Sali Berisha po tenton \u201cgrusht shteti\u201d n\u00eb Kuvend. Propozon ndryshime kushtetuese dhe i jep te drejte vetes tashme:<\/p>\n

T\u00eb arrestoj\u00eb deputet\u00eb t\u00eb Kuvendit, me votim t\u00eb hapur t\u00eb mazhoranc\u00ebs s\u00eb tij politike n\u00eb Kuvend.<\/p>\n

N\u00ebse k\u00ebto ndryshime miratohen, at\u00ebher\u00eb nuk ka m\u00eb Kuvend. Nuk ka m\u00eb as demokraci. Ka vet\u00ebm nj\u00eb parti q\u00eb ka presidentin- q\u00eb em\u00ebron prokurorin dhe gjykat\u00ebsit e lart\u00eb(k\u00ebta akuzojn\u00eb dhe gjykojn\u00eb deputet\u00ebt);<\/p>\n

Ka kryeministrin- q\u00eb em\u00ebron ministrin e Brendsh\u00ebm dhe drejtorin e Policis\u00eb s\u00eb Shtetit(ky \u00ebsht\u00eb organi q\u00eb ekzekuton urdh\u00ebr arrestet);<\/p>\n

Ka kryetarin e Kuvendit- q\u00eb drejton mazhoranc\u00ebn politike(kjo shumic\u00eb lejon arrestimet me vot\u00eb t\u00eb hapur n\u00eb Kuvend).<\/p>\n

Kjo eshte skema e grushtit te shtetit qysh kur partia u be njesh me shtetin!<\/p>\n

Kjo duhet t\u00eb ndalet me \u00e7do kusht, ndryshe nuk ka m\u00eb demokraci e parlamentariz\u00ebm.<\/p>\n

Neni 73\/Ishte<\/p>\n

1. Deputeti nuk mban pergjegjesi per mendimet e shprehura ne Kuvend dhe per votat e dhena prej tij. Kjo dispozite nuk zbatohet ne<\/p>\n

rastin e shpifjes.<\/p>\n

2. Deputeti nuk mund te ndiqet penalisht pa autorizimin e Kuvendit. Autorizimi kerkohet edhe ne rastin kur ai do te arrestohet.<\/p>\n

3. Deputeti mund te ndalohet ose te arrestohet pa autorizim kur kapet ne kryerje e siper ose menjehere pas kryerjes se nje krimi te<\/p>\n

rende. Ne keto raste, Prokurori i Pergjithshem njofton menjehere Kuvendin, i cili, kur konstaton se nuk ka vend per procedim, vendos<\/p>\n

per heqjen e mases.<\/p>\n

4. Per rastet e parashikuara ne paragrafet 2 dhe 3 te ketij neni, Kuvendi vendos me votim te fshehte .<\/p>\n

Neni 73\/e ben PD<\/p>\n

1. Deputeti nuk mban p\u00ebrgjegj\u00ebsi penale, civile ose ndonj\u00eb lloj tjet\u00ebr p\u00ebrgjegj\u00ebsie p\u00ebr mendimet e shprehura dhe votat e hedhura n\u00eb Kuvend n\u00eb ushtrim t\u00eb detyrave dhe t\u00eb drejtave t\u00eb tij si deputet. Kjo dispozit\u00eb nuk zbatohet n\u00eb rastin e shpifjes.<\/p>\n

2. Deputeti nuk mund t\u00eb arrestohet ose t\u00eb privohet nga liria personale e tij n\u00eb ndonj\u00eb form\u00eb, dhe ai nuk mund t\u2019i n\u00ebnshtrohet kontrollit vetjak ose t\u00eb sht\u00ebpis\u00eb s\u00eb tij\/saj n\u00eb qoft\u00eb se dhe p\u00ebr sa koh\u00eb, Kuvendi (ose nj\u00eb organ i caktuar i tij) k\u00ebrkon zbatimin e imunitetit te deputetit ndaj k\u00ebtyre masave. Kuvendi mund ta k\u00ebrkoj\u00eb zbatimin e imunitetit vet\u00ebm me arsyen se po cenohet ndjesh\u00ebm funksionimi i Kuvendit. Kuvendi duhet t\u00eb njoftohet menj\u00ebher\u00eb sapo q\u00eb nis t\u00eb ekzekutohet ndonj\u00ebra nga masat e m\u00ebsip\u00ebrme.<\/p>\n

Shihini ndryshimet ne nene:<\/p>\n

1. Deputeti nuk mund te ndiqej penalisht e as te arrestohej pa leje te Kuvendit.<\/p>\n

Kerkohej qe: leja e Kuvendit per procedimin penal te shfuqizohej per veprat penale te korrupsionit.<\/p>\n

PD heq: lejen e Kuvendit per procedim penal pa kufi; lejen per arrestimin e deputetit po perseri pa kufi.<\/p>\n

2.Deputeti mund te arrejtohej ne kushtet e flagrances por kur Kuvendi, konstaton se nuk ka vend per procedim, vendos me votim te fshehte heqjen e mases se arrestit.<\/p>\n

PD heq teresisht: konceptin e \u201carrestit ne flagrance\u201d, per te deputeti mund te arrestohet lirshem kurdo; Kuvendi mund te kerkoj sbatimin e imunitetit vetem nese veren qe cenohet rende funksionimi i tij; kete e vendos maxhoranca politike me votim te hapur!<\/p>\n
