\n\u00b61. (C) SUMMARY: After a long and contentious investigation,
\nprosecutors have forwarded the indictment of Foreign Minister
\nLulzim Basha to the Supreme Court, which will rule on Basha’s
\nguilt or innocence (ref a). To make matters worse for Basha,
\nnewspapers today printed lengthy excerpts from the
\nindictment, which was leaked to the press. Basha’s defense
\nhas been further complicated by infighting within his
\nDemocratic Party, with Basha’s opponents within the party
\nreluctant to come to his defense in hopes that his legal woes
\nwill eliminate him as a potential political rival. END
\nSUMMARY.
\nLegal Troubles Only the Beginning

\n\u00b62. (C) Basha has not been accused of outright corruption.
\nInstead, he has been charged with “abuse of office” and for
\nviolating “equal treatment in a tender process.” In essence,
\nBasha is being charged with negligent oversight and
\nmisrepresenting the projected costs of the Durres-Kukes road
\nproject while serving as Minister of Transportation –
\nnegligence which allegedly resulted in vast cost overruns
\ntotaling nearly 600 million euros. Basha’s defense team –
\nwhen not claiming that the charges are entirely politically
\nmotivated – claims that the approval and oversight of the
\nroad deal was a collective act by the Council of Ministers
\nand others within the Ministry of Transport (ref b).
\nDemocratic Party Rivals Smell Blood

\n\u00b63. (C) Basha’s legal troubles have been complicated by his
\nprecarious position within the Democratic Party, with
\npolitical rivals such as Speaker of Parliament Josephina
\nTopalli looking on with barely-disguised glee. Other PD
\nofficials such as Prime Minister Berisha have offered only
\nlukewarm defenses of Basha, while still using the claim that
\nthe charges against Basha are politically motivated to
\nfurther attack the Prosecutor General. Arben Cici, President
\nTopi’s Diplomatic Advisor, told PolOff that Basha has little
\nto worry about from opposition parties – it’s his own DP,
\nCici claimed, that is out to get Basha. Basha himself echoed
\nthis in a nearly hysterical phone call to the DCM in
\nNovember, claiming that leaks to the media alleging ties
\nbetween Basha’s family and shady Bosnian businessman Damir
\nFazlic were coming from his political rivals within the DP.
\n\u00b64. (C) COMMENT: It remains to be seen how much political
\ndamage the indictment will do to Basha. His indictment is
\ncertainly an embarrassment to Prime Minister Berisha, who
\ncampaigned for office in 2005 on an anti-corruption platform.
\nBasha’s trial will probably begin in January and could drag
\non for several months – potentially complicating Basha’s
\ncandidacy in the upcoming parliamentary elections. In the
\nmeantime, there is no indication that Basha will resign or
