Shum\u00eb njer\u00ebz, sidomos ata q\u00eb nuk durojn\u00eb dot m\u00eb Ilir Met\u00ebn, jan\u00eb t\u00eb d\u00ebshp\u00ebruar pse akuza ka k\u00ebrkuar dy vjet burg p\u00ebr t\u00eb. T\u00eb tjer\u00eb jan\u00eb t\u00eb d\u00ebshp\u00ebruar se e din\u00eb q\u00eb Gjykata e Lart\u00eb do ta hedh\u00eb posht\u00eb k\u00ebrkes\u00ebn e akuz\u00ebs. T\u00eb gjitha k\u00ebto jan\u00eb emocione q\u00eb prodhohen jo nga rasti konkret, por nga historia e rasteve t\u00eb pand\u00ebshkueshm\u00ebris\u00eb n\u00eb Shqip\u00ebri. E v\u00ebrteta q\u00eb un\u00eb lexova n\u00eb pretenc\u00eb, \u00ebsht\u00eb nj\u00eb pun\u00eb e lavd\u00ebrueshme. Prokuror\u00ebt Bujar Sheshi dhe Anila Leka kan\u00eb provuar se Ilir Meta \u00ebsht\u00eb hajdut. Kjo ka shum\u00eb r\u00ebnd\u00ebsi p\u00ebr autoritetin e institucionit t\u00eb akuz\u00ebs n\u00eb Shqip\u00ebri.<\/p>\n<p>Duke qen\u00eb se ai \u00ebsht\u00eb nj\u00eb krim i mbetur n\u00eb tentativ\u00eb, p\u00ebr shkak t\u00eb denoncimit t\u00eb Dritan Priftit, nuk ja vlen t\u00eb gjykojm\u00eb p\u00ebr mas\u00ebn e d\u00ebnimit, sasin\u00eb e viteve t\u00eb burgut, cil\u00ebsin\u00eb e qelis\u00eb apo sasin\u00eb e lek\u00ebve t\u00eb gjob\u00ebs. Duhet t\u00eb gjykojm\u00eb p\u00ebr nj\u00eb cil\u00ebsi q\u00eb po zhdukej nga drejt\u00ebsia shqiptare, aft\u00ebsin\u00eb p\u00ebr t\u00eb gjykuar dhe k\u00ebrkuar d\u00ebnim p\u00ebr nj\u00eb politikan t\u00eb lart\u00eb. Prokuroria e ka b\u00ebr\u00eb k\u00ebt\u00eb akt. Dhe kjo nuk \u00ebsht\u00eb pak. \u00cbsht\u00eb e vetmja rreze shprese n\u00eb err\u00ebsir\u00ebn q\u00eb kan\u00eb prodhuar paragjykimet p\u00ebr drejt\u00ebsin\u00eb shqiptare, e cila nuk na ka zhg\u00ebnjyer kurr\u00eb p\u00ebr t\u00eb qen\u00eb pro pushtetit t\u00eb korruptuar.<\/p>\n<p>Pretenca ndaj Ilir Met\u00ebs \u00ebsht\u00eb nj\u00eb vendim i qart\u00eb p\u00ebr ta nd\u00ebshkuar korrupsionin. N\u00eb pretenc\u00eb ka disa element\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb dala nga hetimi, q\u00eb nuk kan\u00eb lidhje me kaset\u00ebn dhe zhurm\u00ebn rreth saj, ku e p\u00ebrqendroi Berisha dhe Meta mbrojtjen e tyre.<\/p>\n<p>Elementi i par\u00eb q\u00eb t\u00eb ngjall respekt p\u00ebr hetimin \u00ebsht\u00eb se ata kan\u00eb provuar gjith\u00e7ka pa pasur nevoj\u00eb p\u00ebr kaset\u00ebn. Gjith\u00e7ka \u00e7far\u00eb shihet dhe d\u00ebgjohet n\u00eb kaset\u00eb, prokuroria e ka provuar me elemente jasht\u00eb kasete. Fjala vjen, biseda e Ilir Met\u00ebs p\u00ebr 700 mij\u00eb eurot dhe telefonata e tij gjat\u00eb bised\u00ebs me Priftin, mb\u00ebshtetet jo m\u00eb nga ajo q\u00eb shikom\u00eb e d\u00ebgjojm\u00eb, por nga tabulatet telefonike t\u00eb Met\u00ebs, Priftit, Agim Rrapajt, v\u00ebllez\u00ebrve Tola, Halilit dhe gjith\u00eb personazheve t\u00eb asaj afere korruptive. Nd\u00ebrtimi i sken\u00ebs p\u00ebrmes tabulateve, apo d\u00ebshmive t\u00eb personazheve t\u00eb thirrur n\u00ebn hetim, provojn\u00eb at\u00eb q\u00eb ne kemi par\u00eb dhe d\u00ebgjuar n\u00eb kaset\u00eb. Edhe sikur t\u00eb mos ekzistonte ajo kaset\u00eb, me aq fakte sa ka grumbulluar prokuroria, ajo mund t\u00eb xhirohej si nj\u00eb film dhe t\u00eb ishte prap\u00eb reale.<\/p>\n<p>Elementi i dyt\u00eb i r\u00ebnd\u00ebsish\u00ebm i hetimit \u00ebsht\u00eb q\u00ebndrimi ndaj denoncuesit. Organi i akuz\u00ebs ka p\u00ebrligjur faktin pse Dritan Prifti duhet ta regjistronte Ilir Met\u00ebn, pas provave q\u00eb ai ka dh\u00ebn\u00eb dhe q\u00eb jan\u00eb provuar t\u00eb besueshme se ai po i b\u00ebnte presion p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb p\u00ebr disa afera korruptive kundrejt pareve, shp\u00ebrblimeve n\u00eb aksione ose formave t\u00eb tjera. Kjo ka r\u00ebnd\u00ebsi, pasi mbrojtja e Ilir Met\u00ebs u fokusua tek zhvler\u00ebsimi i denoncuesit dhe zhvler\u00ebsimi i kaset\u00ebs. T\u00eb dyja i kan\u00eb d\u00ebshtuar, pasi hetimi ka provuar me element\u00eb t\u00eb tjer\u00eb kaset\u00ebn, dhe i ka dh\u00ebn\u00eb arsyetim jo vet\u00ebm logjik, por dhe ligjor regjistrimit t\u00eb Priftit dhe denoncimit t\u00eb tij.<\/p>\n<p>Nj\u00eb element tjet\u00ebr i r\u00ebnd\u00ebsish\u00ebm n\u00eb pretenc\u00eb duket se \u00ebsht\u00eb dhe zhvler\u00ebsimi i d\u00ebshmitar\u00ebve t\u00eb mbrojtjes, t\u00eb cil\u00ebt kan\u00eb ndryshuar d\u00ebshmit\u00eb e tyre nga prokuroria n\u00eb gjykat\u00eb. Prokuroria l\u00eb t\u00eb kuptoj\u00eb se ka fakte p\u00ebr t\u00eb shkuar\u00ebn e tyre t\u00eb inkriminuar, por nuk ka dashur t\u2019i p\u00ebrfshij\u00eb n\u00eb k\u00ebt\u00eb hetim, duke l\u00ebn\u00eb t\u00eb hapur mund\u00ebsin\u00eb q\u00eb ata t\u00eb rihetohen p\u00ebr deklaratat e tyre. Kjo nuk ka shum\u00eb r\u00ebnd\u00ebsi p\u00ebr procesin, por ka r\u00ebnd\u00ebsi p\u00ebr cil\u00ebsin\u00eb e njer\u00ebzve q\u00eb dalin n\u00eb krah t\u00eb z\u00ebvend\u00ebskryeministrit t\u00eb akuzuar p\u00ebr korrupsion. Eleganca me t\u00eb cil\u00ebn organi i akuz\u00ebs i ka portretizuar k\u00ebta tipa, \u00ebsht\u00eb nj\u00eb aft\u00ebsi e admirueshme profesionale, e cila tregon qart\u00ebsin\u00eb q\u00eb kan\u00eb pasur prokuror\u00ebt e k\u00ebsaj \u00e7\u00ebshtje rreth rastit n\u00eb fjal\u00eb.<\/p>\n<p>Interesant \u00ebsht\u00eb dhe q\u00ebndrimi q\u00eb prokuroria ka mbajtur ndaj p\u00ebrpjekjeve t\u00eb gjykat\u00ebs p\u00ebr t\u00eb zhvler\u00ebsuar si prov\u00eb kaset\u00ebn e regjistruar. Organi i akuz\u00ebs thekson faktin se prokuroria ka pranuar si prov\u00eb t\u00eb vlefshme rrug\u00ebn n\u00eb t\u00eb cil\u00ebn \u00ebsht\u00eb servirur si prov\u00eb kaseta dhe q\u00ebndrimin e ekspert\u00ebve t\u00eb em\u00ebruar prej Ilir Met\u00ebs n\u00eb at\u00eb \u00e7\u00ebshtje e konsideron si dyshues, por t\u00eb pamb\u00ebshtetur n\u00eb prova shkencore. Ky element me pun\u00ebn q\u00eb ka b\u00ebr\u00eb organi i akuz\u00ebs nuk ka m\u00eb r\u00ebnd\u00ebsi pasi ata e kan\u00eb provuar sken\u00ebn e krimit me element\u00eb t\u00eb tjer\u00eb, por ka r\u00ebnd\u00ebsi p\u00ebr t\u00eb zhvler\u00ebsuar furtun\u00ebn politike q\u00eb Berisha ngriti ndaj gazetar\u00ebve t\u00eb Fiks Fare dhe medies n\u00eb p\u00ebrgjith\u00ebsi, q\u00eb u bazua n\u00eb sulmet e saj pik\u00ebrisht tek kjo kaset\u00eb.<\/p>\n<p>Por si\u00e7 e theksova n\u00eb krye t\u00eb k\u00ebtij shkrimi, gj\u00ebja m\u00eb e r\u00ebnd\u00ebsishme q\u00eb sjell kjo pretenc\u00eb nuk jan\u00eb detajet profesionale q\u00eb un\u00eb u p\u00ebrpoqa t\u00eb riprodhoj, por fakti q\u00eb p\u00ebr her\u00eb t\u00eb par\u00eb, nj\u00eb akuz\u00eb e mir\u00ebpunuar p\u00ebr nj\u00eb zyrtar t\u00eb lart\u00eb, p\u00ebrfundon n\u00eb form\u00ebn e nj\u00eb pretence n\u00eb gjykat\u00eb.<\/p>\n<p>Un\u00eb kam lexuar dhe dosjen penale t\u00eb Lul\u00ebzim Bash\u00ebs p\u00ebr segmentin Rr\u00ebshen-Kalimash, ku ai \u00ebsht\u00eb n\u00ebn akuz\u00eb p\u00ebr 220 milion\u00eb euro. Prokurori i Tiran\u00ebs ka b\u00ebr\u00eb nj\u00eb pun\u00eb t\u00eb shk\u00eblqyer dhe p\u00ebr moskompetenc\u00eb e ka kaluar \u00e7\u00ebshtjen n\u00eb Prokurori t\u00eb P\u00ebrgjithshme. Sikur t\u00eb mos ishin b\u00ebr\u00eb loj\u00ebrat me afate dhe blerja e Gjykat\u00ebs s\u00eb Lart\u00eb, n\u00ebse ajo akuz\u00eb p\u00ebrfundonte n\u00eb pretenc\u00eb n\u00eb Gjykat\u00eb, si\u00e7 mund t\u00eb p\u00ebrfundoj\u00eb ndonj\u00eb her\u00eb, ai i akuzuar nuk del m\u00eb nga burgu. Por guximi p\u00ebr ta dor\u00ebzuar at\u00eb n\u00eb Gjykat\u00eb fatkeq\u00ebsisht mungoi, dhe p\u00ebr m\u00eb tep\u00ebr mungoi guximi p\u00ebr ta rihapur \u00e7\u00ebshtjen. Po ashtu Fatmir Mediu, i akuzuar si p\u00ebrgjegj\u00ebs p\u00ebr vdekjen e 26 qytetar\u00ebve n\u00eb biznesin q\u00eb loboi i biri i kryeministrit, nuk p\u00ebrfundoi n\u00eb Gjykat\u00eb p\u00ebr shkak t\u00eb imunitetit.<\/p>\n<p>Ky \u00ebsht\u00eb rasti i par\u00eb n\u00eb historin\u00eb e drejt\u00ebsis\u00eb shqiptare pas vitit 2005 q\u00eb nj\u00eb akuz\u00eb penale arrin t\u00eb formulohet n\u00eb sall\u00ebn e gjyqit n\u00eb form\u00ebn e pretenc\u00ebs nga prokuroria shqiptare. \u00cbsht\u00eb nj\u00eb hap i r\u00ebnd\u00ebsish\u00ebm. Mos gjykoni mas\u00ebn e d\u00ebnimit q\u00eb \u00ebsht\u00eb k\u00ebrkuar dhe as at\u00eb q\u00eb do t\u00eb jap\u00eb Gjykata e Lart\u00eb. Pes\u00eb an\u00ebtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb nuk kan\u00eb shansin t\u00eb jen\u00eb m\u00eb gjyqtar\u00eb t\u00eb k\u00ebsaj \u00e7\u00ebshtje, ata do jen\u00eb thjesht t\u00eb gjykuar. M\u00eb 16 janar gjykohet Gjykata e Lart\u00eb, jo Ilir Meta. Ai \u00ebsht\u00eb tashm\u00eb i gjykuar.<\/p>\n<p>E paragjykuar ka mbetur Gjykata e Shpresa Becajt, p\u00ebr shkakun e vet\u00ebm se nuk na ka zhg\u00ebnjyer kurr\u00eb p\u00ebr t\u00eb zgjedhur mes pazareve me pushtetin dhe drejt\u00ebsis\u00eb, nga ana e drejt\u00ebsis\u00eb. Prokuroria shqiptare ka anuar nga e drejta p\u00ebrball\u00eb pushtetit dhe ky \u00ebsht\u00eb jo vet\u00ebm nj\u00eb lajm i mir\u00eb, por dhe nj\u00eb standard q\u00eb i jep fund epok\u00ebs s\u00eb pand\u00ebshkueshm\u00ebris\u00eb. T\u00eb pakt\u00ebn muri mb\u00ebrriti tek pretenca.
