{"id":13476,"date":"2014-03-25T17:30:19","date_gmt":"2014-03-25T16:30:19","guid":{"rendered":"http:\/\/www.fjala.info\/?p=834"},"modified":"2014-03-25T17:30:19","modified_gmt":"2014-03-25T16:30:19","slug":"te-gjithe-te-pergjuar","status":"publish","type":"post","link":"https:\/\/fjala.info\/2009-2015\/te-gjithe-te-pergjuar\/","title":{"rendered":"T\u00eb gjith\u00eb t\u00eb p\u00ebrgjuar"},"content":{"rendered":"<p><img decoding=\"async\" class=\"alignright size-thumbnail wp-image-7236\" title=\"Telefon\" alt=\"\" src=\"http:\/\/www.fjala.info\/2014\/telefon.jpg\" width=\"300\" \/> <strong>Besiana Xharra<\/strong>, <em>24.03.2014<\/em><\/p>\n<p>T\u00eb gjitha bisedat, komunikimet elektronike t\u00eb kosovar\u00ebve do t\u00eb mund\u00eb t\u00eb p\u00ebrgjohen nga Agjencia Kosovare e Inteligjenc\u00ebs (AKI) edhe pa urdhrin paraprak t\u00eb Gjykat\u00ebs.<\/p>\n<p>Kjo gj\u00eb po mund\u00ebsohet me Projektligjin p\u00ebr P\u00ebrgjimin e Komunikimeve Elektronike, i cili \u00ebsht\u00eb hartuar nga Qeveria e Kosov\u00ebs, pavar\u00ebsisht kund\u00ebrshtimeve t\u00eb institucioneve nd\u00ebrkomb\u00ebtare.<\/p>\n<p>Sipas k\u00ebtij projektligji, nj\u00eb kopje t\u00eb t\u00eb cilit e posedon edhe gazeta \u201cZ\u00ebri\u201d, Qeveria e Kosov\u00ebs planifikon q\u00eb AKI-ja t\u00eb jet\u00eb nj\u00ebri nga \u201cinstitucionet e autorizuara\u201d, i cili p\u00ebrve\u00e7 q\u00eb mund t\u00eb k\u00ebrkoj\u00eb nga operator\u00ebt e rrjetit t\u00eb ket\u00eb qasje n\u00eb t\u00eb gjitha komunikimet elektronike t\u00eb transmetuara pand\u00ebrprer\u00eb, asaj i mund\u00ebsohet edhe t\u00eb ket\u00eb nj\u00eb qend\u00ebr lidh\u00ebse brenda operatorit operues, q\u00eb n\u00ebnkupton mund\u00ebsin\u00eb e p\u00ebrgjimit t\u00eb kujtdo, pa dijen e operatorit.<\/p>\n<p>Si i till\u00eb, projektligji konsiderohet q\u00eb shkel t\u00eb drejtat e qytetar\u00ebve, duke i dh\u00ebn\u00eb shum\u00eb kompetenca AKI-s\u00eb, si institucion q\u00eb nuk siguron q\u00eb t\u00eb gjitha p\u00ebrgjimet q\u00eb i b\u00ebn mund t\u00eb mos keqp\u00ebrdoren. Planifikohet q\u00eb institucioni i autorizuar p\u00ebr administrimin n\u00eb qendr\u00ebn monitoruese ka autoritet t\u00eb k\u00ebrkoj\u00eb nga operator\u00ebt e rrjetit apo nga ofruesi i sh\u00ebrbimeve t\u2019i mund\u00ebsohet qasja n\u00eb t\u00eb gjitha komunikimet elektronike.<\/p>\n<p>P\u00ebrgjimet pas afer\u00ebs \u201cPronto\u201d<\/p>\n<p>Rexhep Selimi, z\u00ebvend\u00ebskryetar i Komisionit Parlamentar p\u00ebr Pun\u00eb t\u00eb Brendshme e Siguri, thot\u00eb se insistimi i Qeveris\u00eb p\u00ebr ta kaluar nj\u00eb projektligj t\u00eb till\u00eb ka nisur qysh n\u00eb fillim t\u00eb vitit 2011.<\/p>\n<p>\u201cDrafti i par\u00eb i prezantuar n\u00eb k\u00ebt\u00eb komision \u00ebsht\u00eb vler\u00ebsuar si nj\u00eb ligj jo demokratik dhe si i till\u00eb \u00ebsht\u00eb refuzuar\u201d, pohon Selimi, duke shtuar se Qeveria n\u00eb vitin 2012 e ka sjell\u00eb nj\u00eb draft tjet\u00ebr me disa p\u00ebrmir\u00ebsime, por q\u00eb prap\u00eb nuk ka kaluar, dhe m\u00eb pas vjen deri te drafti i tret\u00eb pas afer\u00ebs s\u00eb njohur \u201cPronto\u201d.<\/p>\n<p>\u201cKur doli afera \u2018Pronto\u2019, n\u00eb frym\u00ebn e atij zem\u00ebrimi, qeveria ka sjell\u00eb p\u00ebr t\u00eb tret\u00ebn her\u00eb nj\u00eb draft, por ai draft ka qen\u00eb i her\u00ebs s\u00eb par\u00eb, pra ka p\u00ebrs\u00ebritur t\u00eb nj\u00ebjtin draft, t\u00eb cilin prap\u00eb ia kemi kthyer\u201d, thot\u00eb Selimi.<\/p>\n<p>Sidoqoft\u00eb, Qeveria shqyrtimin e k\u00ebtij projektligji e ka kaluar te Komisioni Parlamentar p\u00ebr Integrime Evropiane n\u00eb muajin qershor, sipas programit t\u00eb pun\u00ebs s\u00eb Kuvendit t\u00eb Kosov\u00ebs p\u00ebr vitin 2014.<\/p>\n<p>\u201cProjektligji \u00ebsht\u00eb refuzuar nga Komisioni p\u00ebr Siguri, por ka pasur v\u00ebrejtje t\u00eb m\u00ebdha edhe nga bashk\u00ebsia nd\u00ebrkomb\u00ebtare. Megjithat\u00eb qeveria ka insistuar n\u00eb aprovimin e projektligjit, i cili tani ka kaluar te Komisioni p\u00ebr i Integrime Evropiane, q\u00eb nuk \u00ebsht\u00eb n\u00eb rregull\u201d, tha m\u00eb tej Selimi.<\/p>\n<p>Kontroll mbi gjith\u00e7ka elektronike<\/p>\n<p>Deputeti, Rexhep Selimi, thot\u00eb se pas mosmiratimit nga Komisioni Parlamentar p\u00ebr Siguri, shpresat jan\u00eb q\u00eb as Komisioni p\u00ebr Integrime Evropiane t\u00eb mos e miratoj\u00eb nj\u00eb projektligj t\u00eb till\u00eb.<\/p>\n<p>\u201dMbase shpresat e qeveris\u00eb jan\u00eb q\u00eb ky komision ta miratoj\u00eb, dhe un\u00eb k\u00ebtu shoh nj\u00eb tendenc\u00eb t\u00eb qeveris\u00eb p\u00ebr t\u00eb pasur nj\u00eb kontroll t\u00eb plot\u00eb mbi p\u00ebrgjimet elektronike. E k\u00ebtu kemi t\u00eb b\u00ebjm\u00eb jo vet\u00ebm me telefonatat, por me e-mailat, SMS, rrjetet sociale e madje edhe \u2018free call\u2019 si\u00e7 jan\u00eb \u2018Viber\u2019 e t\u00eb tjerat\u201d, tha Selimi.<\/p>\n<p>Ai shton se ekzekutivit t\u00eb vendit nuk duhet t\u2019i ngutet me miratimin e k\u00ebtij projektligji, por tash p\u00ebr tash t\u00eb mbetet kjo \u00e7\u00ebshtje ashtu si\u00e7 e rregullon Kodi Penal, i cili p\u00ebrgjimin e lejon me urdh\u00ebr t\u00eb prokurorit.<\/p>\n<p>Deputeti tjet\u00ebr i Kuvendit t\u00eb Kosov\u00ebs, Haxhi Shala, i cili nga PDK-ja ka kaluar n\u00eb subjektin m\u00eb t\u00eb ri politik n\u00eb vend, \u201cNisma p\u00ebr Kosov\u00ebn\u201d, thot\u00eb se nj\u00eb projektligj i till\u00eb nuk duhet t\u00eb miratohet n\u00eb Kuvend.<\/p>\n<p>\u201cN\u00ebse lejohet p\u00ebrfshirja e AKI-s\u00eb n\u00eb p\u00ebrgjim t\u00eb komunikimeve elektronike pa ndonj\u00eb urdh\u00ebr, leje paraprake t\u00eb gjyq\u00ebsorit, p\u00ebrb\u00ebn shkelje t\u00eb t\u00eb drejtave t\u00eb njeriut dhe si i till\u00eb nuk guxon t\u00eb ndodh\u00eb\u201d, tha Shala.<\/p>\n<p>Nd\u00ebrsa deputeti i PDK-s\u00eb, Zenun Pajaziti, thot\u00eb se projektligji i dedikohet nj\u00eb fushe q\u00eb rregullohet sipas direktivave t\u00eb BE-s\u00eb, dhe, sipas tij, pjesa d\u00ebrmuese e neneve n\u00eb k\u00ebt\u00eb projektligj \u00ebsht\u00eb p\u00ebrshkrim i k\u00ebtyre direktivave.<\/p>\n<p>Deputeti i LDK-s\u00eb, Anton \u00c7uni, thot\u00eb se edhe vet\u00eb nd\u00ebrkomb\u00ebtar\u00ebt e kan\u00eb kritikuar nj\u00eb projektligj t\u00eb till\u00eb.<\/p>\n<p>\u201cProjektligji ka v\u00ebrejtje t\u00eb shumta edhe nga Komisioni p\u00ebr Siguri, por ka pasur reagime edhe nga vet\u00eb nd\u00ebrkomb\u00ebtar\u00ebt. Nuk \u00ebsht\u00eb q\u00eb ne i mohojm\u00eb kompetencat e AKI-s\u00eb p\u00ebr t\u00eb b\u00ebr\u00eb p\u00ebrgjimet, por shqet\u00ebsimi m\u00eb i madh \u00ebsht\u00eb q\u00eb k\u00ebtij Agjencioni t\u00eb i lejohet nj\u00eb qend\u00ebr brenda e autoriteteve operuese\u201d, tha \u00c7uni.<\/p>\n<p>Sipas tij, kjo form\u00eb e pamund\u00ebson p\u00ebr t\u00eb pasur n\u00ebn mbik\u00ebqyrje AKI-n\u00eb, n\u00ebse po nuk po i keqp\u00ebrdor informatat q\u00eb i merr p\u00ebr qytetar\u00ebt<\/p>\n<p>Maloku: AKI-ja t\u00eb mos e keqp\u00ebrdor\u00eb autorizimin<\/p>\n<p>Analisti p\u00ebr \u00e7\u00ebshtje t\u00eb siguris\u00eb, Naim Maloku, vler\u00ebson se zhvillimet dhe ngjarjet q\u00eb po ndodhin n\u00eb bot\u00eb dhe rreziqet nga krimi i organizuar, terrorizmi, po u japin m\u00eb shum\u00eb r\u00ebnd\u00ebsi agjencive apo sh\u00ebrbimeve inteligjent\u00eb n\u00eb t\u00eb gjith\u00eb bot\u00ebn.<\/p>\n<p>\u201c\u00cbsht\u00eb pak problematike t\u00eb vler\u00ebsohet n\u00ebse ky ligj \u00ebsht\u00eb i mir\u00eb apo i keq. Por nuk mund t\u00eb mohojm\u00eb se Kosova gjendet n\u00eb nj\u00eb kryq\u00ebzim t\u00eb shum\u00eb gj\u00ebrave q\u00eb po ndodhin n\u00eb af\u00ebrsi t\u00eb Kosov\u00ebs dhe brenda saj\u201d, tha Maloku.<\/p>\n<p>Ai p\u00ebrmendi, shkuarjen e shqiptar\u00ebve n\u00eb Siri, trafikimet me qeniet njer\u00ebzore p\u00ebr shkak mosliberalizimit t\u00eb vizave, pastaj vend q\u00eb p\u00ebrdoret p\u00ebr transit t\u00eb drog\u00ebs, prandaj, si\u00e7 thot\u00eb ai, m\u00eb shum\u00eb kompetenca po i jepen AKI-s\u00eb. Duke folur p\u00ebr gjykatat, ai tha se ato p\u00ebrkundrazi nuk jan\u00eb treguar t\u00eb besueshme, duke dal\u00eb n\u00eb opinion shum\u00eb p\u00ebrgjime, ende pa u ngritur aktakuzat, p\u00ebrfshir\u00eb k\u00ebtu edhe emrat e d\u00ebshmitar\u00ebve t\u00eb mbrojtur.<\/p>\n<p>\u201cUn\u00eb e shoh t\u00eb nevojshme aprovimin e ligjit, duke e pasur parasysh q\u00eb gjykatat e prokuror\u00ebt nuk jan\u00eb treguar t\u00eb besuesh\u00ebm n\u00eb Kosov\u00eb. Megjithat\u00eb ligji si i till\u00eb nuk b\u00ebn t\u00eb miratohet pa pasur nj\u00eb debat t\u00eb gjer\u00eb paraprakisht mbi t\u00eb, sepse kemi t\u00eb b\u00ebjm\u00eb me di\u00e7ka shum\u00eb t\u00eb ndjeshme\u201d, tha Maloku.<\/p>\n<p>E n\u00ebse miratohet si i till\u00eb, at\u00ebher\u00eb p\u00ebrqendrimi duhet t\u00eb jet\u00eb te mbik\u00ebqyrja e AKI-s\u00eb, q\u00eb ajo t\u00eb mos e keqp\u00ebrdor k\u00ebt\u00eb autorizim.<\/p>\n<p>Sidoqoft\u00eb, ligji deri n\u00eb qershor t\u00eb k\u00ebtij viti mbetet i pashqyrtuar, kur edhe do t\u00eb kaloj\u00eb n\u00eb Komisionin p\u00ebr Integrime.
