P\u00ebr m\u00eb tep\u00ebr, pse i rrah kur ata k\u00ebrkojn\u00eb q\u00eb t\u00eb respektohen interesat e vendit, ashtu si\u00e7 i ka p\u00ebrcaktuar Kuvendi. Krahasuar me k\u00ebto m\u00ebkate, ai i \u201cVet\u00ebvendosjes\u201d duket loj\u00eb f\u00ebmij\u00ebsh<\/p>\n<p><strong>1<\/strong>.<\/p>\n<p>Pengimi i dhunsh\u00ebm i demonstratave t\u00eb \u201cVet\u00ebvendosjes\u201d m\u00eb 14 janar t\u00eb k\u00ebtij viti tregon degradimin e m\u00ebtejm\u00eb t\u00eb funksionimit t\u00eb brisht\u00eb t\u00eb demokracis\u00eb kosovare dhe \u00ebsht\u00eb edhe nj\u00eb sinjal alarmi p\u00ebr shtetin e ri.<\/p>\n<p>E qart\u00eb, ajo q\u00eb u pa n\u00eb sip\u00ebrfaqe t\u00eb ngjarjes, n\u00eb af\u00ebrsi t\u00eb Podujev\u00ebs, ishte ushtrimi i dhun\u00ebs nga ana e policis\u00eb s\u00eb Kosov\u00ebs kund\u00ebr protestuesve t\u00eb padhunsh\u00ebm. E me k\u00ebt\u00eb, edhe sinjali i Qeveris\u00eb s\u00eb Kosov\u00ebs se nuk ka toleranc\u00eb ndaj protest\u00ebs \u2013 s\u00eb paku ndaj protest\u00ebs s\u00eb shqiptar\u00ebve. Rrjedhimisht, dhe po t\u00eb q\u00ebndroj\u00eb k\u00ebshtu, do t\u00eb nd\u00ebrtohet nj\u00eb parim i rreziksh\u00ebm p\u00ebr shoq\u00ebrin\u00eb, e ai \u00ebsht\u00eb e drejta e seleksionimit nga ana e Qeveris\u00eb se kush guxon t\u00eb protestoj\u00eb dhe kush nuk guxon ta b\u00ebj\u00eb k\u00ebt\u00eb, ani pse p\u00ebrdor metoda t\u00eb padhunshme.<\/p>\n<p>Vendi ka kaluar n\u00ebp\u00ebr arbitraritetin qeveritar m\u00eb her\u00ebt \u2013 vet\u00ebm se ka qen\u00eb nj\u00eb sistem krejt\u00ebsisht tjet\u00ebr, q\u00eb pau fundin e vet me bomba t\u00eb NATO-s.<\/p>\n<p><strong>2<\/strong>.<\/p>\n<p>Problemi \u00ebsht\u00eb edhe m\u00eb i thelluar se kaq, kur shohim se n\u00eb mesin e t\u00eb rrahurve dhe t\u00eb t\u00eb arrestuarve ka deputet\u00eb t\u00eb Kuvendit t\u00eb Kosov\u00ebs. Urdh\u00ebrdh\u00ebn\u00ebsit e k\u00ebtij aksioni vun\u00eb n\u00eb nj\u00eb situat\u00eb t\u00eb pap\u00ebrputhshme me demokracin\u00eb nj\u00ebsitet e policis\u00eb s\u00eb Kosov\u00ebs: ato l\u00ebre q\u00eb nuk kan\u00eb t\u00eb drejt\u00eb t\u00eb rrahin e t\u00eb arrestojn\u00eb protestues t\u00eb padhunsh\u00ebm, por aq m\u00eb pak kan\u00eb t\u00eb drejt\u00eb t\u00eb rrahin e t\u00eb arrestojn\u00eb deputet\u00eb t\u00eb Kuvendit t\u00eb Kosov\u00ebs. Deputet\u00ebt e p\u00ebrfshir\u00eb n\u00eb k\u00ebto protesta konsideronin se po e kryenin mandatin e tyre, si p\u00ebrfaq\u00ebsues t\u00eb zgjedh\u00ebsve t\u00eb vet, dhe p\u00ebrfshirja e tyre n\u00eb protest\u00eb nuk kishte asnj\u00eb element t\u00eb veprimit kriminal p\u00ebr \u00e7ka do t\u00eb mund t\u00eb ndiqeshin eventualisht.<\/p>\n<p>Rrahja dhe arrestimi i deputet\u00ebve t\u00eb \u201cVet\u00ebvendosjes\u201d p\u00ebrb\u00ebn nj\u00eb shkelje t\u00eb r\u00ebnd\u00eb ligjore. \u00cbsht\u00eb edhe pengim i dhunsh\u00ebm i kryerjes s\u00eb funksionit t\u00eb deputetit. \u00cbsht\u00eb edhe cenim i vot\u00ebs s\u00eb lir\u00eb t\u00eb qytetar\u00ebve, i shnd\u00ebrruar n\u00eb mandat t\u00eb deputetit. \u00cbsht\u00eb edhe p\u00ebrmbysje e interpretimit t\u00eb Kushtetut\u00ebs: polic\u00ebt rrah\u00ebn dhe arrestuan epror\u00ebt e vet. Deputeti i Kuvendit t\u00eb Kosov\u00ebs zgjedh Qeverin\u00eb e Qeveria, n\u00eb baz\u00eb t\u00eb k\u00ebtij mandati t\u00eb marr\u00eb urdh\u00ebron policin\u00eb. Vet\u00ebm n\u00eb sisteme jodemokratike mund t\u2019i urdh\u00ebroj\u00eb policia pjes\u00ebtar\u00ebt e Parlamentit se \u00e7ka t\u00eb b\u00ebjn\u00eb.<\/p>\n<p><strong>3<\/strong>.<\/p>\n<p>Veprimi i polic\u00ebve, natyrisht, nuk ishte shprehje e vullnetit individual t\u00eb tyre. Po t\u00eb ishte k\u00ebshtu, at\u00ebher\u00eb n\u00eb Podujev\u00eb e n\u00eb pik\u00ebn kufitare t\u00eb Dheut t\u00eb Bardh\u00eb do t\u00eb flisnim p\u00ebr tejkalim kompetencash t\u00eb pjes\u00ebtar\u00ebve t\u00eb policis\u00eb.<\/p>\n<p>Nuk \u00ebsht\u00eb k\u00ebshtu. Veprimi i policis\u00eb ishte tejkalim kompetencash i Qeveris\u00eb. Shp\u00ebrfillja e Qeveris\u00eb e t\u00eb s\u00eb drejt\u00ebs p\u00ebr t\u00eb protestuar, qoft\u00eb t\u00eb qytetarit, qoft\u00eb t\u00eb deputetit pason nj\u00eb shp\u00ebrfillje paraprake, at\u00eb t\u00eb vendimeve t\u00eb Kuvendit t\u00eb Kosov\u00ebs.<\/p>\n<p>Me iniciativ\u00eb t\u00eb l\u00ebvizjes \u201cVet\u00ebvendosje\u201d dhe me p\u00ebrkrahje t\u00eb deputet\u00ebve t\u00eb shum\u00eb subjekteve t\u00eb tjera parlamentare (p\u00ebrfshir\u00eb edhe t\u00eb atyre t\u00eb Pushtetit), Kuvendi mori nj\u00eb vendim me t\u00eb cilin Qeveria obligohet q\u00eb t\u00eb vendos\u00eb marr\u00ebdh\u00ebnie reciproke me Serbin\u00eb.<\/p>\n<p>Qeveria deri m\u00eb tani nuk ka marr\u00eb n\u00eb shqyrtim ndonj\u00eb informat\u00eb p\u00ebrmbledh\u00ebse e l\u00ebre m\u00eb t\u2019i raportoj\u00eb Kuvendit se \u00e7ka ka nd\u00ebrmarr\u00eb n\u00eb kryerjen e obligimit t\u00eb vendosur nga organi m\u00eb i lart\u00eb i vendit. N\u00eb vend t\u00eb shqyrtimit, t\u00eb p\u00ebrpilimit t\u00eb detyrave dhe raportimit, Qeveria me nj\u00eb doz\u00eb t\u00eb theksuar harbut\u00ebrie deklaroi se k\u00ebt\u00eb vendim e konsideron k\u00ebshill\u00ebdh\u00ebn\u00ebs, pastaj se edhe ashtu \u00ebsht\u00eb duke e p\u00ebrmbushur reciprocitetin dhe n\u00eb fund e akuzoi \u201cVet\u00ebvendosjen\u201d se po sillet nj\u00ebjt\u00eb sikur nj\u00eb i arrestuar p\u00ebr kontraband\u00eb arm\u00ebsh dhe kush e di \u00e7ka tjet\u00ebr me emrin Veselinoviq.<\/p>\n<p>Obligimi i nj\u00eb qeverie demokratike, n\u00eb k\u00ebt\u00eb nj\u00eb muaj e gjysm\u00eb, prej se \u00ebsht\u00eb marr\u00eb vendimi n\u00eb Kuvend, ka qen\u00eb q\u00eb s\u00eb paku t\u00eb ftohen \u201cVet\u00ebvendosja\u201d dhe partit\u00eb e tjera votuese t\u00eb k\u00ebtij vendimi p\u00ebr t\u00eb b\u00ebr\u00eb nj\u00eb bilanc: \u00e7ka \u00ebsht\u00eb b\u00ebr\u00eb deri tani n\u00eb vendosjen e reciprocitetit, \u00e7ka po mungon sipas partive n\u00eb opozit\u00eb, \u00e7ka mund dhe duhet t\u00eb b\u00ebhet m\u00eb tutje.<\/p>\n<p>Kjo gjendje quhet dialog, kusht paraprak p\u00ebr zgjidhje brenda institucionale, di\u00e7ka q\u00eb duket e panjohur p\u00ebr pushtetin e tanish\u00ebm.<\/p>\n<p>Kjo qeveri, n\u00eb vend t\u00eb ftes\u00ebs p\u00ebr zbatim t\u00eb p\u00ebrbashk\u00ebt t\u00eb obligimeve t\u00eb vendosura n\u00eb Kuvend \u00ebsht\u00eb k\u00ebrc\u00ebnuar s\u00eb pari verbalisht ndaj prij\u00ebsve t\u00eb \u201cVet\u00ebvendosjes\u201d, e pastaj k\u00ebt\u00eb k\u00ebrc\u00ebnim e ka zbatuar me dhun\u00eb policore.<\/p>\n<p>Duke shkelur mbi protestuesit, Qeveria ka shkelur me t\u00eb dyja k\u00ebmb\u00ebt edhe mbi relacionin demokratik mes Kuvendit dhe Qeveris\u00eb: ka zgjedhur t\u00eb mos e p\u00ebrfill\u00eb vendimin e Kuvendit, e madje edhe t\u00eb shkelmoj\u00eb t\u00eb gjith\u00eb ata q\u00eb menduan se duke protestuar n\u00eb rrug\u00eb po e mbronin mu at\u00eb vendim t\u00eb Kuvendit.<\/p>\n<p>K\u00ebshtu ia ka hapur rrug\u00ebn vetes q\u00eb t\u00eb vendos\u00eb parimin e arbitraritetit: do t\u00eb respektoj\u00eb \u00e7ka dhe kur t\u00eb doj\u00eb nga Kuvendi i Kosov\u00ebs, e kur k\u00ebt\u00eb nuk do ta b\u00ebj\u00eb mund t\u00eb p\u00ebrdor\u00eb edhe forc\u00ebn.<\/p>\n<p><strong>4<\/strong>.<\/p>\n<p>Kurthi i arbitraritetit rri edhe mbi kok\u00ebn e \u201cVet\u00ebvendosjes\u201d. Dikush mund t\u00eb akuzoj\u00eb, ndoshta edhe me t\u00eb drejt\u00eb, se \u201cVet\u00ebvendosja\u201d ka zgjedhur t\u00eb b\u00ebhet \u201carbitri kufitar\u201d i cili do t\u00eb p\u00ebrcaktoj\u00eb se cili kamion do t\u00eb kaloj\u00eb e cili jo, cila vetur\u00eb b\u00ebn t\u00eb hyj\u00eb n\u00eb Kosov\u00eb e cila jo. K\u00ebto pun\u00eb i kan\u00eb qartazi polic\u00ebt dhe doganier\u00ebt e Kosov\u00ebs, dhe \u201cVet\u00ebvendosja\u201d nuk mund t\u2019ua marr\u00eb atyre kompetencat. Por ky arbitraritet duhet t\u00eb konsiderohet brenda kontekstit t\u00eb arbitraritetit m\u00eb t\u00eb madh, atij t\u00eb Qeveris\u00eb. N\u00ebse Qeveria nuk i urdh\u00ebron polic\u00ebt e doganier\u00ebt kosovar\u00eb q\u00eb t\u00eb respektojn\u00eb nj\u00eb marr\u00ebdh\u00ebnie reciproke me Serbin\u00eb pse t\u00eb akuzohet \u201cVet\u00ebvendosja\u201d q\u00eb dashka t\u00eb b\u00ebnte nj\u00eb gj\u00eb t\u00eb till\u00eb me vetiniciativ\u00eb?<\/p>\n<p>N\u00eb nj\u00eb shtet demokratik, veprimi i k\u00ebtill\u00eb i \u201cVet\u00ebvendosjes\u201d ndoshta do t\u00eb interpretohej si nj\u00eb veprim arbitrar, por edhe m\u00eb tep\u00ebr, si nj\u00eb veprim q\u00eb simbolizon d\u00ebshtimin e institucioneve t\u00eb Kosov\u00ebs. Debati n\u00eb shoq\u00ebrin\u00eb demokratike nuk do t\u00eb drejtohej kah pyetja se a kan\u00eb t\u00eb drejt\u00eb aktivist\u00ebt e \u201cVet\u00ebvendosjes\u201d q\u00eb t\u00eb p\u00ebrcaktojn\u00eb se cila vetur\u00eb e kalon kufirin, por p\u00ebrse Qeveria e vendit nuk e ka plot\u00ebsuar obligimin ndaj t\u00eb zgjedhurve t\u00eb popullit. P\u00ebr m\u00eb tep\u00ebr, pse i rrah kur ata k\u00ebrkojn\u00eb q\u00eb t\u00eb respektohen interesat e vendit, ashtu si\u00e7 i ka p\u00ebrcaktuar Kuvendi. Krahasuar me k\u00ebto m\u00ebkate, ai i \u201cVet\u00ebvendosjes\u201d duket loj\u00eb f\u00ebmij\u00ebsh.<\/p>\n<p>L\u00ebvizja \u201cVet\u00ebvendosje\u201d \u00ebsht\u00eb portretuar pa t\u00eb drejt\u00eb me tone alarmuese nga ana e Qeveris\u00eb, medieve t\u00eb tyre dhe disa p\u00ebrfaq\u00ebsuesve nd\u00ebrkomb\u00ebtar\u00eb. K\u00ebta t\u00eb fundit do t\u00eb mund t\u00eb ishin m\u00eb konsekuent\u00eb n\u00eb fjal\u00ebt e tyre dhe para se t\u00eb deklaroheshin, do t\u00eb mund t\u00eb lexonin Raportin e Progresit t\u00eb Komisionit Evropian t\u00eb tri viteve t\u00eb fundit. Aty, n\u00eb form\u00eb t\u00eb p\u00ebrhershme vler\u00ebsohet si dob\u00ebsi e madhe e Kosov\u00ebs shp\u00ebrfillja e Kuvendit t\u00eb Kosov\u00ebs nga ana e Qeveris\u00eb. Po t\u00eb ishin konsekuent\u00eb n\u00eb analiz\u00eb do t\u00eb duhej t\u00eb pranonin se n\u00eb form\u00eb paradoksale, jo edhe gjithaq t\u00eb dashur e t\u00eb duhur ndoshta, por l\u00ebvizja \u201cVet\u00ebvendosje\u201d po i zbaton rekomandimet e Komisionit Evropian, p\u00ebr dallim prej Qeveris\u00eb.<\/p>\n<p><strong>5<\/strong>.<\/p>\n<p>Para nj\u00eb viti vendi ishte n\u00eb nj\u00eb kriz\u00eb politike t\u00eb krijuar, kryesisht, nga partia e cila sot \u00ebsht\u00eb n\u00eb pushtet.<\/p>\n<p>Ajo p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb nd\u00ebrtoi institucionet e veta paralele, me burime gjithsesi t\u00eb dyshimta financimi. P\u00ebr pothuaj nj\u00eb dhjet\u00ebvjet\u00ebsh kishte policin\u00eb e vet sekrete, jasht\u00eb \u00e7do kontrolli institucional. Pastaj organizoi nj\u00eb struktur\u00eb p\u00ebr vjedhje votash, e cila nuk u nd\u00ebshkua nga ligji, duke e legjitimuar si partin\u00eb, ashtu edhe instrumentin e vjedhjes s\u00eb vot\u00ebs.<\/p>\n<p>Pushteti arriti t\u00eb funksionoj\u00eb si \u201cstruktur\u00eb paralele\u201d n\u00eb shum\u00eb vendime, prej atij prej negociatave me Serbin\u00eb e deri te nd\u00ebrtimi i autostrad\u00ebs, me nj\u00eb kontrat\u00eb \u201cfantome\u201d q\u00eb do t\u00eb kushtoj\u00eb nj\u00eb miliard euro.<\/p>\n<p>Me veprimin e 14 janarit Qeveria e dha kontributin edhe p\u00ebr vul\u00ebn e vet politike.
