S\u00eb pari l\u00ebvizjen nga status-quoja e deritanishme e marr\u00ebdh\u00ebnieve t\u00eb ngrira n\u00eb Veri t\u00eb vendit q\u00eb pak a shum\u00eb mbahen vet\u00ebm n\u00eb saje t\u00eb pranis\u00eb s\u00eb forcave t\u00eb NATO-s n\u00eb Kosov\u00eb. S\u00eb dyti, ingranimin e procesit t\u00eb integrimit evropian si kute racionale mat\u00ebse t\u00eb zhvillimeve si n\u00eb Serbi ashtu edhe n\u00eb Kosov\u00eb. Pra, me negociatat p\u00ebr integrim do shpresuar se Serbia do t\u00eb sillet gjithnj\u00eb m\u00eb pak si ajo e t\u00eb s\u00eb kaluar\u00ebs dhe gjithnj\u00eb e m\u00eb shum\u00eb si nj\u00eb vend me vlera evropiane. Dhe me negociata p\u00ebr MSA-n\u00eb, gjendja n\u00eb Kosov\u00eb do t\u00eb vler\u00ebsohet m\u00eb shum\u00eb me kriteret racionale t\u00eb nd\u00ebrtimit t\u00eb institucioneve evropiane, e gjithnj\u00eb e m\u00eb pak me kriteret e misioneve paqeruajt\u00ebse.<\/p>\n<p>P\u00ebr BE-n\u00eb, ngritja e marr\u00ebdh\u00ebnieve n\u00eb k\u00ebt\u00eb rrafsh e v\u00eb n\u00eb pozit\u00ebn e vet m\u00eb t\u00eb fort\u00eb t\u00eb natyrshme. BE-ja nuk di t\u00eb menaxhoj\u00eb shtete (si\u00e7 ka treguar me boll\u00ebk n\u00eb Kosov\u00eb), por di q\u00eb t\u00eb nxis\u00eb transformimet e brendshme t\u00eb shteteve q\u00eb duan t\u00eb integrohen n\u00eb t\u00eb.<\/p>\n<p>Por, n\u00ebse ky \u00ebsht\u00eb fundi at\u00ebher\u00eb \u201cprocesi i normalizimit\u201d po e hap nj\u00eb periudh\u00eb t\u00eb paqart\u00eb p\u00ebr Kosov\u00ebn.<\/p>\n<p>N\u00eb radh\u00eb t\u00eb par\u00eb sepse \u201cprocesi i normalizimit\u201d nuk kuror\u00ebzohet me nj\u00eb akt (traktat, marr\u00ebveshje nd\u00ebrkomb\u00ebtare) n\u00eb t\u00eb cilin ndodh vendosja e marr\u00ebdh\u00ebnieve kontraktuale mes dy pal\u00ebve, Kosov\u00ebs dhe Serbis\u00eb (apo e triave, n\u00ebse p\u00ebrfshihet BE-ja). Procesi i \u201cnormalizimit\u201d, i k\u00ebtill\u00eb \u00e7far\u00eb duket n\u00eb k\u00ebt\u00eb perspektiv\u00eb t\u00eb sotme, n\u00eb vend t\u00eb nj\u00eb akti p\u00ebrfundon me hapjen e nj\u00eb procesi tjet\u00ebr, po ashtu t\u00eb \u201cnormalizimit\u201d. E kjo mund t\u00eb thot\u00eb se Kosova mund t\u00eb konsumohet edhe disa vjet rresht n\u00eb nj\u00eb \u201cproces t\u00eb normalizimit\u201d i cili, sikur edhe deri tani, pa parime udh\u00ebheq\u00ebse, do t\u00eb trajtoj\u00eb her\u00eb nj\u00eb tem\u00eb e her\u00eb nj\u00eb tjet\u00ebr.<\/p>\n<p><strong>3<\/strong>.<\/p>\n<p>N\u00ebse kjo do t\u00eb jet\u00eb rrjedha e ngjarjeve, pra n\u00eb vend t\u00eb aktit t\u00eb normalizimit do t\u00eb kemi nj\u00eb proces t\u00eb ri t\u00eb normalizimit, do shikuar, p\u00ebrtej deklaratave politike, me kutet mat\u00ebse racionale, se n\u00eb \u00e7far\u00eb gjendjeje do ta gjej\u00eb Kosov\u00ebn fundi i k\u00ebsaj faze t\u00eb procesit t\u00eb normalizimit.<\/p>\n<p>S\u00eb pari ta shikojm\u00eb legjitimitetin nd\u00ebrkomb\u00ebtar t\u00eb Kosov\u00ebs. Vendi do t\u00eb ket\u00eb po at\u00eb status legjitimiteti n\u00eb organizata nd\u00ebrkomb\u00ebtare \u00e7far\u00eb e pati edhe para bisedimeve. Aty ku \u00ebsht\u00eb e mundur q\u00eb t\u00eb an\u00ebtar\u00ebsohet me shumic\u00eb t\u00eb thjesht\u00eb votash, do t\u00eb b\u00ebhet. Aty ku k\u00ebrkohet konsensusi, apo p\u00eblqimi i Serbis\u00eb, Kosova mbetet jasht\u00eb.<\/p>\n<p>Pra, duhet t\u00eb zhvillohen negociatat, pas k\u00ebtyre negociatave, p\u00ebr t\u00eb arritur legjitimitetin e plot\u00eb nd\u00ebrkomb\u00ebtar, p\u00ebrfshir\u00eb ul\u00ebsen n\u00eb OKB.<\/p>\n<p>S\u00eb dyti, ta shohim dimensionin evropian. N\u00eb fund t\u00eb k\u00ebsaj faze t\u00eb procesit, legjitimiteti i Kosov\u00ebs karshi BE-s\u00eb do t\u00eb jet\u00eb krejt\u00ebsisht i nj\u00ebjt\u00eb sikur para fillimit t\u00eb procesit. P\u00ebr m\u00eb tep\u00ebr, Kosova, me negociator\u00ebt e saj, ka ndihmuar q\u00eb dyshimet e pes\u00ebshes s\u00eb BE-s\u00eb q\u00eb nuk e njohin pavar\u00ebsin\u00eb e Kosov\u00ebs t\u00eb p\u00ebrligjen n\u00eb form\u00eb t\u00eb fusnot\u00ebs q\u00eb p\u00ebrshkruan Kosov\u00ebn si vend q\u00eb p\u00ebr dik\u00eb \u00ebsht\u00eb i pavarur e p\u00ebr dik\u00eb i administruar nga OKB-ja me Rezolut\u00ebn e saj 1244.<\/p>\n<p>Pra, pas p\u00ebrfundimit t\u00eb k\u00ebsaj faze t\u00eb \u201cnormalizimit\u201d do vazhduar negociatat n\u00eb m\u00ebnyr\u00eb q\u00eb pes\u00eb vendet q\u00eb nuk e kan\u00eb njohur Kosov\u00ebn, pra edhe rrjedhimisht BE-ja, t\u00eb njohin legjitimitetin dhe legalitetin e Republik\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n<p>N\u00eb deklaratat e diplomat\u00ebve dhe t\u00eb burokrat\u00ebve t\u00eb BE-s\u00eb do t\u00eb thuhet se Kosova ka ndryshuar substancialisht n\u00eb marr\u00ebdh\u00ebniet e veta me BE-n\u00eb, me fillim incizimin e gjendjes p\u00ebr liberalizim vizash dhe ofert\u00ebn e mundshme p\u00ebr fillim t\u00eb negociatave p\u00ebr MSA-n\u00eb. Q\u00eb t\u00eb dyja k\u00ebto, n\u00eb fakt, jan\u00eb shum\u00eb t\u00eb r\u00ebnd\u00ebsishme, por nuk e ndryshojn\u00eb substancialisht marr\u00ebdh\u00ebnien e Kosov\u00ebs me BE-n\u00eb. Ndryshimi mund t\u00eb quhet substancial vet\u00ebm kur t\u00eb ket\u00eb mbaruar procesi i negociimit dhe Kosova (me merita t\u00eb vetat, natyrisht) t\u00eb jet\u00eb n\u00eb gjendje t\u00eb n\u00ebnshkruaj\u00eb MSA-n\u00eb, e t\u00eb 28 vendet e BE-s\u00eb t\u00eb jen\u00eb n\u00eb gjendje q\u00eb k\u00ebt\u00eb n\u00ebnshkrim ta ratifikojn\u00eb.<\/p>\n<p>Fundi i k\u00ebsaj faze t\u00eb \u201cnormalizimit\u201d e gjen Kosov\u00ebn (me fusnot\u00eb) af\u00ebrsisht aty ku ishin t\u00eb gjitha vendet e Ballkanit Per\u00ebndimor pas Samitit t\u00eb Selanikut q\u00eb ndodhi m\u00eb 2003, fiks para dhjet\u00eb vjet\u00ebsh.<\/p>\n<p><strong>4<\/strong>.<\/p>\n<p>Por, p\u00ebrtej gjendjes s\u00eb legjitimitetit t\u00eb pandryshuar nd\u00ebrkomb\u00ebtar, t\u00eb nj\u00eb r\u00ebnd\u00ebsie jetike do t\u00eb jet\u00eb kuti mat\u00ebs i funksionalitetit t\u00eb brendsh\u00ebm.<\/p>\n<p>Pyetja \u00ebsht\u00eb, pra, sa do t\u00eb jet\u00eb Kosova shtet m\u00eb funksional n\u00eb fund t\u00eb k\u00ebtij procesi se para tij?<\/p>\n<p>P\u00ebr t\u00eb dh\u00ebn\u00eb p\u00ebrgjigje nevojitet nj\u00eb skic\u00eb me vija t\u00eb trasha. Deri m\u00eb sot Veriu i vendit \u00ebsht\u00eb administruar n\u00eb m\u00ebnyr\u00eb faktike nga Serbia. NATO-ja ka sh\u00ebrbyer aty p\u00ebr t\u00eb mos lejuar p\u00ebrligjen formale t\u00eb nj\u00eb shtrirjeje t\u00eb k\u00ebtill\u00eb t\u00eb sovranitetit t\u00eb Serbis\u00eb. Procesi i \u201cnormalizimit\u201d, ashtu si\u00e7 shpjegohet nga negociator\u00ebt, po k\u00ebrkon nj\u00eb shteg t\u00eb mes\u00ebm mes gjendjes faktike dhe rregullimit kushtetues-juridik t\u00eb Kosov\u00ebs. Kjo do t\u00eb thot\u00eb se po k\u00ebrkohet nj\u00eb \u201ckompromis i dhimbsh\u00ebm\u201d mes nd\u00ebrhyrjes s\u00eb Serbis\u00eb n\u00eb sovranitetin e Kosov\u00ebs dhe Paket\u00ebs s\u00eb Ahtisaarit.<\/p>\n<p>Rezultati mund t\u00eb jet\u00eb nj\u00eb \u201cAhtisaari plus\u201d dhe k\u00ebtu ka dy probleme.<\/p>\n<p>I pari \u00ebsht\u00eb se Paketa e Ahtisaarit \u00ebsht\u00eb tashm\u00eb kategori kushtetuese e Kosov\u00ebs; nd\u00ebrhyrja n\u00eb t\u00eb n\u00ebnkupton nevoj\u00ebn p\u00ebr nj\u00eb proces t\u00eb ve\u00e7ant\u00eb, t\u00eb nd\u00ebrlikuar, t\u00eb ndryshimeve kushtetuese.<\/p>\n<p>I dyti \u00ebsht\u00eb se Paketa e Ahtisaarit \u00ebsht\u00eb edhe ashtu nj\u00eb kompromis mes negociator\u00ebve nd\u00ebrkomb\u00ebtar\u00eb dhe atyre kosovar\u00eb, nj\u00eb kompromis q\u00eb mb\u00ebrrin tehun e rreziksh\u00ebm te kufijt\u00eb e funksionalitetit t\u00eb shtetit n\u00eb materien e t\u00eb drejtave t\u00eb minoriteteve. Nd\u00ebrhyrja n\u00eb k\u00ebt\u00eb Paket\u00eb mund ta \u00e7oj\u00eb drejt paralizimit funksionimin e shtetit.<\/p>\n<p>Kjo \u00ebsht\u00eb sa i p\u00ebrket form\u00ebs. Tash sa i p\u00ebrket substanc\u00ebs. N\u00ebse \u00ebsht\u00eb e v\u00ebrtet\u00eb se pal\u00ebt negociatore jan\u00eb af\u00ebr kompromisit dhe se kompromisi n\u00ebnkupton nj\u00ebkoh\u00ebsisht suspendimin e nd\u00ebrhyrjes s\u00eb Serbis\u00eb n\u00eb sovranitetin e Kosov\u00ebs n\u00eb Veri (apo kudo q\u00eb ka serb\u00eb) dhe suspendimin e Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb Veri (aty ku nuk \u00ebsht\u00eb i mundur implementimi pa forc\u00eb) at\u00ebher\u00eb kompromisi n\u00eb Veri do t\u00eb jet\u00eb vendosja e nj\u00eb sistemi t\u00eb ve\u00e7ant\u00eb administrimi.<\/p>\n<p>N\u00eb munges\u00eb t\u00eb njohjes nga ana e Serbis\u00eb se Kosova ka sistemin e vet kushtetues juridik, dhe duke k\u00ebrkuar kompromis, \u00ebsht\u00eb fare e mundur q\u00eb ky sistem i ve\u00e7ant\u00eb i administrimit n\u00eb Veri t\u00eb jet\u00eb objekt i \u201cambiguitetit kreativ\u201d. P\u00ebr Brukselin kjo mund t\u00eb jet\u00eb nj\u00eb lloj OJQ-je, p\u00ebr Prishtin\u00ebn po ashtu (t\u00eb bindur nga Brukseli, p\u00ebr m\u00eb tep\u00ebr duke e gjetur k\u00ebt\u00eb formulim n\u00eb Kushtetut\u00ebn e Kosov\u00ebs) , por p\u00ebr lider\u00ebt serb\u00eb n\u00eb Veri dhe p\u00ebr Beogradin zyrtar mund t\u00eb jet\u00eb nj\u00eb form\u00eb elegante e vendosjes s\u00eb rrafshit t\u00eb tret\u00eb t\u00eb pushtetit. Pra, n\u00eb mes t\u00eb pushtetit qendror dhe atij komunal, t\u00eb vendoset rrafshi i pushtetit t\u00eb nj\u00eb autonomie territoriale-politike serbe n\u00eb Kosov\u00eb.<\/p>\n<p>Ky Asociacion (Autonomi) mund t\u2019i shfryt\u00ebzoj\u00eb disa p\u00ebrpar\u00ebsi, q\u00eb tashm\u00eb jan\u00eb precedenc\u00eb juridike.<\/p>\n<p>Fillimisht, t\u00eb shfryt\u00ebzoj\u00eb ato provizione t\u00eb Ahtisaarit q\u00eb i konvenojn\u00eb (p\u00ebr shembull, vendosjen e sistemit t\u00eb arsimit sipas planprogrameve t\u00eb Serbis\u00eb, pa pasur nevoj\u00eb q\u00eb t\u00eb respektoj\u00eb provizionin tjet\u00ebr, q\u00eb k\u00ebrkon p\u00eblqimin e Ministris\u00eb s\u00eb Arsimit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs), dhe k\u00ebshtu t\u00eb p\u00ebrligjin forc\u00ebn e vet ekzekutive.<\/p>\n<p>Pastaj t\u00eb shfryt\u00ebzoj\u00eb precedencat juridike t\u00eb \u201cbisedimeve teknike\u201d, ku Kosova ka pranuar q\u00eb t\u00eb administroj\u00eb bashk\u00ebrisht me Serbin\u00eb dokumentet e veta civile dhe kadastrale. Madje, Asociacioni do t\u2019i ket\u00eb polic\u00ebt e vet, q\u00eb Prishtina zyrtare do t\u2019i konsideroj\u00eb si t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs. A do t\u00eb jet\u00eb Kosova m\u00eb demokratike se deri tani?<\/p>\n<p>N\u00eb jet\u00ebn politike t\u00eb brendshme, deri tani, procesi i \u201cnormalizimit\u201d e ka institucionalizuar g\u00ebnjeshtr\u00ebn.
