Publiku k\u00ebrkon nj\u00eb qeveri me vendimmarrje t\u00eb ligjshme, sh\u00ebrbim cil\u00ebsor dhe q\u00eb \u00ebsht\u00eb i hapur, i aksesuesh\u00ebm dhe i drejtuar si duhet. E shkuara ka d\u00ebshmuar p\u00ebr nj\u00eb cenim t\u00eb r\u00ebnd\u00eb t\u00eb marr\u00ebdh\u00ebnies s\u00eb besimit nd\u00ebrmjet qeveritar\u00ebve dhe qytetar\u00ebve. P\u00ebr rivendosjen e besimit te sistemi yn\u00eb politik, n\u00ebp\u00ebrmjet rikthimit t\u00eb besimit publik n\u00eb integritetin e qeveris\u00eb, hartohet ky Kod Etik, i cili \u00ebsht\u00eb konceptuar si nj\u00eb mjet p\u00ebr t\u00eb nxitur p\u00ebrmir\u00ebsimin e vazhduesh\u00ebm t\u00eb q\u00ebndrimeve dhe sjelljeve drejt standardeve m\u00eb t\u00eb larta t\u00eb drejtimit dhe ridimensionimin e moralitetit t\u00eb zakonsh\u00ebm n\u00eb sfer\u00ebn e \u00e7\u00ebshtjeve qeveritare.<\/p>\n<p style=\"text-align: center;\"><strong>KREU I<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>DISPOZITA T\u00cb P\u00cbRGJITHSHME<\/strong><\/p>\n<p><strong>Neni 1<\/strong><\/p>\n<p><strong>Q\u00ebllimi<\/strong><\/p>\n<p>Kodi ka p\u00ebr q\u00ebllim t\u00eb p\u00ebrcaktoj\u00eb rregullat e etik\u00ebs, q\u00eb do t\u00eb garantojn\u00eb nj\u00eb sjellje t\u00eb an\u00ebtarit t\u00eb K\u00ebshillit t\u00eb Ministrave n\u00eb ushtrimin e funksionit t\u00eb tij si an\u00ebtar i organit kolegjial apo si organ individual, si dhe n\u00eb cil\u00ebsin\u00eb e tij personale, n\u00eb p\u00ebrputhje me interesin e ligjsh\u00ebm publik dhe me programin e qeveris\u00eb.<\/p>\n<p><strong>Neni 2<\/strong><\/p>\n<p><strong>Fusha e veprimit<\/strong><\/p>\n<p>Rregullat etike t\u00eb k\u00ebtij Kodi jan\u00eb t\u00eb detyrueshme p\u00ebr t\u2019u zbatuar nga t\u00eb gjith\u00eb an\u00ebtar\u00ebt e K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p><strong>Neni 3<\/strong><\/p>\n<p><strong>Parime t\u00eb p\u00ebrgjithshme<\/strong><\/p>\n<p>1. Parimi i ligjshm\u00ebris\u00eb. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave duhet t\u00eb zbatoj\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, marr\u00ebveshjet nd\u00ebrkomb\u00ebtare t\u00eb ratifikuara dhe legjislacionin e brendsh\u00ebm, n\u00eb p\u00ebrputhje me kompetencat q\u00eb ai mbulon dhe, sipas rastit, si pjes\u00eb e vendimmarrjes n\u00eb organin kolegjial apo individual.<\/p>\n<p>2. Parimi i besueshm\u00ebris\u00eb dhe solidar\u00ebsis\u00eb. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave duhet t\u00eb respektoj\u00eb vendimet e marra n\u00eb mbledhjen e K\u00ebshillit t\u00eb Ministrave, t\u00eb ofroj\u00eb mb\u00ebshtetjen e tij n\u00eb publik p\u00ebr t\u00eb gjitha vendimet e qeveris\u00eb, pavar\u00ebsisht n\u00ebse ai ka marr\u00eb pjes\u00eb ose jo n\u00eb mbledhje apo n\u00ebse ka votuar \u201cpro\u201d ose \u201ckund\u00ebr\u201d k\u00ebtij akti.<\/p>\n<p>3. Parimi i mosdiskriminimit. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, gjat\u00eb ushtrimit t\u00eb funksionit, me veprimet ose mosveprimet e tij, nuk duhet t\u00eb favorizoj\u00eb apo t\u00eb diskriminoj\u00eb nj\u00eb subjekt t\u00eb caktuar p\u00ebr shkak t\u00eb gjinis\u00eb, rac\u00ebs, ngjyr\u00ebs, etnis\u00eb, gjuh\u00ebs, identitetit gjinor, orientimit seksual, bindjes politike, fetare ose filozofike, gjendjes ekonomike, arsimore ose shoq\u00ebrore, shtatzanis\u00eb, p\u00ebrkat\u00ebsis\u00eb prind\u00ebrore, p\u00ebrgjegj\u00ebsis\u00eb prind\u00ebrore, mosh\u00ebs, gjendjes familjare ose martesore, gjendjes civile, vendbanimit, gjendjes sh\u00ebndet\u00ebsore, predispozicioneve gjenetike, aft\u00ebsis\u00eb s\u00eb kufizuar, p\u00ebrkat\u00ebsis\u00eb n\u00eb nj\u00eb grup t\u00eb ve\u00e7ant\u00eb ose p\u00ebr ndonj\u00eb shkak tjet\u00ebr t\u00eb ngjash\u00ebm.<\/p>\n<p>4. Mosabuzimi me funksionin. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave e ushtron funksionin dhe kompetencat e tij vet\u00ebm p\u00ebr q\u00ebllimin q\u00eb ato i jan\u00eb dh\u00ebn\u00eb nga legjislacioni n\u00eb fuqi. Ai duhet t\u00eb shmang\u00eb p\u00ebrdorimin e funksionit t\u00eb tij p\u00ebr q\u00ebllime, t\u00eb cilat nuk kan\u00eb baz\u00eb ligjore apo nuk jan\u00eb t\u00eb motivuara nga ndonj\u00eb interes publik.<\/p>\n<p>5. Paanshm\u00ebria, ndershm\u00ebria dhe pavar\u00ebsia. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave n\u00eb ushtrimin e funksionit t\u00eb tij duhet t\u00eb jet\u00eb i paansh\u00ebm, i drejt\u00eb, i arsyesh\u00ebm dhe i pavarur. Ai duhet t\u00eb shmang\u00eb \u00e7do veprim, mosveprim arbitrar apo \u00e7do trajtim preferencial, si dhe t\u00eb jet\u00eb i pandikuar nga \u00e7do interes tjet\u00ebr, personal, politik, familjar dhe shoq\u00ebror.<\/p>\n<p>6. Objektiviteti. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, gjat\u00eb ushtrimit t\u00eb funksionit t\u00eb tij, duhet t\u00eb marr\u00eb n\u00eb konsiderat\u00eb faktor\u00ebt p\u00ebrkat\u00ebs dhe t\u2019i jap\u00eb secilit prej tyre pesh\u00ebn e duhur n\u00eb q\u00ebndrimin p\u00ebrfundimtar, duke p\u00ebrjashtuar \u00e7do element q\u00eb nuk i p\u00ebrgjigjet procesit konkret t\u00eb pun\u00ebs.<\/p>\n<p>7. Transparenca dhe llogaridh\u00ebnia. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, n\u00ebse e k\u00ebrkon interesi publik dhe kur kjo nuk \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me ligjin, informon dhe p\u00ebrgjigjet kur \u00ebsht\u00eb rasti p\u00ebr t\u00eb gjith\u00eb veprimtarin\u00eb e tij si funksionar publik.<\/p>\n<p>8. Konflikti i interesit. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave duhet t\u00eb parandaloj\u00eb, si dhe t\u00eb marr\u00eb t\u00eb gjitha masat p\u00ebr nd\u00ebrprerjen e gjendjes s\u00eb konfliktit nd\u00ebrmjet detyr\u00ebs publike dhe interesave t\u00eb tij privat\u00eb.<\/p>\n<p style=\"text-align: center;\">KREU II<\/p>\n<p style=\"text-align: center;\">MBLEDHJET E K\u00cbSHILLIT T\u00cb MINISTRAVE<\/p>\n<p><strong>Neni 4<\/strong><\/p>\n<p><strong>Garantimi i paanshm\u00ebris\u00eb<\/strong><\/p>\n<p>1. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave nuk mund t\u00eb marr\u00eb pjes\u00eb n\u00eb shqyrtimin dhe vendimmarrjen nj\u00eb \u00e7\u00ebshtjeje n\u00ebse ka interes personal ndaj saj ose, n\u00eb \u00e7do rast tjet\u00ebr, kur v\u00ebrtetohen arsye serioze nj\u00ebanshm\u00ebrie.<\/p>\n<p>2. N\u00ebse p\u00ebr an\u00ebtarin e K\u00ebshillit t\u00eb Ministrave konstatohet nj\u00ebri nga rastet e parashikuara n\u00eb pik\u00ebn 1, t\u00eb k\u00ebtij neni, duhet t\u00eb ndiqet procedura e p\u00ebrcaktuar n\u00eb nenin 18, t\u00eb ligjit nr.9000, dat\u00eb 30.1.2003, \u201cP\u00ebr organizimin dhe funksionimin e K\u00ebshillit t\u00eb Ministrave\u201d, dhe n\u00eb ligjin nr.9367, dat\u00eb 7.4.2005, \u201cP\u00ebr parandalimin e konfliktit t\u00eb interesave n\u00eb ushtrimin e funksioneve publike\u201d, t\u00eb ndryshuar.<\/p>\n<p><strong>Neni 5<\/strong><\/p>\n<p><strong>Shfaqja e mendimit, konfidencialiteti dhe solidariteti<\/strong><\/p>\n<p>1. P\u00ebr \u00e7\u00ebshtje t\u00eb r\u00ebnd\u00ebsishme, ku gjen zbatim parimi i besueshm\u00ebris\u00eb dhe solidar\u00ebsis\u00eb, \u00e7do an\u00ebtar i K\u00ebshillit t\u00eb Ministrave ka t\u00eb drejt\u00eb t\u00eb shpreh\u00eb lirisht mendimin dhe pik\u00ebpamjet e veta dhe t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn e vot\u00ebs p\u00ebr projektaktet, objekt shqyrtimi.<\/p>\n<p>2. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, pas marrjes s\u00eb vendimit duhet t\u00eb shmang\u00eb n\u00eb publik \u00e7do shprehje mospajtimi dhe t\u00eb mbroj\u00eb ose t\u00eb p\u00ebrkrah\u00eb vendimet e arritura, si dhe duhet t\u00eb ruaj\u00eb konfidencialitetin e mendimeve, vler\u00ebsimeve t\u00eb debateve e t\u00eb raportimeve, t\u00eb shprehura n\u00eb K\u00ebshillin e Ministrave dhe komitetet nd\u00ebrministrore, si dhe n\u00ebp\u00ebrmjet korrespondenc\u00ebs.<\/p>\n<p><strong>Neni 6<\/strong><\/p>\n<p><strong>Shqyrtimi kolegjial i \u00e7\u00ebshtjeve<\/strong><\/p>\n<p>\u00c7\u00ebshtjet, q\u00eb jan\u00eb n\u00eb kompetenc\u00eb dhe n\u00ebn p\u00ebrgjegj\u00ebsin\u00eb e nj\u00eb ministrie t\u00eb vetme dhe t\u00eb cilat normalisht nuk sillen p\u00ebr shqyrtim n\u00eb K\u00ebshillin e Ministrave ose n\u00eb ndonj\u00eb komitet nd\u00ebrministror, p\u00ebrjashtimisht mund t\u00eb paraqiten kur ministri d\u00ebshiron t\u00eb informoj\u00eb koleg\u00ebt e tij ose t\u00eb k\u00ebshillohet me ta. Kjo gj\u00eb lihet n\u00eb diskrecionin e ministrit p\u00ebrkat\u00ebs.<\/p>\n<p>Kur nd\u00ebrmjet ministrive ka mosmarr\u00ebveshje, k\u00ebto i referohen Kryeministrit vet\u00ebm pasi t\u00eb jen\u00eb shteruar mjetet e tjera t\u00eb zgjidhjes.<\/p>\n<p><strong>Neni 7<\/strong><\/p>\n<p><strong>Pjes\u00ebmarrja n\u00eb mbledhjet e K\u00ebshillit t\u00eb Ministrave<\/strong><\/p>\n<p>1. N\u00eb mbledhjen e K\u00ebshillit t\u00eb Ministrave marrin pjes\u00eb an\u00ebtar\u00ebt e K\u00ebshillit t\u00eb Ministrave si dhe persona t\u00eb tjer\u00eb sipas p\u00ebrcaktimeve t\u00eb pikave 4 e 5, t\u00eb nenit 13, t\u00eb ligjit nr.9000, dat\u00eb 30.1.2003, \u201cP\u00ebr organizimin dhe funksionimin e K\u00ebshillit t\u00eb Ministrave\u201d.<\/p>\n<p>2. Ministrat, t\u00eb cil\u00ebt p\u00ebr shkaqe t\u00eb arsyeshme, nuk mund t\u00eb marrin pjes\u00eb n\u00eb mbledhjet e K\u00ebshillit t\u00eb Ministrave, duhet t\u00eb njoftojn\u00eb paraprakisht Kryeministrin.<\/p>\n<p><strong>Neni 8<\/strong><\/p>\n<p><strong>Deklaratat publike dhe dokumentet politike<\/strong><\/p>\n<p>An\u00ebtari i K\u00ebshillit t\u00eb Ministrave nuk mund t\u00eb b\u00ebj\u00eb publike mendimet n\u00eb lidhje me \u00e7\u00ebshtje, t\u00eb cilat paraprakisht jan\u00eb ose mund t\u00eb jen\u00eb objekt i shqyrtimit n\u00eb mbledhjen e K\u00ebshillit t\u00eb Ministrave, n\u00eb mbledhjen e nj\u00eb komiteti nd\u00ebrministror ose nga ndonj\u00eb organ tjet\u00ebr n\u00eb var\u00ebsi t\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p style=\"text-align: center;\"><strong>KREU III<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>RREGULLAT GJAT\u00cb USHTRIMIT T\u00cb FUNKSIONIT ZYRTAR<\/strong><\/p>\n<p><strong>Neni 9<\/strong><\/p>\n<p><strong>Garantimi i zbatimit t\u00eb parimeve t\u00eb funksionimit t\u00eb sh\u00ebrbimit civil<\/strong><\/p>\n<p>Ministri garanton, n\u00ebp\u00ebrmjet subjekteve t\u00eb ngarkuara nga ligji, funksionimin e sh\u00ebrbimit civil t\u00eb ministris\u00eb q\u00eb drejton dhe t\u00eb institucioneve n\u00eb var\u00ebsi, n\u00eb p\u00ebrputhje me parimin e profesionalizmit, meritokracis\u00eb, t\u00eb pavar\u00ebsis\u00eb dhe integritetit, t\u00eb paan\u00ebsis\u00eb politike, t\u00eb transparenc\u00ebs, t\u00eb sh\u00ebrbimit ndaj publikut, t\u00eb vazhdim\u00ebsis\u00eb s\u00eb karrier\u00ebs, t\u00eb p\u00ebrgjegj\u00ebsis\u00eb dhe korrekt\u00ebsis\u00eb n\u00eb zbatimin e legjislacionit n\u00eb fuqi.<\/p>\n<p><strong>Neni 10<\/strong><\/p>\n<p><strong>Zbatimi i legjislacionit p\u00ebr sh\u00ebrbimin civil<\/strong><\/p>\n<p>1. Ministri, p\u00ebr ministrin\u00eb dhe institucionet q\u00eb ka n\u00eb var\u00ebsi, garanton me p\u00ebrgjegjshm\u00ebri t\u00eb lart\u00eb, n\u00ebp\u00ebrmjet subjekteve t\u00eb ngarkuara nga ligji, respektimin dhe zbatimin e legjislacionit n\u00eb fuqi n\u00eb lidhje me parimet, kushtet dhe procedurat e pranimit n\u00eb sh\u00ebrbimin civil.<\/p>\n<p>2. Ministri duhet t\u00eb nxit\u00eb ngritjen profesionale dhe sjelljen jopartiake t\u00eb an\u00ebtar\u00ebve t\u00eb sh\u00ebrbimit civil n\u00eb ministrin\u00eb q\u00eb ai drejton dhe n\u00eb institucionet e var\u00ebsis\u00eb.<\/p>\n<p>3. Ministri duhet t\u00eb siguroj\u00eb q\u00eb, n\u00eb \u00e7do rast, n\u00eb ministrin\u00eb q\u00eb drejton dhe n\u00eb institucionet n\u00eb var\u00ebsi, em\u00ebrimi n\u00eb sh\u00ebrbimin civil, ngritja n\u00eb detyr\u00eb, transferimi, pezullimi, marrja e masave disiplinore apo lirimi i n\u00ebpun\u00ebsit prej sh\u00ebrbimit civil t\u00eb mos ndikohen, favorizohen apo diskriminohen p\u00ebr shkak t\u00eb bindjeve politike apo p\u00ebrkat\u00ebsis\u00eb partiake t\u00eb n\u00ebpun\u00ebsit civil.<\/p>\n<p><strong>Neni 11<\/strong><\/p>\n<p><strong>Sjellja e ministrit ndaj personelit q\u00eb drejton<\/strong><\/p>\n<p>Ministri, n\u00eb marr\u00ebdh\u00ebnie me personelin q\u00eb drejton, duhet q\u00eb:<\/p>\n<p>a. t\u00eb jet\u00eb shembull i mir\u00ebsjelljes si dhe t\u2019u p\u00ebrmbahet me rregullshm\u00ebri, p\u00ebrve\u00e7 legjislacionit, edhe k\u00ebtij kodi, dhe kodeve\/rregulloreve t\u00eb etik\u00ebs, veshjes dhe sjelljes, q\u00eb do t\u00eb miratohen n\u00eb \u00e7do ministri;<\/p>\n<p>b. t\u00eb respektoj\u00eb personalitetin, mendimet, si dhe t\u00eb nxit\u00eb bashk\u00ebpunimin e personelit e, nj\u00ebkoh\u00ebsisht, t\u00eb ruaj\u00eb edhe t\u00eb drejt\u00ebn e vendimmarrjes;<\/p>\n<p>c. t\u00eb vler\u00ebsoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb, objektive dhe efikase, sjelljen e secilit prej an\u00ebtar\u00ebve t\u00eb personelit;<\/p>\n<p>\u00e7. t\u00eb mbroj\u00eb t\u00eb drejtat e personelit dhe n\u00eb asnj\u00eb m\u00ebnyr\u00eb t\u00eb mos i kufizoj\u00eb ato;<\/p>\n<p>d. t\u2019i ofroj\u00eb personelit mund\u00ebsi t\u00eb barabarta t\u00eb ngritjes profesionale dhe motivim p\u00ebr ngritjen e efektivitetit n\u00eb pun\u00eb.<\/p>\n<p><strong>Neni 12<\/strong><\/p>\n<p><strong>Veprimet e ndaluara<\/strong><\/p>\n<p>An\u00ebtarit t\u00eb K\u00ebshillit t\u00eb Ministrave, n\u00eb ushtrimin e veprimtaris\u00eb s\u00eb tij, i ndalohet:<\/p>\n<p>a. t\u00eb k\u00ebrkoj\u00eb apo t\u00eb pranoj\u00eb shp\u00ebrblim apo premtim shp\u00ebrblimi lidhur me vendime t\u00eb marra gjat\u00eb ushtrimit t\u00eb funksionit;<\/p>\n<p>b. t\u00eb fitoj\u00eb ndonj\u00eb t\u00eb drejt\u00eb apo t\u00eb pranoj\u00eb premtim p\u00ebr fitimin e saj, n\u00eb rastet kur shkelet parimi i mosdiskriminimit;<\/p>\n<p>c. t\u00eb keqp\u00ebrdor\u00eb autorizimet\/delegimet t\u00eb cilat rrjedhin nga ushtrimi i funksionit t\u00eb tij publik;<\/p>\n<p>\u00e7. t\u00eb k\u00ebrkoj\u00eb, t\u00eb p\u00ebrvet\u00ebsoj\u00eb, t\u00eb pranoj\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb ose jo, dhurata, sende me vler\u00eb apo sh\u00ebrbime, n\u00eb kompensim t\u00eb vot\u00ebs s\u00eb tij n\u00eb vendimmarrjen kolegjiale apo n\u00eb vendimmarrjen e tij individuale;<\/p>\n<p>d. t\u00eb ndikoj\u00eb n\u00eb vendimin e ndonj\u00eb zyrtari apo organi p\u00ebr arsye t\u00eb p\u00ebrfitimit material personal, t\u00eb familjar\u00ebve t\u00eb tij apo fjalimet<\/strong><\/p>\n<p>1. N\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb garantohet bashk\u00ebrendimi i efektsh\u00ebm i pun\u00ebs s\u00eb kabinetit qeveritar, p\u00ebr p\u00ebrmbajtje dhe koh\u00ebn e t\u00eb gjitha prononcimeve madhore, fjalimeve, deklaratave p\u00ebr shtyp dhe nismave t\u00eb reja duhet, p\u00ebr sa \u00ebsht\u00eb e mundur, t\u00eb merret p\u00eblqimi i Zyr\u00ebs s\u00eb Komunikimit, pran\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p>2. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, i zgjedhur si p\u00ebrfaq\u00ebsues i partis\u00eb politike, e ruan t\u00eb drejt\u00ebn e ushtrimit t\u00eb funksionit n\u00eb parti, n\u00ebse me ligj t\u00eb ve\u00e7ant\u00eb nuk parashikohet ndryshe.<\/p>\n<p>2. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, gjat\u00eb koh\u00ebs s\u00eb ushtrimit t\u00eb funksionit publik, mund:<\/p>\n<p>a) t\u00eb kryej\u00eb pa shp\u00ebrblim veprimtari n\u00eb fush\u00ebn e shkenc\u00ebs, sportit, arsimit, kultur\u00ebs dhe n\u00eb ato t\u00eb natyr\u00ebs humanitare;<\/p>\n<p>b) t\u00eb realizoj\u00eb fitime, n\u00eb baz\u00eb t\u00eb t\u00eb drejtave t\u00eb autorit, patentave dhe t\u00eb drejtave t\u00eb ngjashme.<\/p>\n<p><strong>Neni 28<\/strong><\/p>\n<p><strong>Dekoratat e huaja<\/strong><\/p>\n<p>Pranimi i dekoratave nga nj\u00eb shtet tjet\u00ebr mund t\u00eb b\u00ebhet vet\u00ebm pasi t\u00eb jet\u00eb marr\u00eb m\u00eb par\u00eb miratimi nga Kryeministri, si dhe t\u00eb jet\u00eb njoftuar paraprakisht Ministria e Pun\u00ebve t\u00eb Jashtme.<\/p>\n<p><strong>Neni 29<\/strong><\/p>\n<p><strong>Dhuratat, favoret, premtimet dhe trajtimet preferenciale<\/strong><\/p>\n<p>1. \u00cbsht\u00eb e ndaluar q\u00eb nj\u00eb an\u00ebtar i K\u00ebshillit t\u00eb Ministrave t\u00eb k\u00ebrkoj\u00eb ose t\u00eb marr\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb a t\u00eb t\u00ebrthort\u00eb, dhurata, favore, premtime ose trajtime preferenciale, t\u00eb cilat i jepen, p\u00ebr shkak t\u00eb pozicionit t\u00eb tij, nga nj\u00eb person, fizik ose juridik, privat.<\/p>\n<p>2. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, q\u00eb ka dyshime n\u00ebse \u00ebsht\u00eb n\u00eb kushtet e ndalimit t\u00eb p\u00ebrcaktuar n\u00eb pik\u00ebn 1, t\u00eb k\u00ebtij neni, duhet t\u00eb k\u00ebrkoj\u00eb k\u00ebshill\u00ebn e Komisionit t\u00eb Etik\u00ebs dhe\/ose ILDKPKI-s\u00eb.<\/p>\n<p>3. Dhuratat, q\u00eb i jepen an\u00ebtarit t\u00eb K\u00ebshillit t\u00eb Ministrave, n\u00eb ushtrim t\u00eb funksionit t\u00eb tij ministror, kalojn\u00eb n\u00eb pron\u00ebsi t\u00eb shtetit. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave duhet:<\/p>\n<p>a) t\u00eb mbaj\u00eb p\u00ebrgjegj\u00ebsi personale n\u00eb miratimin e madh\u00ebsis\u00eb dhe t\u00eb p\u00ebrb\u00ebrjes s\u00eb delegacioneve ministrore, p\u00ebr t\u00eb cilat ministria e tij \u00ebsht\u00eb p\u00ebrgjegj\u00ebse, duke i mbajtur delegacionet n\u00eb num\u00ebr sa m\u00eb t\u00eb vog\u00ebl q\u00eb t\u00eb jet\u00eb e mundur.<\/p>\n<p>b) t\u00eb informoj\u00eb p\u00ebr shpenzimet p\u00ebr udh\u00ebtimet jasht\u00eb shtetit, jo m\u00eb von\u00eb se 30 dit\u00eb nga data e paraqitjes s\u00eb k\u00ebrkes\u00ebs nga subjekti i interesuar.<\/p>\n<p>2. Kur an\u00ebtari i K\u00ebshillit t\u00eb Ministrave udh\u00ebton p\u00ebr pun\u00eb zyrtare, shpenzimet e udh\u00ebtimit duhet t\u00eb p\u00ebrballohen nga fondet e p\u00ebrcaktuara n\u00eb buxhetin e ministris\u00eb. Si rregull, ofertat p\u00ebr udh\u00ebtim falas nuk duhet t\u00eb pranohen. P\u00ebrjashtim b\u00ebn oferta p\u00ebr transport e nj\u00eb qeverie t\u00eb huaj, me kusht q\u00eb t\u00eb mos krijohet asnj\u00eb detyrim i panevojsh\u00ebm.<\/p>\n<p><strong>Neni 32<\/strong><\/p>\n<p><strong>Fluturimet e paplanifikuara<\/strong><\/p>\n<p>Vet\u00ebm an\u00ebtari i K\u00ebshillit t\u00eb Ministrave ka t\u00eb drejt\u00eb t\u00eb autorizoj\u00eb fluturime t\u00eb ve\u00e7anta, qoft\u00eb p\u00ebr vete apo zyrtar\u00ebt e tjer\u00eb brenda institucioneve q\u00eb ata drejtojn\u00eb. Fluturimet e paplanifikuara mund t\u00eb autorizohen kur nj\u00eb sh\u00ebrbim i planifikuar nuk \u00ebsht\u00eb i disponuesh\u00ebm ose kur \u00ebsht\u00eb e domosdoshme q\u00eb t\u00eb udh\u00ebtohet n\u00eb rrug\u00eb ajrore, por q\u00eb k\u00ebrkesat e veprimtaris\u00eb zyrtare ose parlamentare, apo masat e siguris\u00eb nuk lejojn\u00eb q\u00eb udh\u00ebtimi t\u00eb kryhet nga nj\u00eb sh\u00ebrbim i planifikuar.<\/p>\n<p><strong>Neni 33<\/strong><\/p>\n<p><strong>Ministrat e thirrur nga jasht\u00eb<\/strong><\/p>\n<p>N\u00ebse nj\u00eb an\u00ebtar i K\u00ebshillit t\u00eb Ministrave ndodhet jasht\u00eb vendit p\u00ebr q\u00ebllime zyrtare, me leje apo p\u00ebr arsye personale, thirret p\u00ebr t\u2019u kthyer p\u00ebr \u00e7\u00ebshtje ministrore apo parlamentare, p\u00ebrfshir\u00eb procedur\u00ebn e votimit, shpenzimet e udh\u00ebtimit shtes\u00eb drejt dhe nga destinacioni mund t\u00eb paguhen nga fondet publike.<\/p>\n<p><strong>Neni 34<\/strong><\/p>\n<p><strong>Vizitat brenda territorit shqiptar<\/strong><\/p>\n<p>An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, q\u00eb ka programuar t\u00eb b\u00ebj\u00eb nj\u00eb vizit\u00eb brenda territorit shqiptar, duhet t\u00eb informoj\u00eb paraprakisht deputet\u00ebt dhe kryetar\u00ebt e bashkive\/komunave, zonat elektorale, territori i t\u00eb cilave do t\u00eb p\u00ebrfshihet n\u00eb itinerar.<\/p>\n<p><strong>Neni 35<\/strong><\/p>\n<p><strong>P\u00ebrdorimi i makinave zyrtare<\/strong><\/p>\n<p>1. Ndalohet p\u00ebrdorimi i automjeteve zyrtare p\u00ebr q\u00ebllime private, p\u00ebrve\u00e7 rastit kur kjo lidhet me sigurin\u00eb personale dhe t\u00eb familjes s\u00eb an\u00ebtarit t\u00eb K\u00ebshillit t\u00eb Ministrave. N\u00eb k\u00ebt\u00eb rast, kostot e p\u00ebrdorimit t\u00eb automjetit paguhen nga an\u00ebtari i K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p>2. Kur \u00ebsht\u00eb e mundur, ministrat nxiten q\u00eb t\u00eb p\u00ebrdorin transportin publik.<\/p>\n<p><strong>Neni 36<\/strong><\/p>\n<p><strong>Shpenzimet e udh\u00ebtimit p\u00ebr bashk\u00ebshort\u00ebt\/bashk\u00ebjetuesit<\/strong><\/p>\n<p>Shpenzimet p\u00ebr bashk\u00ebshortin\/bashk\u00ebjetuesin e nj\u00eb an\u00ebtari t\u00eb K\u00ebshillit t\u00eb Ministrave, kur ata shoq\u00ebrojn\u00eb ministrin p\u00ebr detyrat zyrtare t\u00eb k\u00ebtij t\u00eb fundit, mund t\u00eb mbulohen nga fondet publike, me kusht q\u00eb t\u00eb jet\u00eb e qart\u00eb se shoq\u00ebrimi i ministrit nga ai\/ajo \u00ebsht\u00eb n\u00eb interesin publik. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave, t\u00eb cilit i p\u00ebrfundon mandati, p\u00ebrfshir\u00eb edhe ai i deputetit, nuk ka t\u00eb drejt\u00eb p\u00ebr 1 (nj\u00eb) vit t\u00eb em\u00ebrohet n\u00eb pozita drejtuese apo t\u00eb p\u00ebrfshihet n\u00eb kontrollin e shoq\u00ebrive tregtare, publike apo private, n\u00ebse gjat\u00eb periudh\u00ebs 2 (dy) \u2013 vje\u00e7are para p\u00ebrfundimit t\u00eb ushtrimit t\u00eb funksionit publik, ka qen\u00eb drejtp\u00ebrdrejt i implikuar me veprimtarin\u00eb tregtare t\u00eb k\u00ebtyre shoq\u00ebrive.<\/p>\n<p>2. N\u00eb \u00e7do rast, an\u00ebtari i K\u00ebshillit t\u00eb Ministrave ka t\u00eb drejt\u00eb t\u00eb k\u00ebrkoj\u00eb nga Komisioni i Etik\u00ebs nj\u00eb opinion k\u00ebshillimor lidhur me sjellje apo veprime t\u00eb caktuara gjat\u00eb kryerjes s\u00eb detyr\u00ebs apo jasht\u00eb saj, n\u00ebse ato konsiderohen ose jo n\u00eb p\u00ebrputhje me normat e Kodit Etik Ministror.<\/p>\n<p>3. Komisioni i Etik\u00ebs ka t\u00eb drejt\u00eb t\u2019i propozoj\u00eb K\u00ebshillit t\u00eb Ministrave ndryshime n\u00eb Kodin e Etik\u00ebs.<\/p>\n<p><strong>Neni 39<\/strong><\/p>\n<p><strong>Interpretimi<\/strong><\/p>\n<p>Interpretimi i Kodit Etik Ministror, i b\u00ebr\u00eb nga Komisioni i Etik\u00ebs, me k\u00ebrkes\u00ebn e nj\u00eb prej subjekteve t\u00eb fush\u00ebveprimit t\u00eb k\u00ebtij Kodi, lidhur me faktin n\u00ebse norma p\u00ebrkat\u00ebse e lejon nj\u00eb sjellje apo q\u00ebndrim t\u00eb caktuar, mund t\u00eb p\u00ebrdoret si mjet mbrojtjeje nga ana e tij n\u00eb rast procedimi disiplinor, por ky interpretim nuk ka karakter detyrues p\u00ebr zgjidhjen\/vler\u00ebsimin e rasteve t\u00eb tjera t\u00eb ngjashme.<\/p>\n<p><strong>Neni 40<\/strong><\/p>\n<p><strong>Masat disiplinore<\/strong><\/p>\n<p>1. An\u00ebtari i K\u00ebshillit t\u00eb Ministrave q\u00ebndron n\u00eb detyr\u00eb p\u00ebr aq koh\u00eb sa g\u00ebzon besimin e Kryeministrit. Ky i fundit vler\u00ebson standardet e sjelljes q\u00eb pritet t\u00eb mbahen nga ana e ministrit dhe vendos p\u00ebr masat, q\u00eb do t\u00eb nd\u00ebrmerren n\u00eb rast t\u00eb thyerjes s\u00eb k\u00ebtyre standardeve.<\/p>\n<p>2. Komisioni i Etik\u00ebs, pasi del n\u00eb p\u00ebrfundimin se kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb thyerje t\u00eb Kodit Etik Ministror, ia b\u00ebn at\u00eb me dije Kryeministrit n\u00ebp\u00ebrmjet nj\u00eb akti me shkrim.
