforma ligjore q\u00eb k\u00ebrkojn\u00eb votim t\u00eb cil\u00ebsuar t\u00eb kryhen, Berisha dhe mazhoranca t\u00eb pranoj\u00eb hetimin parlamentar sic e thekson dhe Rezoluta e K\u00ebshillit t\u00eb Europ\u00ebs,duke filluar me hapjen e kutive p\u00ebr t\u00eb b\u00ebr\u00eb transparenc\u00eb.
